HomeMy WebLinkAbout05-22-2018 CD Director to File - Minor Amend to PDDATE: May 22, 2018 D UBL I N TO: File PLPA-2018-00014 CALIFORNIA THE NEW CC: File PA 03-058 AMERICAN File CC Ord.02-05 BACKYARD FROM: Luke Sims,AICP,Community Development Direct945-7 SUBJECT: Minor Amendment to Planned Development(PD)Zoning District PA 03-058(Ordinance 02-05)(Eclipse at Dublin Station) Background On December 3, 2002, the City Council adopted Ordinance No. 21-02 to rezone the approximately 91-acre area known as the Dublin Transit Center to a Planned Development (PD) Zoning District and adopted a Stage 1 Development Plan for the area. On January 18, 2005, the City Council adopted Ordinance No. 02-05 which approved a Stage 2 Development Plan for a portion of the Dublin Transit Center known as Site B-2 (PA 03-058). Site B-2, known as Eclipse at Dublin Station (formerly referred to as Avalon Bay) is a mixed-use development located at 5300 Iron Horse Pkwy.The site was designed as a 5-story 305 unit residential building wrapped around a 6-level parking structure with the potential for up to 15,389 square feet of ancillary, neighborhood-serving commercial uses at the ground level along Iron Horse Parkway and Village Green. Eclipse at Dublin Station finished construction in 2007. Ultimately, 13,340 square City Council feet of commercial space was built along Iron Horse Parkway and Campbell Green. 925,$33.6650 The commercial spaces were given a second address of 5286 Iron Horse Pkwy and City Manager 925.833.6650 divided into six individual suites lettered A-F.These six commercial suites struggled to Community Development attract businesses since completion of construction and sat mostly vacant up until 925.833.6610 2015 when three businesses took occupancy of three of the six vacant suites.Economic Development 925.833.6650 Finance/IT In December 2016, a Minor Amendment to PD Ordinance 02-05 was approved by the 925.833.6640 Community Development Director to allow approximately 3,556 square feet of the Fire Prevention ground level retail space along Iron Horse Pkwy to be converted to amenity space to 925.833.6606 Human Resources be used exclusively by residents of the apartment complex. 925.833.6605 Parks&Community Services Proposal 925.833.6645 Police On January 23, 2018, the applicant, Thirsty Bay, LLC. submitted an application to 925.833.6670 operate a restaurant that serves alcohol in Suite B. The PD Ordinance 02-05 Public Works establishes a range of development standards; however, it does not provide Hours of925.833.6630 Operation standards for the ground-floor commercial uses. The absence of these standards creates a potential conflict between the commercial uses and the 100 Civic Plaza Dublin,CA 94568 residential units located above. The restaurant will provide seating in an inside dining area as well as two outdoor seating areas located on Iron Horse Parkway and Campbell Green. The outdoor seating areas is required to be fenced in accordance with ABC licensing requirements, and a Site Development Review Waiver is required for the design of the fence and for the furnishings of the seating area. A restaurant with outdoor seating is a permitted use in PD Ordinance 02-05; however, the proposed restaurant is unique in that it will have outdoor seating and will predominantly operate during evening hours. In order to address the potential conflict between the outdoor seating operating within evening hours, and the residents of the community, the PD Zoning District is being amended to establish Hours of Operation for Outdoor Seating under Section 2. Permitted Uses. Minor Amendment to a Planned Development(PD)Zoning District A minor amendment to an adopted PD may be approved administratively by the Community Development Director upon a finding that the amendment substantially complies with and does not materially change the provisions or intent of the adopted PD Zoning District Ordinance for the site(DMC 8.32.080). Approval The Community Development Director finds that the proposed Minor Amendment to PD Zoning District Ordinance 02-05 is in substantial compliance with, and does not materially change the provisions or intent of PD Zoning District Ordinance 02-05. The Director hereby approves a Minor Amendment to PD Zoning District Ordinance 02-05 with the following footnote added to Section 2.
