A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

RESOLUTION OF INTENTION TO ESTABLISH ULTIMATE RIGHT OF WAY LINES
FOR TASSAJARA ROAD AND FALLON ROAD
WHEREAS, the City of Dublin has proposed the establishment of right-of-way lines for Tassajara
Road and Fallon Road in accordance with Municipal Code Chapter 7.68; and
WHEREAS, the effected segment of Tassajara Road extends trom the northern boundary of
Dublin Ranch Phase 1 (Tract 6925) near Shadow Hills Drive to the Alameda County/Contra Costa County
line, generally following the existing road; and
WHEREAS, the planned segment of Fallon Road extends trom a future intersection at Tassajara
Road to a point approximately 1,500 feet southeast of the intersection for connection with the portion of
Fallon Road to be constructed as part of Dublin Ranch Area A; and
WHEREAS, the proposed right-of-way lines conform to the lines previously established by
Ordinance No. 20-99 adopted on September 7, 1999, for the southern segment of Tassajara Road between
1-580 and the northern boundary of Dublin Ranch Phase I; and
WHEREAS, the project has been reviewed in accordance with the provisions of the California
Envirorunental Quality Act (CEQA) and implementing Guidelines, and a Mitigated Negative Declaration
has been recommended to the City Council for adoption, as it will have no significant effect on the
environment; and
WHEREAS, a report and recommendation were prepared on behalf of the Public Works Director
and submitted to the Planning Commission, as required by Municipal Code Chapter 7.68, recommending
that the Planning Commission recommend to the City Council adoption of a Resolution of Intention to
establish right-of-way lines; and
WHEREAS, the Planning Commission, after hearing and considering all said reports,
recommendations and testimony at a public hearing on May 11, 2004, adopted Resolution No. 04-39
recommending that the City Council adopt a Resolution of Intention; and
WHEREAS, the City Council intends to establish ultimate right-of-way lines for Tassajara Road
and Fallon Road.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts this Resolution
of Intention and calls for a public hearing pursuant to Sections 7.68.080 through 7.68.100 of the Dublin
Municipal Code, on July 20, 2004, at 7:00 p.m., in the City of Dublin City Council Chambers, 100 Civic
Plaza, Dublin, California, to hear protests and objections to the establishment of the proposed ultimate
right-of-way lines hereinafter set forth:

Ultimate Right-of-Way Lines on Tassajara Road and Fallon Road as described on the Legal
Description (Exhibit A) and illustrated on the Plat Maps (Exhibit B) attached hereto.
BE IT FURTHER RESOLVED that the City Clerk is directed to post this Resolution of
Intention in accordance with Section 7.68.Q70 of the Dublin Municipal Code at least 10 days before the
hearing.
PASSED, APPROVED AND ADOPTED this 6th day of July, 2004.
