Foss, City Manager SUBJECT: Ordinance Amending the Dublin Traffic Code Establishing 15 New Bus Stops Prepared by: Obaid Khan, Transportation and Operations Manager EXECUTIVE SUMMARY: The City Council will consider adopting an ordinance to amend the Dublin Traffic Code establishing 15 new bus stops in the City as requested by the Livermore Amador Valley Transit Authority. STAFF RECOMMENDATION: Waive the second reading and adopt an Ordinance Amending the Dublin Traffic Code Establishing 15 New Bus Stops. FINANCIAL IMPACT: There is no financial impact to the City of Dublin associated with this item. DESCRIPTION: On October 15, 2019, the City Council waived the reading and introduced an Ordinance to amend the Dublin Traffic Code establishing 15 new bust stops in the City as requested by the Livermore Amador Valley Transit Authority (LAVTA). The Ordinance is now ready for adoption. LAVTA was created in 1985 under a Joint Exercise of Powers Agreement between the Cities of Dublin, Livermore, and Pleasanton to provide transit service across the Tri- Valley. LAVTA and City staff routinely work cooperatively on upcoming project s, on day- to-day operations, and on proposed new bus stops. LAVTA recently requested that 15 new bus stop locations be designated so that extended service may commence in the immediate future, as LAVTA staff has received several requests for bus service fr om City of Dublin residents. The City Council introduced an ordinance at the October 15, 2019 meeting amending the Dublin Traffic Code establishing 15 new bus stops in the City as requested by LAVTA. Requested bus stop locations are shown in Attachment 1. Page 2 of 3 There are currently 170 bus stops throughout the City, which are indicated by either signs or curb markings and may include a bus pullout and amenities such as benches and shelters. According to Dublin Municipal Code Section 6.04.360, the City Council may establish bus stops by ordinance. Once established and marked accordingly, only buses may stop, stand or park within the designated area. LAVTA has developed bus route extensions to better serve residents, including 15 proposed new bus stops. Details regarding the proposed new bus stops are provided in Table 1. Although the City has jurisdiction over the amenities in the road rights of way, the LAVTA board has approved the proposed bus stops in order to provide better bus service coverage for the neighborhoods. Bus stops have been proposed in some locations partly out of the specific request of citizens or have been required as part of new development improvements like the Boulevard Project. The Agreement contains an Exhibit that lists all City bus stop locations and associated amenities to be maintained by LAVTA. An amendment ("First Amendment") was approved by City Council in 2010 to further clarify maintenance responsibilities. In 2011, another amendment to the agreement was approved ("Second Amendment"), which added additional bus stops to the Exhibit and revised the agreement language to authorize the City Manager of Dublin and the Executive Director of LAVTA to execute future amendments to the Exhibit ( i.e., add additional locations in the field and/ or associated amenities) after the City Council, by ordinance, has established said bus stops. Subsequent amendments ("Third Amendment", "Fourth Amendment", “Fifth Amendment”) further added or modified bus stop locations. Should this ordinance be adopted, the City Manager and Executive Director of LAVTA will execute a Sixth Amendment to the Agreement adding the above referenced 15 bus stops to the agreement. STRATEGIC PLAN INITIATIVE: None. NOTICING REQUIREMENTS/PUBLIC OUTREACH: Livermore Amador Valley Transit Authority (LAVTA) has conducted community outreach during the month of August and September for all proposed stops west of San Ramon Road. Bus stops associated with Boulevard Project (east of Dougherty Road) have been reviewed by the City of Dublin as part of the Boulevard Project plans. LAVTA will also post barricades at the proposed bus stop locations prior to initiating new bus service. A copy of this staff report was provided to Michael Tree, Executive Director of LAVTA. The provisions of this Ordinance are severable and if any provision, clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstances, such illegality, invalidity, unconstitutionality, or inapplicability s hall not affect or impair any of the remaining provisions, clauses, sentences, sections, words or parts thereof of the ordinance or their applicability to other persons or circumstances. Section 3: Effective Date. This Ordinance shall take effect and be e nforced thirty (30) days following its adoption and following placement of speed limit signs providing notice thereof. Section 4: Posting. The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California.
