HomeMy WebLinkAboutReso 161-04 DubRchTraficDevice RESOLUTION NO. 161 w 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCEOFll"PROVEMENTSFOR TRACT 7141 (DUBLIN RANCH AREA A, NEIGHBORHOOD Aw6) AND APPROVING REGULA TORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 7141, filed on August 21,2001, in Book 261 of Maps at Pages 1 - 4, previously entered into two Tract Developer Agreements with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: Toll CA II, LP, A California Limited Partnership North of Fallon Road, West of Bent Tree Drive, and Southeast of Dublin Ranch Golf Course 97 Single-Family Lots No. 130-01, City of Dublin City Council Grayhawk Court, Grayhawk Lane, Poppy Hills Court, Poppy Hills Lane, Royal Pines Court, Royal Pines Way, Twin Eagles Lane, and Southwind Lane a) Subdivider: b) Tract Location: WHEREAS, the Landscape Improvements along the west side of Bent Tree Drive and the north side of Fallon Road along the tTontage of Tract 7141, as governed by one of the Tract Developer Agreements, were completed and accepted by the City Council via Resolution No. 97-04 on June 15, 2004; and WHEREAS, the street improvements associated with Tract 7141, as governed by the remaining Tract Developer Agreement, are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the developer has installed certain regulatory traffic control devices as a part of the Tract improvements; and WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that guaranteed the Street Improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: 1 a) Stop control device installed on the southerly approach of Royal Pines Way at Twin Eagles Lane. b) Stop control device installed on the northerly approach of Royal Pines Court at Twin Eagles Lane. c) Stop control device installed on the easterly approach of Twin Eagles Lane at Bent Tree Drive. d) Stop control device installed on the westerly approach of Twin Eagles Lane at Grayhawk Lane. e) Stop control device installed on the westerly approach of Poppy Hills Lane at Grayhawk Lane. f) Stop control device installed on the northerly approach of Royal Pines Way at Poppy Hills Lane. g) Stop control device installed on the easterly approach of Southwind Lane at Bent Tree Drive. 3. The original Performance Bond issued by The Continental Insurance Company (Bond No. 929200647) in the amount of $780,384.00 be released; and 4. The original Labor and Materials Bond issued by The Continental Insurance Company (Bond No. 929200647) in the amount of $390, 192.00 be released; and 5. The submitted Maintenance Bond issued by The Continental Insurance Company in the amount of $292,644.00 (Bond No. 929328710) for street improvements be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 17th day of August, 2005. PASSED, APPROVED AND ADOPTED this 17th day of August, 2004.
