Foss, City Manager SUBJECT: Modification to Ground Lease Option Condition with Dublin Unified School District for Jordan Ranch School/Park Site Prepared by: Linda Smith, Assistant City Manager EXECUTIVE SUMMARY: The City Council will consider a minor modification to a condition for the Jordan Ranch School/Park Site Ground Lease Option. The modification relates to the attachment of storm water treatment plans to the City-approved Park Site Improvement plans in order to execute the Ground Lease Agreement. STAFF RECOMMENDATION: Staff recommends that the City Council, by motion, approve the modification to Condition 5.1.4. FINANCIAL IMPACT: None DESCRIPTION: Dublin Unified School District is seeking a modification to Condition 5.1.4 of the Ground Lease Option Agreement for the school/park site at Jordan Ranch. Specifically, the District seeks to alter Condition 5.1.4 “City staff approval of the plans for the Park Site Improvements submitted to DSA that shall be attached to the Ground Lease as Exhibit D, which shall include storm water treatment for the entire site.” The District is requesting that the City Council remove that portion of the Condition requiring attachment of the storm water treatment plans for the entire site. Review and approval of the storm water treatment plans are already in the City’s purview as the permitting agency. Storm water treatment plans proposed, to date, have fallen short of meeting the site’s storm water requirements, requiring the District to work on new plans. These plans will take additional time that originally anticipated. That portion of the Condition requiring City staff approval of the plans for the Park Site Improvements submitted to DSA shall remain unchanged. Page 1 of 2 While the current agreement allows the District site access to begin grading work prior to the execution of the Lease Agreement, the District’s Lease/Leaseback construction method that it chose to use on this project (following execution of the Ground Lease Option) requires the District to have a fully executed Lease Agreement before beginning any site work. The request to modify this condition will allow the District to stay on track with the construction schedule, with a school delivery date of Fall 2018. Without this revision, it is likely that the District will miss the construction window this year, resulting in the school opening in Fall 2019.
