FINANCIAL STATEMENT' No cost associated with adoption of ordinance. DESCRIPTION: The first reading of this proposed ordinance was held at the October 9, 1989, City Council meeting. No public comment was received at that time. Staff received a request from Mrs. Kate Hodgdon of 7750 Creekside Drive that consideration be given to installing "Curb Your Wheels" signs on the steeper streets. The request was made following a "runaway vehicle" accident which damaged Mrs. Hodgdon's fence. In researching the regulations pertaining to parking on hills, the Traffic Safety Committee discovered that the California Vehicle Code delegates the authority for such regulations to the local jurisdiction. Alameda County has such an ordinance, and since development has occurred and will continue to occur in Dublin's hills, Staff feels that it is prudent for the City to adopt an ordinance requiring a driver to curb or otherwise block the wheels of a vehicle that is parked on the street that is steeper than a 3% grade. Observation of vehicles on hill streets indicates that most drivers are aware of this safety practice and are already curbing their wheels. Staff feels that posting of signs is not necessary and that police enforcement of the ordinance, once adopted, would be a sufficient reminder to the others. Staff recommends that the City Council conduct a public hearing, waive the reading, and ADOPT the ordinance amending Ordinance 55-87 pertaining to parking on hills. ORDINANCE NO. -89 AN ORDINANCE OF THE CITY OF DUBLIN AMENDING ORDINANCE 55-87 (TRAFFIC ORDINANCE) HILL PARKING REGULATION The City Council of the City of Dublin does ordain as follows: Section 1. Article 7 "Miscellaneous" of Ordinance 55-87 (Traffic Ordinance) is hereby amended to add the following: Section 36.5 Hill Parking. It shall be unlawful for any person driving, or in control of, or in charge of a motor vehicle to permit it to stand unattended, within any business or residence district, on any portion of a public street in the City of Dublin having a grade exceeding three percent (3%), without effectively setting the brakes thereon and blocking a front wheel of said vehicle against the curb, by turning the front wheels in such a direction as to cause the forward portion of one of the front wheels to come in contact with the curb when the vehicle is facing downhill, or the rear portion of one of the front wheels to come in contact with the curb when the vehicle is facing uphill; if there is no curb, other suitable means shall be used to block the movement of the wheels of said vehicle. Section 2. This ordinance shall become effective thirty (30) days after its final passage and adoption by the City Council. Section 3. The City Clerk of the City of Dublin shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Seotion 36933 of the Government Code of the State of California.
