OF THE CITY OF DUBLIN ESTABLISHING A PROCEDURE FOR REIMBURSEMENT OF THE COST OF PREPARATION OF THE EAST DUBLIN SPECIFIC PLAN WHEREAS, The City of Dublin is preparing a Specific Plan for the East Dublin Area, which is delineated on Attachment A hereto; and WHEREAS, the East Dublin Specific Plan ("Plan") is being prepared with the assistance of the consultant firm of Wallace Roberts & Todd and other associated consultants; and WHEREAS, the preparation of the plan will require some amount of time from City Staff; and WHEREAS, the cost of the Plan (which is estimated to be $500,240 plus City Staff costs) is a significant expenditure of public funds; and WHEREAS, the Specific Plan is being prepared to provide policies, standards, and procedures for development and management of the East Dublin Specific Plan Area, which policies, standards and procedures will help achieve orderly and well- planned development for The City of Dublin by providing measures necessary to protect valuable natural resources, to accommodate increased traffic, increased demand on public services, and increased population; and WHEREAS, it is expected that the Plan will promote the general good of The City of Dublin, will be of direct, immediate and long-term economic benefit to property owners, developers, and entrepreneurs in the East Dublin Area; and WHEREAS, Section 65456 of the Government Code of the State of California permits the recovery of the costs of the preparationof the Specific Plan, including costs incurred pursuant to Division 13 of the Public Resources Code (CEQA); and WHEREAS, it is the purpose and intent of this Resolution to establish a policy and procedure for the collection of fees to recover the cost of preparation of the East Dublin Specific Plan; NOW, THEREFORE, BE IT RESOLVED THAT The City Council of The City of Dublin does hereby find that: a) Fees shall be imposed on any and all Property Owners' lands within the boundaries of the East Dublin Specific Plan Area if and when an application is submitted to The City of Dublin for a permit, governmental approval or annexation which is consistent with the East Dublin Specific Plan. b) Said fees shall be based on a cost-per-acreage rate and calculated by the following formula: (i) Rate = Total cost of preparation of The Specific Plan divided by total acreage within the Specific Plan Study Area; and (ii) Fee = Rate x Property Owner's acreage as set forth in the East Dublin Specific Plan. (iii) To compensate for the fluctuating change in the value of the U.S. Dollar, the fee shall be adjusted annually by multiplying it by the U.S. Department of Labor Bureau of Labor Statistics Consumer Price Index for the San Francisco Bay Area (all urban consumers) for the preceding year. c) Any Property Owner who has entered into an agreement for payment of a portionof the costs of the East Dublin Specific Plan Study and who has paid an amount equal to, or greater than the fees which would be imposed pursuant to this Resolution shall be exempt from payment of such fees or shall receive a refund, as the case may be.
