1. Call to Order and Pledge of Allegiance
A regular meeting of the Dublin City Council was held on Tuesday, November 5, 2019,
in the City Council Chambers of the Dublin Civic Center. The meeting was called to
order at 7:00 p.m. by Mayor Haubert.

3. Oral Communications
3.1. Presentation from the League of California Cities to the City of Dublin for
the Helen Putnam Award for Excellence for the Valor Crossing Affordable
Housing Development
Sam Caygill, East Bay Division Regional Public Affairs Manager for the League
of California Cities, presented the City Council with the League’s Helen Putnam
Award for Excellence for the Valor Crossing Affordable Housing Development.
3.2. Employee Introduction: John Stefanski
The City Council welcomed John Stefanski to the City of Dublin Staff.

3.3. Proclamation in Recognition of United Against Hate Week
(November 17-23, 2019)
The City proclaimed November 17-23, 2019 in Recognition of United Against
Hate Week.

4. Consent Calendar
Item 4.5, Updates to the City’s Construction and Fire Codes in Accordance with
Requirements of State Law, and Item 4.8, Clover Park Art Selection and Agreement,
were pulled for further discussion.
City Attorney Baker stated in regard to Item 4.9, Agreement to Employ Linda Smith as
City Manager, the Brown Act requires the City to provide a verbal summary of a
recommendation to approve a local agency executive contract or amendment. Item 4.9
is the Negotiation Committee’s recommendation to approve an agreement with Linda
Smith to serve as the City Manager beginning December 31, 2019. The basic terms of
the agreement are as follows: Term through December 30, 2024; initial base salary of
$24,238 per month; standard benefits that accrue to other employees, plus, automobile
allowance, technology allowance, City deferred compensation contribution, 35 days of
general leave and 12 days of management leave annually; and an initial 12 month
severance.
City Manager Foss stated, in regard to Item 4.5, the City Council had received an errata
sheet. It was a list of non-substantive changes to the update to the City’s Construction
and Fire Codes that would be incorporated into Item 4.5.

Code), 7.32 (Building Code), 7.34 (Residential Code), 7.36 (Electrical Code), 7.40
(Plumbing Code), 7.44 (Mechanical Code), and 7.94 (Green Building Code), of the
Dublin Municipal Code, in Order To Adopt By Reference and Amend Provisions of
the 2019 Edition of the California Building Standards Code, Title 24, Cal ifornia
Code of Regulations and Repealing Chapter 7.48 (Housing Code) and Adopting
Chapter 7.48 (Building Maintenance Code), of the Dublin Municipal Code, in Order
to Adopt by Reference and Amend Provisions of the 2018 International Property
Maintenance Code; and, 2) Set the Public Hearing of November 19, 2019 to: a)
Adopt the Resolution approving the Finding of Necessity for Amend ments to the
2019 California Building Standards Code, as recommended by Staff, b) Waive the
second reading and adopt an Ordinance Repealing and Replacing Chapters 5.08
(Fire Code), 7.28 (Building Regulation Ad ministration Code), 7.32 (Building Code),

On motion of Cm. Kumagai, seconded by Vm. Hernandez and by majority vote (Cm.
Josey and Cm. Goel voting no), the City Council adopted
RESOLUTION NO. 113-19
APPROVING AN AGREEMENT WITH COLIN SELIG FOR A PUBLIC ART PROJECT
AT CLOVER PARK;
and asked that the artist make the art project more “seatable”.

Mayor Haubert opened the public hearing.

(Density Bonus Regulations) of the Dublin Zoning Ordinance.

Brief information only reports from City Council and/or Staff, including committee
reports and reports by City Council related to meetings attended at City expense
(AB1234).
Vice Mayor Hernandez left the dais and meeting at 8:12 p.m.
Assistant City Manager Linda Smith stated Staff would return with a future agenda
item requesting additional funding for equipment that will assist in the event of
another large-scale outage in terms of a Public Safety Power Shutoff. By
consensus, the City Council agreed to invite the East Bay Housing Organizations to
a future City Council meeting; have Staff return with a feasibility report on staff time
and cost for public fitness challenge; have Staff return with an item in regard to City
Council voting at League of California Cities conference, to register the Mayor, and
Vice Mayor, then City Councilmembers in order of seniority; and return with what
other communities are using for regulations on short term re ntals.
The City Council held a moment of silence for Alameda County Sheriff’s Technician
Nancy Melanson.

The meeting was adjourned at 8:30 p.m. in honor or Staff Sgt. Sean Diamond and
Alameda County Sheriff’s Technician Nancy Melanson.
