The PD established, among other things, the permitted and conditionally permitted uses within the PD Zoning District, as well as a site plan which established the setbacks from buildings to property lines. Since the adoption of the PD and the approval of the project in 2013, Regency Centers has started construction on a new 160,000 square foot shopping center in accordance with the approved plans. The approved site plan identified outdoor seating areas for several restaurant tenants that were expected to be located in the center. Some of these outdoor seating areas were expected to be enclosed with City Council fencing (one of the requirements for restaurants that sell alcohol), but the (925)833-6650 enclosures are allowed within the setback areas because they are not considered City Manager (925)833-6650 structures. The tenant (Paxti's Pizza) is processing a (925)833-6606 Human Resources Site Development Review (SDR) Waiver for the modifications they would like to (925)833-6605 Parks&Community Services make to the approved project plans (both the site plan and building elevations) that (925)556-4500 include the construction of an outdoor bar and enclosed seating area. Police (925)833-6670 Public Works/Engineering Because the (new) outdoor bar area is proposed to be attached to the (existing) (925)833-6630 building, the setback between the building and the property line adjacent to Hacienda Drive will be reduced from 44'6" to 15'2". The landscape area separating the outdoor seating area patio from the sidewalk on Hacienda Drive is proposed to remain the same size. The only change is that there will a permanent structure Dublin blfrgi constructed in the patio area, which changes the minimum setbacks approved with 111141medsaato the site plan. III' Staff is intending to approve the SDR Waiver for the outdoor bar and enclosure 2011 fence, and is supportive of the accompanying Minor PD Amendment. www.dublin.ca gov Minor Amendment to a Planned Development(PD)Zoning District A minor amendment to an adopted PD may be approved administratively by the Community Development Director upon a finding that the amendment substantially complies with and does not materially change the provisions or intent of the adopted Planned Development Zoning District Ordinance for the site (DMC 8.32.080). Approval This Minor Amendment to the PD can be approved for the following reasons: 1. The area to be used for outdoor seating in this area is not changing, only the type of structures allowed within the outdoor seating area; 2. The overall amount of development on the site when the outdoor bar is included is within the overall amount of building area allowed for the project site; and 3. Even with the reduced setback, the area for perimeter landscaping is not being reduced. Therefore, the Community Development Director hereby approves a Minor Amendment to Planned Development (PD) Zoning District PLPA-2012-00031 that reduces the setback from tenant space S1H from 44'6" to 15'2" as shown in Exhibit 1.
