HomeMy WebLinkAboutReso 066-87 AlaCoNonpointWater RESOLUTION NO. 66 -87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AGREEMENT REGARDING EVALUATION OF NONPOINT SOURCE OF WATER POLLUTION WHEREAS, the San Francisco Bay Water Control Board, in carrying out the Federal Clean Water Act, has established certain requirements for local agencies within Alameda County for the preparation of a detailed proposal for evaluation of non-point source pollution by June 1, 1988; and WHEREAS, the various local agencies propose to prepare a combined study with Alameda County as a lead agency; and WHEREAS, this initial study is not to exceed $150,000; and WHEREAS, the City of Dublin's pro-rata share is 1.17% based on area and population; NOW, THEREFORE, BE IT RESOLVED that the City of Dublin approves this Joint Agreement Regarding Evaluation of Non-Point Source of Water Pollution and authorizes Mayor to execute same. AYES: Councilmembers Hegarty, Moffatt, Snyder, Vonheeder and Mayor Jeffery NOES: None ABSENT: None ATTEST: City Clerk AGREEMENT REGARDING EVALUATION OF NON-POINT SOURCE OF WATER POLLUTION Alameda County Flood Control and Water Conservation District, a local public agency of the State of California: Zone 7 of Alameda County Flood Control and Water Conservation District, a local public agency of the State of California: County of Alameda, a subdivision of the State of California; City of Alameda, a municipality of the State of California; City of Albany, a municipality of the State of California; City of Berkeley, a municipality of the State of California; City of Dublin, a municipality of the State of California; City of Emeryville, a municipality of the State of California; City of Fremont, a municipality of the State of California; City of Hayward, a municipality of the State of California; City of Livermore, a municipality of the State of California; City of Newark, a municipality of the State of California; City of Oakland, a municipality of the State of California; City of Piedmont, a municipality of the State of California; City of Pleasanton, a municipality of the State of California; City of San Leandro, a municipality of the State of California; City of Union City, a municipality of the State of California; AGREE this day of , 1987, as follows: RECITALS: A. The San Francisco Bay Basin Water Quality Control Plan of the San Francisco Bay Regional Water Quality Control Board requires that local agencies in the County of Alameda (viz, the parties to this agreement) shall prepare for review by said Regional Board a detailed proposal for evaluation of non-point source pollution by June 1, 1988. B. This agreement will provide for the allocation of responsibility for the work and for distribution of the cost thereof. -1- AGREEMENT: /~c> ~ ~ ~ 1. In accordance with the Water Quality Control Plan for the San Francisco Bay Basin (Basin Plan), the Alameda County Flood Control and Water Conservation District (hereinafter District) is assuming a significant coordination role in development of this program and shall undertake to secure the services of a consultant in accordance with District procedures on selection of professional consultants. The District's contract with the consultant will contain a hold harmless and indemnity provision for the benefit of all parties to this agreement. 2. A Task Force consisting of representatives of agencies specified on "Exhibit A" hereto, so marked and made a part hereof, shall oversee and direct the preparation by the consultant so engaged of the proposal men- tioned in Recital A above. 3. The parties shall share in meeting the cost of the proposal, including the consul tant's fee and the necessary and reasonable cost incurred by the District therein, in the proportions stated in the schedule thereof marked "Exhibit B" attached hereto and made a part hereof. The indicated shares are based on population and area of the respective jurisdictions as computed for purposes of this agreement. 4. The total cost to be so apportioned shall not exceed $150,000. 5. This agreement will be effective as to signing parties upon the execution of parties sharing 87 per cent or more of the apportioned cost. District will thereupon proceed to secure the services of a consultant as stated in paragraph I above. If execution is refused by one or more of the balance of the named proposed parties hereto the share of such party or parties will be met by the executing parties other than District or Zone 7 of Alameda County Flood Control and Water Conservation District (hereinafter Zone 7) in the general proportion shown on Exhibit B or by such division as the executing parties other than District and Zone 7 may determine and agree upon.
