An additional appropriation of $3,000 is required to continue the legal work. DESCRIPTION: At its meeting of April 3, 2001, the City Council approved a budget change in the amount of $2,000 to assist with the legal fees associated with the National Fire Protection Association (NFPA) 1710 appeal. An additional appropriation in the amount of $3,000 is now required to continue the legal effort. Attached is a letter from Chief McCammon providing an update on NFPA 1710 and the next steps in the appeal process. RECOMMENDATION: Staff recommends that the Council approve the budget change in the amount of $3,000 for contract legal services associated with opposition to NFPA 1710. The Council issued thc standard on July 17. in issu!ng the standard the Council added an important atnendment designed to allow local governments real and-substantial flexibility in the way they provide fire and emergency medical services. The provision reads: "1.3 EquiValency. Nothing in this standard is intended to proliibit the use of' systems, methods, or approaches of' eqdivalent or superior performance to those prescribed in this standard. T~chnical documentation shall be submitted m tho Autliority having jurisdiction to demonstrate equivalencyY The Standards Council directed thc Technical committee responsible for 1710 to begin tlm review mid revisio3 o[' thc standard on a throe-year cycle, and report back at Uae NFPA 2004 Annual Meeting. There is still one more level of apl)cai, wlfich tim coalition is pursuing. Legal counsel prepared an appeal to the NFPA Board of Directors, which was submltted to them for consideration. At this point no further action will be taken towards isstling the standard until fl~e NFPA Board of Directors meets to consider the appeal.
