' . Authorize Staff to accept maintenance bond FINANCIAL STATEMENT: A Maintenance Bond in the amount of $50,000 to guarantee against defects has been provided to the City. Sweeping and other street maintenance costs will be incurred by the City. The street lighting maintenance costs shall be paid by the Street Light Maintenance Assessment District 99-1 (Dublin Ranch Area and Tract 7067) as the developer elected to install decorative lights and annex to this Lighting District. DESCRIPTION: The DeSilva Group, Inc., originally subdivided, graded and installed public improvements for the Clifden Parc development, Tract 7067, located just west of the Hansen Hill development in western Dublin. The Clifden Parc development consists of 16 single-family lots plus one custom-home lot, for a total of 17 lots. Taylor Woodrow Homes purchased the finished lots from The DeSilva Group and constructed 16 single-family homes. The custom-home lot remains undeveloped, although Taylor Woodrow Homes obtained approval from the Planning Commission for a custom-home design last year. The improvements within the Clifden Parc development have been inspected by the City Engineer and found to be substantially complete. At the time the City and the subdivider executed the contract for the tract improvements, the subdivider was required to provide a Grading Permit Bond in the amount of $491,110, a Performance Bond in the amount of $200,000, and a Labor and Materials Bond in the amount of $100,000 in order to guarantee performance of the work involved. Now that the work is substantially complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced COPIES TO: Jay Egy, The DeSilva Group Tony Craig, Taylor Woodrow ITEM NO. g:\develop\aura taylor woodrow\agstacpt7067 with a Maintenance Bond in an amount necessary to assure maintenance of the improvements for a one- year period following acceptance of the work. The subdivider has provided a Maintenance Bond in the amount of $50,000, which is 25% of the original Performance Bond amount, and which is sufficient to guarantee the one-year maintenance period upon acceptance. The following regulatory traffic improvement will be accepted and approved as a part of this development and added to the City of Dublin Traffic Code: Stop control device installed at the westbound approach of Mountainrise Place at Galway Court/Clifden Court. Staff recommends adopting the Resolution to accept the improvements associated with Tract 7067, Clifden Parc, and authorize Staff to accept a Maintenance Bond in the amount of $50,000. Page 2 RESOLUTION NO. - O1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS FOR TRACT 7067 (CLIFDEN PARC) AND APPROVING REGULATORY TRAFFIC DEVICES INSTALLED AS TRACT IMPROVEMENTS WHEREAS, the subdivider of Tract 7067, filed June 20, 1999, in Book 245 of Maps Pages 46-51, previously entered into a contract with the City of Dublin to improve said tract in accordance with plans and Specifications on file with the City Engineer, said tract identified as follows: a) Subdivider: b) Tract Location: c) Tract Size: d) Resolution Approving Final Map: e) City Streets Affected: The DeSilva Group, Inc. Mountain Rise Place, west of Hansen Hill 17 Single-Family Lots No. 45-99, City Council of Dublin Mountainrise Place, Clifden Court, and Galway Court WHEREAS, the improvements associated with Tract 7067 are substantially complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the developer has installed certain traffic regulatory devices as a part of the tract improvements; and WHEREAS, the improvements are now substantially complete, the original Grading Permit Bond, Performance Bond, and Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee maintenance of the completed work for a one-year period. NOW, THEREFORE, BE IT RESOLVED that: The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: Stop control device installed at the westbound approach of Mountainrise Place at Galway Court/Clifden Court. o The original Grading Permit Bond issued by Reliance Insurance Company (Bond No. B2703659) in the amount of $491,110.00 be released; and o The original Performance Bond issued by United Pacific Insurance Company (Bond No. U2692879) in the mount of $200.000.00 be released; and The original Labor and Materials Bond issued by United Pacific Insurance Company (Bond No. U2692789) in the mount of $100,000.00 be released; and o The submitted Maintenance Bond issued by United Pacific Insurance Company (Bond No. U2692879M) in the amount of $50,000.00 be accepted as security for the aforesaid one- year maintenance period, said period to commence on this date and terminate on the 7th day of August, 2002. PASSED, APPROVED AND ADOPTED this 7th day of August, 2001.
