3.3 Schaefer Ranch GHAD Board Acceptance of Easement and Deed
STAFF REPORT GEOLOGIC HAZARD ABATEMENT DISTRICT DATE:August 16, 2016 TO: Honorable Mayor and City Councilmembers FROM: Christopher L. Foss, GHAD District Manager SUBJECT: Acceptance of Assignment of Two Easement and Deed Restrictions from Discovery Builders, Inc. Prepared by: Eric Harrell, ENGEO Incorporated, GHAD Services Consultant EXECUTIVE SUMMARY: On August 19, 2014 the Schaefer Ranch Geologic Hazard Abatement District (GHAD) Board of Directors approved Resolution 2-14 allowing GHAD acceptance of maintenance and ownership responsibility within Tract 6765. This request is for the GHAD to accept assignment of two existing easement and deed restrictions from Discovery Builders, Inc. for subdrains with Tract 6765 on privately owned residential lots. STAFF RECOMMENDATION: Resolution District Staff recommends that the Board adopt the Accepting Assignment of Easement and Deed Restrictions from Discovery Builders, Inc. and Authorizing the District Manager to Sign the Related Agreement. FINANCIAL IMPACT: The Schaefer Ranch GHAD already has maintenance responsibility for subdrains within Tract 6765. Maintenance costs, and all other GHAD costs, are paid from revenue generated from the assessments levied on residential and non-residential parcels within the Schaefer Ranch GHAD boundary. DESCRIPTION: The Schaefer Ranch GHAD was formed on December 5, 2006. The adopted Plan of Control for the Schaefer Ranch development is dated November 1, 2006. The Plan of Control describes geologic hazards, provides a plan for prevention, mitigation, abatement, and control of geologic hazards, and identifies the parcels that have or will be conveyed to the GHAD. The Plan of Control also describes the process for conveyance of property and transfer of responsibility from the Schaefer Ranch developer to the GHAD, which for Tract 6765 occurred on August 19, 2014 with the Page 1 of 2 approval of Resolution 3-14. Within Tract 6765, the GHAD monitored and maintained improvements include subdrains in addition to other improvements. The cost of on-going maintenance and control of geologic hazards is funded by assessment levied on residential parcels within the Schaefer Ranch GHAD boundary. Assignment of Easement and Deed Restriction Discovery Builders, Inc. has offered to assign two recorded Grant of Easements and Deed Restriction documents to the GHAD. The Grant of Easement and Deed Restriction documents were recorded March 4, 2009 and August 24, 2011. The Easement and Deed Restrictions cover residential parcels 18-20, 29, 53, 62, 70-85, 96- 99, 113, 114, 118-121, 128-132, 143-145, 195-197, 205, 206, 209-212, 215, 217, 220- 248, 259, 260, and 297-302 within Tract 6765. The purpose of the easement is to allow periodic monitoring maintenance, repair, and replacement activities and to prevent damage to the subdrains. WHEREAS, Staff for the District has reviewed the Grant of Easement and Deed Restriction documents dated February 17, 2009 and August 19, 2011; and WHEREAS, Staff for the District has reviewed the Assignment of Grant of Easement and Deed Restriction document between Discovery Builders, Inc. and the GHAD; and NOW THEREFORE, BE IT RESOLVED that the Board of Directors of the Schaefer Ranch Geologic Hazard Abatement District authorize the District Manager to execute the Assignment of Grant of Easement and Deed Restriction and direct the District Clerk to record the Assignment of Grant of Easement and Deed Restriction in the attached Exhibit A.
