Foss, City Manager SUBJECT: Approve Contract Services Agreement with Western Pacific Signal, LLC. and JAM Services, Inc. Prepared by: Obaid Khan, Transportation and Operations Manager EXECUTIVE SUMMARY: The City Council will consider approving sole source contract services agreements with Western Pacific Signal, LLC and Jam Services, Inc. for the purchase and maintenance of specialized traffic signal communication and infrastructure equipment. STAFF RECOMMENDATION: Adopt the Resolution Approving Contract Services Agreement with Western Pacific Signal, LLC. as a Sole Source Vendor; and Adopt the Resolution Approving Contract Services Agreement with Jam Services Inc. as a Sole Source Vendor. FINANCIAL IMPACT: There are sufficient funds available in Signal and Streetlighting Operating Budget using Traffic Safety and Gas Tax funds to fund the services and purchase the equi pment. Each contract is termed for a total of three years. The total not to exceed amount for both contracts is $195,000. DESCRIPTION: The City’s current traffic communication and signal infrastructure equipment is proprietary in nature. Furthermore, integration of the central Traffic Operation Center (TOC) with multiple Intelligent Transportation Systems (ITS) such as video -based detection technologies and adaptive signal systems require maintenance of communication hardware and support from higher level technical experts. On May 21, 2013, the City Council approved Western Pacific Signal LLC. (WPS) as a sole source vendor as part of the approval of the Citywide Signal Communication Upgrade (CIP - 960020) project. Since then, Staff has successfully worked with WPS to integrate various ITS elements, interconnect signals along major corridors and establish communications with the TOC located at the Civic Center. WPS has also delivered and provided technical installation support and onsite technical training on numerous ITS Page 2 of 3 devices and related software; including local signal controller, traffic central management software, and vehicle detection equipment. More recently, Staff worked in coordination with various CIP project managers to connect the signals along the corridors of San Ramon Road, Amador Valley Boulevard, Village Parkway and Dougherty Road to the TOC. Communication between the TOC equipment and the traffic signals is accomplished through network communication devices or wireless systems. Currently, there is a need for these devices and specialized traffic signal systems and communications expertise. Additionally, City’s aging signal and streetlight equipment need replacement. The City Municipal Code establishes the procedures for making purcha ses and requires that major purchases for items in excess of $45,000 be awarded by the City Council. The Municipal Code contains specific exception to the formal bid process when the City’s requirements can be met solely by a single patented article or pro cess (Section 2.36.100(B)(1)). Staff has identified WPS as the sole source vendor of these communication devices. Additionally, Staff recommends WPS for technical support related to traffic signal communication as they are aware of the City’s systems and have always exceeded performance and customer service expectations. The signal and street light infrastructure such as Illuminated street name signs, pedestrian push buttons, LED vehicle indications, traffic signal battery backup systems, lighted crosswalks and luminaires need replacement after their usable life. JAM Services is a leading and trusted supplier providing a diverse variety of high quality products, including those that are proprietary in nature. Following are the products currently installed in the City and sold solely by JAM Services: illuminated street name signs manufactured by Temple Edge-Lit, audible pedestrian push buttons manufactured by Polara, solar and AC lighted crosswalks manufactured by Carmanah and the traffic signal battery backup systems manufactured by ZincFive. (Letter of Exclusivity, attachment 5). Jam Services has consistently provided the expertise and resources to meet the industry and City standards. AS A SOLE SOURCE VENDOR WHEREAS, in 2002, a Traffic Operations Center (TOC) was deployed at the City of Dublin, which was funded through a federal grant in cooperation with Cities of Pleasanton and Livermore; and WHEREAS, the TOC contains state-of-the-art networking equipment that communicates with field devices, including video monitoring cameras and traffic signal controllers, as well as the TOC’s in the Cities of Pleasanton and Livermore and other regions within the Bay Area; and WHEREAS, the recent CIP projects have expanded the scope of communication capabilities to signals along major corridors on San Ramon Road, Amador Valley Boulevard and Village Parkway; and WHEREAS, there is a need to buy specialized traffic signal communication equipment to maintain the complex communication devices required for TOC operation; and WHEREAS, the firm of Western Pacific Signal, LLC. has demonstrated professional qualifications and the ability to perform the technical work required; and WHEREAS, Staff has determined that the firm of Western Pacific Signal, LLC. is qualified to be a Sole Source Vendor as per the City of Dublin’s Municipal Code Section 2.36.100; and WHEREAS, the City and Western Pacific Signal LLC. would like to enter into a Contract Services Agreement for the required traffic signal communication equipment; and WHEREAS, under said agreement the vendor will be compensated for equipment supplied as specified in the agreement through June 30, 2021, and for a not to exceed amount of $105,000 authorized on a task-by-task basis prior to the commencement of work; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the Contract Services Agreement with Western Pacific Signal, LLC. as a sole source vendor as per the City of Dublin’s Municipal Code Section 2.36.100. BE IT FURTHER RESOLVED that the City Manager is authorized to execute the Agreement, attached hereto as Exhibit A and make any other minor amendments as necessary to carry out the intent of this Resolution.
