Thompson, Public l/Vorks Director ATTACHMENTS: RECOMMENDATION.~ FINANCIAL STATEMENT: 1) 2) Resolution Amendment 1 to Agreement with Jennifer Lin Adopt Resolution approving Amendment 1 to the Agreement The combination of this amendment to the agreement and the Development Agreement for the Dublin Ranch project provides that Jennifer Lin will pay additional cost of the design for interchange improvements at the 1-580/Fallon interchange. This additional cost is broken down as follows: Original Design Contract (CCS) Project Management (Cordoba) City Staff Time $ 593,180 '30,000 10,000 633,180 Construction Coordination (not in original scope) Additional Scope of Work: Total Additional. Cost 65,006 56,284 121,290 TOTAL DESIGN COST $754,470 The Developer (Lin) will receive additional credit against payment of future Eastern Dublin Traffic Impact Fees (TIF) in an amount equal to the additional funds advanced for this work. Additional TIF Credit will only be given after cash deposits have been received by the City. Use of this credit is to be defined in the Development Agreement for each project and used according to the established TIF policy. at the time of development. COPIES TO: Martin Inderbitzen, for Jennifer Lin ITEM NO. g:\develop\interchanges\Fallon Rd DesignXagst fallon design amend.doc DESCRIPTION: Improvement of the 1-580/Fallon Road Interchange is a required traffic mitigation for the Dublin Ranch Developments, Areas A-E and F, G & H. The City Council previously approved the preparation of a Project Report and Design Agreement for the design of the 1-580/Fallon Road Interchange Improvements, and this design is currently nearing completion. The additional design of the interchange improvements consists of preparing detailed improvement plans, specifications and estimates for construction of ramp metering, a closed circuit TV camera, reconstruction of median drainage, and expanded Storm Water Pollution Prevention Plan (SWPPP) that was mandated by CalTrans. The previously approved Development Agreement with Jennifer Lin provides for payment of costs related to the design of the needed 1-580/Fallon Road interchange improvements. Since the additional design costs exceed the design contingency, the original Agreement with Jennifer Lin needs to be amended. A separate item on this agenda provides for amending the City's Agreement with CCS Planning and Engineering for preparation of the design. The City Council previously approved an agreement with Eric Cordoba of Cordoba Consulting for project management and coordination services related to improvement of several interchanges, including this interchange project. Staff recommends that the City Council adopt the resolution approving Amendment 1 to the Agreemento RESOLUTION NO. - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AMENDMENT 1 TO AGREEMENT WITH JENNIFER LIN REGARDING DESIGN OF THE 1-580/FALLON ROAD INTERCHANGE IMPROVEMENTS WHEREAS, a part of the mitigation for the Dublin Ranch Areas A-E and F, G & H developments requires improvement of the 1-580/Fallon Road Interchange; and WHEREAS, the City and Jennifer Lin have agreed to the preparation of design documents related to this interchange; and WHEREAS, a credit against payment of future Category 1 Eastern Dublin Traffic Impact fees will be provided to offset each of Jennifer Lin's payments of costs related to the project; NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council approves Amendment 1 to the Agreement with Jennifer Lin regarding preparation of the expanded design scope and costs for the 1-580/Fallon Interchange Improvements. BE IT FURTHER RESOLVED that the Mayor is authorized to execute Amendment 1 to the Agreement. PASSED, APPROVED AND ADOPTED this 1st day of May, 2001. AYES: NOES: ABSENT: ABSTAIN: ATTEST: Mayor City Clerk g:develop\interchangesXFallon Design\reso fallon design.doc / AMENDMENT 1 TO AGREEMENT BETWEEN JENNIFER LIN AND CITY OF DUBLIN REGARDING DESIGN OF THE 1-5801FALLON ROAD INTERCHANGE IMPROVEMENTS THIS AMENDMENT is entered into this day of 2001, between the City of Dublin, a municipal corporation ("City") and Jennifer Lin ('Lin"). RECITALS Through an existing agreement dated May 16,'2000, Lin agreed to fund payment of construction documents for the 1-580/Fallon Road Interchange Improvements. The existing agreement is attached hereto as Exhibit A. B. Pursuant to Paragraph I of the existing' agreement, City has retained CCS Planning and Engineering to prepare the referenced construction documents. C. Pursuant to. Paragraph 2 of the existing agreement, Lin paid an initial deposit of $200,000 to City upon execution of the agreement, and paid additional · funds for a total of $ 663, 180. Due to changes to the original scope of work, additional funds are required to complete design of the interchange improvements. The purpose of this amendment to the existing agreement is to provide for an additional deposit to fund the additional design costs, and to increase the amount of the total contribution accordingly. AGREEMENT Now, therefore, City and Lin agree as follows: The deposit provisions in Paragraph 2 Of the existing agreement are revised to provide that Lin will pay an additional deposit of $91,290 to City contemporaneous with execution of this amendment to be used by City to cover City's additional costs of the construction document preparation as set forth in paragraph D above. 2. The total. contribution amount in Paragraph 2 of the existing agreement is hereby increased from $663,180 to $754,470 to reflect the additional deposit.
