HomeMy WebLinkAboutReso 205-04 DubRchTr7252 RESOLUTION NO. 205 - 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF STREET IMPROVEMENTS FOR FALLON ROAD AND SIGNAL HILL DRIVE ASSOCIATED WITH TRACT 7252 (DUBLIN RANCH AREA A) AND APPROVING REGULA TORY TRAFFIC CONTROL DEVICES WHEREAS, the developer of Tract 7252, filed on March 22, 2002, in Book 263 of Maps at Pages 63 - 68, previously entered into three (3) Tract Developer Agreements with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: d) Resolution Approving Agreement: Toll CA II, L.P. Fallon Road north of Antone Way IO bulk parcels for subsequent subdivision as Dublin Ranch, Neighborhoods A-I through A-5, plus vario,us golf course parcels No. 206-01, as amended by No. 225-02, Dublin City Council Fallon Road and Signal Hill Drive a) Developer: b) Tract Location: c) Tract Size: e) City Streets Affected: WHEREAS, the three agreements govern the following improvements: 1. Traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and on Fallon Road at Turnberry Drive; 2. Fallon Road and Signal Hill Landscaping; 3. Street improvements for the extension of Fallon Road north of Antone Way and Signal Hill Drive along the frontage of the Dublin Ranch Golf Course Clubhouse and Recreation Facility; and WHEREAS, traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and on Fallon Road at Turnberry Drive, as governed by the first of the three Tract Developer Agreements for Tract 7252, were completed and accepted on January 20,2004, via City Council Resolution No. 10-04; and WHEREAS, the Fallon Road and Signal Hill landscaping, as governed by the second of three Tract Developer Agreements for Tract 7252, is nearing completion and will be recommended for acceptance in the near future; and WHEREAS, the street improvements for Fallon Road and Signal Hill Drive, as governed by the third of three Tract Developer Agreements for Tract 7252, are now complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and ~ 1 ~ WHEREAS, the original Performance Bonds and Labor and Materials Bonds associated with the street improvements for Fallon Road and Signal Hill Drive can be released in accordance with the authority contained in §66499. 7 of the Government Code of the State of California, and replaced with Maintenance Bonds in amounts necessary to guarantee the completed work for a one~year period following acceptance. NOW, THEREFORE, BE IT RESOLVED that: 1. The street improvements for Fallon Road and Signal Hill Drive completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) Fallon Road and Signal Hill Drive are each designated as a "Through Street". b) "No Parking Anytime" restriction on both sides of Fallon Road north of Antone Way. c) "No Parking Anytime" restriction on both sides of Signal Hill Drive along the frontage of the Golf Course Clubhouse and Recreation Facility. 3. The original Performance Bond issued by The Continental Insurance Company (Bond No. 929213840) in the amount ofSl,302,000.00 be released; and 4. The original Performance Bond issued by The Continental Insurance Company (Bond No. 929218643) in the amount ofS246,435.00 be released; and 5. The original Labor and Materials Bond issued by The Continental Insurance Company (Bond No. 929213840) in the amount ofSI,302,000.00 be released; and 6. The original Labor and Materials Bond issued by The Continental Insurance Company 9292 I 8643) in the amount ofS246,435.00 be released; and 7. The submitted Maintenance Bond issued by The Continental Insurance Company (Bond No. 929328712) in the amount ofS325,500.00 for Fallon Road be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the I9th day of October, 2005. 8. The submitted Maintenance Bond issued by The Continental Insurance Company (Bond No. 929328711) in the amount ofS6I,609.00 for Signal Hill Drive be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 19th day of October, 2005. PASSED, APPROVED AND ADOPTED this I9th day of October, 2004.
