HomeMy WebLinkAboutReso 098-87 AlaCoWasteMngmt RESOLUTION NO. 98- 87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AN AMENDMENT TO THE ALAMEDA COUNTY WASTE MANAGEMENT PLAN WHEREAS, the City Council of the City of Dublin approved the Solid Waste Management Plan for Alameda County on September 28, 1987; and WHEREAS, the Plan must be approved by a majority of cities representing a majority of the population; and WHEREAS, nine cities have adopted the Plan with amended language; and WHEREAS, the Solid Waste Management Authority has reviewed and approved the amendment; and WHEREAS, the Authority has requested that each City which adopted the Plan without the amendment consider the proposed language contained in Exhibit A. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby amend its action taken September 28, 1987, to approve the Solid Waste Management Plan. The approval shall be amended to include the replacement language contained in Exhibit A attached hereto and made a part hereof. PASSED, APPROVED AND ADOPTED this 23rd day of November, 1987. AYES: Councilmembers Hegarty, Moffatt, Snyder Vonheeder and Mayor Jeffery NOES: None ABSENT: None C 1 EXHIBIT A PROPOSED REPLACEMENT LANGUAGE FOR SPECIFIC SECTIONS OF THE ADOPTED SOLID WASTE MANAGEMENT PLAN FOR ALAMEDA COUNTY Language included in Final Draft Plan Page II-3, Item 11, as adopted September 28, 1987. 11. Prior to November 1, 1988, and at each five-year interval after the start of importation, guarantee that there is significant permitted landfill capacity in Alameda County to meet the disposal needs of all Alameda County jurisdictions for a 50-year continuous period. Proposed replacement language for Page II-3, Item 11. 11. Prior to November 1, 1988, a base line permitted landfill capacity in the Alameda County shall be established using the engineering technology currently available. No new application for the import of waste for an agency outside Alameda County shall be approved unless an engineering study certifies that at least 50 years of permitted landfill capacity is available in Alameda County for all the jurisdictions in Alameda County. The engineering study shall be based upon the regulations and technology prevailing at the time of application. In no event shall any application from an agency outside of Alameda County be approved with mitigation which would on the date of approval reduce the permitted landfill capacity available to Alameda County jurisdictions to less than 50 years. (c) Any proposed plan amendment to import waste for disposal in Alameda County will be considered only after clear independent evidence is presented demonstrating that either sufficient fully permitted landfill capacity exists within Alameda County to serve the needs of all County jurisdictions for a minimum 50-year continuous period, or that mitigation fees are provided by the project proponents to acquire such additional capacity. Mitigation fees shall be provided to acquire replacement capacity or to achieve source reduction. Proposed replacement language for Page II-8, Item 3(c). (c) Any proposed plan amendment to import waste for disposal in Alameda County will be considered for approval only after clear independent evidence is presented demonstrating that sufficient fully permitted landfill capacity exists within Alameda County to serve the needs of all County jurisdictions for a minimum 50-year continuous period.
