Foss, City Manager SUBJECT: Award of Contract to Granite Construction Company, Waive Minor Bid Irregularity, Approval of Plans and Specifications and Authorize the City Manager to Execute Agreements with Alameda County Transportation Commission for the Dublin Boulevard Widening Project, Project No. ST1012 Prepared by: Michael Boitnott, Capital Improvement Program Manager EXECUTIVE SUMMARY: The City Council will consider awarding a construction contract to Granite Construction Company and approving the plans and specifications for the Dublin Boulevard Widening Project, (CIP Project No. ST1012). The project will widen Dublin Bou levard to three lanes in each direction and modify the median islands between Civic Plaza and Dublin Court. The contract work also includes the addition of bike lanes, new curb gutter and sidewalk along both sides of the street, installing a pedestrian bridge across the Zone 7 channel, and repaving Dublin Boulevard from Civic Plaza to Dougherty Road. STAFF RECOMMENDATION: Adopt the Resolution Approving the Plans and Specifications and Awarding a Contract for Project No. ST1012 to Granite Construction Company and Waive Minor Bid Irregularity for the Dublin Boulevard Widening Project; authorize the City Manager to Execute Agreements with Alameda County Transportation Commission; and approve the budget change. FINANCIAL IMPACT: The total remaining budget for this project is $5,350,000. The low bid for construction, plus contingency, is $6,253,454. Additional funds of $2,125,000 are needed to award the construction contract and cover other project costs, including staff and construction management expenses. There are sufficient funds in the Eastern Dublin Traffic Impact Fee, Category 2 Fund to cover this increase. There is no impact on the General Fund. DESCRIPTION: The 2018-2023 Capital Improvement Program (CIP) includes the Dublin Boulevard Page 2 of 3 Widening Project (CIP No. ST1012) which was broken into two phases. The first phase was the Rule 20A project which undergrounded overhead utility lines, which began construction in May 2017 and is now complete, which cleared the right-of-way for the street improvements phase. This second phase will widen the roadway and construct the street improvements along with conforming existing private surface improvements to the newly constructed segment of Dublin Boulevard. During phase one of the project all the right-of-way and temporary construction easements for the widening along the north side of Dublin Boulevard were acquired. The project plans and specifications for the Dublin Boulevard Widening Project were completed and the project was advertised for bids in May 2018. The project includes the widening of Dublin Boulevard to six travel lanes between Sierra Court/Civic Plaza and Dublin Court; the addition of bicycle lanes on both sides of Dublin Boulevard; intersection improvements at both Sierra and Dublin Courts; new s idewalk on both sides of the street including a pedestrian bridge over a drainage channel east of Dublin Sports Grounds; landscape improvements, including the replacement of the existing street trees plus additional street trees; and bus shelter relocation. The project also includes the construction of curb ramps to comply with the Americans with Disabilities Act (ADA); modifications to median islands; installation of traffic signal video detection system; converting the existing potable landscaping irrigation to recycled; installation of a landscaped bioretention treatment area; relocation of existing water service into the new sidewalk; and the resurfacing of the Dublin Sports Ground parking lot to accommodate a new striping layout to facilitate the stre et widening, with no reduction in the total number of parking stalls. On June 18, 2013 the City Council determined that there is no substantial evidence that the project as mitigated will have a significant effect on the environment, and approved Resolution No.96-13 adopting the Mitigated Negative Declaration. As part of the overall funding for the project, the City was allocated a $3,000,000 Measure BB discretionary grant from the ACTC in July of 2016. Staff is requesting that the City Council authorize the City Manager to execute the funding and reimbursement documents with ACTC for the Dublin Boulevard Widening Project. Bid Results and Construction: The City of Dublin issued the bid package on May 7, 2018 for the widening improvements. A total of three (2) sealed bids were received on June 19, 2018, ranging from $5,678,454.00 to $9,837,737.00. A summary of the bids is provided as Attachment 1. The low bid of $5,678,454.00 was submitted by Granite Construction Company and the bid contained an arithmetic error between an item unit cost and the mathematical sum which subsequently decreased the total base bid price by $90,500. The Public Contract Code and the City’s bid documents define this as a “minor bid irregularity,” and authorize the City to “waive” this irregularity and proceed with the award of the contract. Staff reviewed the bid results, checked references, and necessary licenses, and recommends that the City Council adopt the Resolution awarding the project construction contract to Granite Construction Company, as the lowest responsive bidder. Page 3 of 3 To facilitate the approval of contract change orders and to avoid construction delay, it is requested that the City Manager be authorized to approve change orders up to the contingency amount of $575,000.00. The Resolution will authorize this change as it relates to this Project. Construction Hours: This segment of Dublin Boulevard is a critical east/west arterial that carries, on average, over 32,000 vehicle trips a day, with most trips occurring d uring the daytime. The road widening work will require temporary lane closures during construction. In an effort to minimize traffic congestion, impacts to business, and impacts to the overall community, the project bid documents require the contractor con struct the improvements at night between the hours of 8:00 pm and 6:00 am Sunday through Friday, with weekend work by special request requiring Staff approval. These are the same restriction as with the successfully completed Rule 20A utility phase of the project and the City received very few complaints associated with the nighttime construction. Staff expects the project to begin in August and anticipates completion of the majority of the improvements by summer 2019. NOTICING REQUIREMENTS/PUBLIC OUTREACH: A copy of this staff report was sent to Granite Construction Company and to the Alameda County Transportation Commission, Independent Watchdog Committee. Ar r o w S i g n C o m p a n y Co n t e c h E n g i n e e r S o l u t i o n 6 RESOLUTION NO. - 18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * APPROVING THE PLANS AND SPECIFICATIONS; AWARDING A CONTRACT TO GRANITE CONSTRUCTION COMPANY AND WAIVE MINOR BID IRREGULARITY; AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH ALAMEDA COUNTY TRANSPORTATION COMMISSION FOR DUBLIN BOULEVARD WIDENING PROJECT, PROJECT NO. ST1012 WHEREAS, the design team has completed the plans and specifications for the Dublin Boulevard Widening Project CIP No. ST1012 (“Project”). The work includes widening Dublin Boulevard to three lanes in each direction and modify the median islands betwee n Civic Plaza and Dublin Court, the addition of bike lanes, new curb gutter and sidewalk along both sides of the street, installing a pedestrian bridge across the Zone 7 channel, and repaving Dublin Boulevard from Civic Plaza to Dougherty Road; and WHEREAS, the City of Dublin did, on June 19, 2018, publicly open, examine, and declare all sealed bids for doing the work described in the approved Plans and Specification for the Project, which Plans and Specification are hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under the request for bids; and, WHEREAS, Granite Construction Company’s bid contained a minor bid irregularity in that there was a mathematic error decreasing the proposed contract price by $90,500 and the Public Contract Code and the City’s bid documents authorize the City to waive any minor irregularity and proceed with the award of the contract; and WHEREAS, said bids were submitted to the Public Works Director, who has recommended that the bid hereinafter is the lowest responsive responsible bid for doing said work. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby approves the plans and specifications for the Project. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby authorizes the City Manager to execute agreements with Alameda County Transportation Commission for the project. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby waive the minor bid irregularity since the mathematical error only decreased the lowest responsible bid by $90,500. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby award the Contract for the Project, to the lowest responsive responsible bidder therefore, to wit, Granite Construction Company, at a bid of Five Million, Six Hundred and Seventy-Eight Thousand, Four Hundred and Fifty-Four Dollars and no cents ($5,678,454.00) the particulars of which bid are on file in the Office of the Public Works Director. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby authorize the City Manager of his d esignee to approve the Project Contract Change Orders based on the appropriated funds designated for the Project up to the contingency amount of $575,000. BE IT FURTHER RESOLVED that the City Manager is authorized to execute the Project Construction Agreement.
