SUBJECT Request from Tri-Valley Special Education Local
Plan Area (SELPA) to utilize Dublin Swim Center

RECOMMENDATION Consider Request
FINANCIAL STATEMENT : Potential lose of revenue from Swim Lessons
$2,880-$5,760
DESCRIPTION At the March 12, 1990 meeting of the Park and
Recreation Commission, the Commission received a report from Staff
summarizing the proposed summer program for the Dublin Swim Center.
In the report, Staff indicated the need for additional swim lesson
times and recommended that the Tri-Valley SELPA program be relocated.
As a result of this recommendation, the Commission directed Staff to
meet with representatives from the participating school districts as
well as City representatives to determine the feasibility of sharing
the program.
Staff met with representatives from the Cities of Livermore and
Pleasanton as well as representatives from the Dublin, Livermore and
Pleasanton School Districts to discuss the program for 1990 as well as
for future seasons. Neither Livermore nor Pleasanton felt that they
would be able to accommodate the program for 1990 and were unable to
commit for future years. A follow-up meeting is scheduled in May to
further discuss future options.
Correspondence has been received from J. Patrick Fitzpatrick
(attached) requesting that the City reconsider their previous position
with regards to pool availability. Additionally Judy Giles,
coordinator of the program has prepared a supplemental sheet to
justify their request. Their request is as follows:
1. Use of the pool from 9:00-10:00am on Monday -Thursday from June 25
through July 19 with an extended session on Tuesday and Thursday
from July 24 to August 9.
2. Use of pool staff to serve as lifeguards and instructors (City
will be reimbursed for staff costs).
Staff has the following concerns with regards to the program.
Pool Availability
As stated previously, there is a tremendous demand to increase the
number of swim lessons for residents. If the request for use as shown
above is granted, it will impact four out of five sessions of swim
lessons. If the request is limited to Monday through Thursday ending
July 19 only two sessions of swim lessons will be impacted.
Liability Exposure
Swim instruction for the handicapped children is provided by
volunteers recruited by Judy Giles, the program's coordinator, as well
as by City Staff. As the volunteers and Staff do not typically have
the certification required by the American Red Cross in adaptive
aquatics, Staff feels that there is a potential for liability
exposure.
If the Commission is in favor of granting the request by Tri-Valley
SELPA, Staff recommends that the following conditions be imposed:
1. Use is granted for June 25-July 19 only.
2. The City and the School District work to develop an agreement
protecting the City and Staff from liability.
