HomeMy WebLinkAbout5.1 Happy Little Munchkins Large Family Day Care Home Conditional Use Permit (PLPA-2018-00024)Page 1 of 4 STAFF REPORT PLANNING COMMISSION DATE: November 13, 2018 TO: Planning Commission SUBJECT: Happy Little Munchkins Large Family Day Care Home Conditional Use Permit (PLPA-2018-00024) Prepared by:Martha Battaglia, Associate Planner EXECUTIVE SUMMARY: The Applicant Prachi Nadkarni, is requesting approval of a Conditional Use Permit to operate a Large Family Day Care Home at 4451 Sunset View Drive. The Applicant proposes to provide day care for up to 14 children within her home. The use, as proposed, requires approval of a Conditional Use Permit by the Planning Commission. RECOMMENDATION: Conduct the public hearing, deliberate and adopt a Resolution approving a Conditional Use Permit for the operation of a Large Family Day Care Home at 4451 Sunset View Drive. DESCRIPTION: The project site is located at 4451 Sunset View Drive and is located within the Jordan Ranch neighborhood, as shown in the vicinity map below. The property has a General Plan land use designation of Medium -Density Residential and is located within a Planned Development (PD) Zoning District. The project site is an existing single family residence and access to the project site is provided by an existing driveway and an improved sidewalk from Sunset View Drive. The Applicant is proposing to operate a Large Family Day Care Home with the purpose of providing child care to a maximum of 14 children. The Applicant has operated a Small Family Day Care Home from this location since 2016. A Large Family Day Care Home is permitted in all residential 5.1 Packet Pg. 10 Page 2 of 4 districts subject to the Development Standards and Regulations contained in Chapter 8.66 (Large Family Day Care Homes) of the Dublin Zoning Ordinance. A Large Family Day Care that conforms to the Development Standards and Regulation s contained in Section 8.66.030 of the Dublin Zoning Ordinance is subject to approval of a Zoning Clearance by the Community Development Director. Any proposed Large Family Day Care Home that does not meet all of these Development Standards and Regulations is subject to approval of a Conditional Use Permit by the Planning Commission. The proposed Large Family Day Care Home does not meet the Development Standards related to parking and separation between day care homes to qualify for a Zoning Clearance. Therefore, the Applicant is requesting approval of a Conditional Use Permit to operate a Large Family Day Care Home at the project site. ANALYSIS: A Conditional Use Permit enables the City to place Conditions of Approval on a project to ensure that the operating characteristics are compatible with surrounding uses. The proposed project has been reviewed for issues related to operating characteristics and parking. Conditions of Approval have been placed on the project, where appropriate, to ensure compatibility with the surrounding residential uses (Attachment 1). The proposed Large Family Day Care Home will provide care for up to 14 children and employ one person who does not reside in the home. The proposed day care will operate Monday through Friday from 8am to 6pm. The day care will have staggered drop off and pick-up times in the mornings from 8:30 am to 9:30 am and in the early evenings from 5:00 pm to 6:00 pm which reduces the concentration of vehicles to and from the house at any particular time. A Condition of Approval has been placed on the project that requires the drop-off and pick-up of children be staggered over a minimum one hour time period (Condition 15 of Attachment 1). Parking The City of Dublin Zoning Ordinance contains parking requirements by use type (Section 8.76.080.B). A Large Family Day Care Home is required to provide 2 parking spaces in an enclosed garage, plus 1 off-street space for each employee not residing in the home, plus one space for every 6 children receiving care a t the facility. The code allows for a loading space to occur on the street if within 150 feet of the dwelling. Happy Little Munchkins Day Care is required to provide a total of five parking spaces (2 parking spaces for the dwelling, 1 for the non-resident employee, and 2 loading spaces). The project site has two off -street parking spaces, which includes the two spaces in the garage. The project site does not have a driveway; therefore, there is a shortage of three off-street parking spaces. The Applicant’s husband works outside of the home and uses his car to get to work. He leaves for work before 8am and returns home after 6pm, leaving one of the garage 5.1 Packet Pg. 11 Page 3 of 4 parking spaces available. Thus the Applicant proposes to utilize one of the garage parking spaces for the employee who does not reside in the home (Condition 18 of Attachment 1). The Applicant proposes to use two parking spaces on the street in front of their home to satisfy the requirement for loading spaces (Attachment 3). Staff visited the site on Tuesday, October 23, 2018 from 7:30 am to 9:30 am in order to ensure that adequate on-street parking exists for loading purposes. Staff observed that many of the residents parked on the street in the vicinity of the proposed project site left for work between the hours of 8:00 am and 8:30 am, freeing up street parking spaces. There were several available parking spaces located within 150 feet of the proposed Large Family Day Care Home. Minimum Separation The Zoning Ordinance requires a minimum 300 -foot separation between Large Family Day Care Homes located on the same street (Chapter 8.66). A minimum separation of less than 300 feet may be granted with approval of a Conditional Use Permit by the Planning Commission. There is an existing Large Family Day Care located at 4427 Sunset View Drive, approximately 125 feet from the proposed Large Family Day Care. Staff observed parents dropping off their children at the project site (existing Small Family Day Care Home) and the existing Large Family Day Care Ho me located at 4427 Sunset View Drive. Staff verified that the drop-off of children at the adjacent existing Large Family Day Care Home was staggered and that on-street parking spaces were available for use by both day care homes. ENVIRONMENTAL REVIEW: The California Environmental Quality Act (CEQA), together with the State Guidelines and City Environmental Regulations require that certain projects be reviewed for environmental impacts and when applicable, environmental documents prepared. Staff recommends that the project be found Statutorily Exempt from CEQA in accordance with CEQA Guidelines Section 15274. The project includes only a Conditional Use Permit for the operation of a Large Family Day Care Home. CONSISTENCY WITH THE GENERAL PLAN AND ZONING ORDINANCE: The project is consistent with the General Plan and Medium Density land use designation – which permits the operation of Large Family Day Care Home. The project is consistent with the Plan Development Zoning District in that a Large Family Da y Care Home is permitted subject to approval of a Zoning Clearance or a Conditional Use Permit by the Planning Commission. REVIEW BY APPLICABLE DEPARTMENT AND AGENCIES: The Building Division, Fire Prevention Bureau, and Public Works Department have reviewed the project and provided Conditions of Approval where appropriate to ensure that the project is established in compliance with all local ordinances and regulations. 5.1 Packet Pg. 12 Page 4 of 4 NOTICING REQUIREMENTS/PUBLIC OUTREACH: In accordance with State law, a Public Notice was mailed to all property owners and occupants within 300-feet of the proposed project. The Public Notice was also published in the Valley Times and posted at several locations throughout the City. To date, the City has received no objections regarding the Project. Site Plan 5.1 Packet Pg. 13 RESOLUTION NO. 18-xx A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING A CONDITIONAL USE PERMIT FOR THE OPERATION OF A LARGE FAMILY DAY CARE HOME AT 4451 SUNSET VIEW DRIVE (APN 985-0113-071) PLPA-2018-00024 WHEREAS, the Applicant, Prachi Nadkarni, has requested approval of a Conditional Use Permit for the operation of a Large Family Day Care Home at 4451 Sunset View Drive (the “Project”); and WHEREAS, a Large Family Day Care Home is permitted in all residential districts subject to the Development Standards and Regulations contained in Chapter 8.66 (Large Family Day Care Homes) of the Dublin Zoning Ordinance; and WHEREAS, a Large Family Day Care Home that does not meet all of the Development Standards and Regulations contained in Section 8.66.030 is subject to a Conditional Use Permit to be reviewed by the Planning Commission; and WHEREAS, the proposed Large Family Day Care Home does not meet the Pa rking Standard or the Minimum Separation Standard as described in Chapter 8.66; therefore, the Applicant is requesting approval of a Conditional Use Permit to operate a Large Family Day Care Home at the project site. WHEREAS, the California Environmental Quality Act (CEQA), together with State Guidelines and City Environmental Regulations require that certain projects be reviewed for environmental impacts; and WHEREAS, the project is exempt from the California Environmental Quality Act (CEQA) in accordance with Section 15274 because it is a Large Family Day Care Home. WHEREAS, a Staff Report was submitted to the Planning Commission on November 13, 2018 recommending approval of said application; and WHEREAS, the Planning Commission did hold a properly noticed public hearing on said application on November 13, 2018 at which time all interested parties had the opportunity to be heard; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth and used its independent judgment to evaluate the project. NOW, THEREFORE, BE IT RESOLVED that the foregoing recitals are true and correct and made a part of this resolution. 5.1.a Packet Pg. 14 Attachment: 1. Resolution approving a Conditional Use Permit for the operation of a Large Family Day Care Home at 4451 Sunset View Drive 2 of 7 NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission of the City of Dublin does hereby make the following findings and determinations regarding the Conditional Use Permit for the establishment and operation of a Large Family Day Care Center: A. The proposed use and related structures are compatible with other land uses, transportation and service facilities in the vicinity in that: 1) the proposed Large Family Day Care Home complies with State laws that require the primary use of the site to be a single-family residential use with the Day Care as an accessory use; and 2) the noise and traffic impacts will be minimized by restrictions on the hours of operation an d the low number of vehicle trips that may be generated by the project. B. It will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety and welfare in that: 1) the proposed Large Family Day Care Home will comply with all City of Dublin and State regulations; 2) the Large Family Day Care Home will be located at an existing facility that currently serves as a Small Family Day Care Home; 3) the project has been conditioned so that all activities will be controlled so as to not create a nuisance to the surrounding residents ; and 4) the Day Care Home will be a state licensed facility. C. It will not be injurious to property or improvements in the neighborhood in that : 1) as conditioned, noise and traffic impacts will be minimized by Conditions of Approval which establish limits on the number of children enrolled and the hours of operation; 2) two required parking spaces will be provided on-site; 3) a Condition of Approval has been placed on the project that requires the employee who does not reside at the residence to park in the garage; and 4) the parking reduction is warranted based on the availability of loading spaces on Sunset View Drive. D. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety, and welfare in that: 1) vehicular and pedestrian access is provided to the site from existing sidewalks on Sunset View Drive; and 2) the proposed Large Family Day Care Home is located in an existing residence served by existing public utilities, services and infrastructure. E. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed in that: 1) the Large Family Day Care Home will be located on an existing site; 2) two parking spaces will be provided on -site; 3) as conditioned, the employee who does not reside at the residence will park in the garage; 4) the parking space reduction is appropriate based on the existing street width and capacity and the availability of parking spaces along Sunset View Drive. F. It will not be contrary to the specific intent clauses, development regulations, or performance standards established for the zoning district in which it is located in that: 1) a Large Family Day Care Home is permitted in all residential districts subject to the Development Standards and Regulations contained in Chapter 8.66 (Large Family Day Care Homes) of the Dublin Zoning Ordinance; 2) a proposed Large Family Day Care Home that does not meet all of the Development Standards and Regulations contained in Section 8.66.030 is subject to a Conditiona l Use Permit to be reviewed by the Planning Commission; 3) the proposed Large Family Day Care Home does not meet the parking standard or the minimum separation standard as described in Chapter 8.66; 4) the 5.1.a Packet Pg. 15 Attachment: 1. Resolution approving a Conditional Use Permit for the operation of a Large Family Day Care Home at 4451 Sunset View Drive 3 of 7 Applicant is satisfying the parking requirement by utilizing the two parking spaces in the garage for the employee who resides in the home or who resides outside the home and by providing two loading spaces in front of the home; 5) the requested parking reduction has been determined to be warranted based on the capacity and width of Sunset View Drive and the availability of loading sp aces on Sunset View Drive; and 6) a Condition of Approval has been placed on the project that requires the employee who does not reside at the residence to park in the garage. G. It is consistent with the Dublin General Plan and with any applicable Specific Plans in that: 1) the proposed use is permitted with a Conditional Use Permit and meets the intensions of the Zoning District; and 2) as conditioned, the Large Family Day Care Home will operate in such a manner as to limit impacts on the surrounding properties. BE IT FURTHER RESOLVED that the Planning Commission does hereby approve a Conditional Use Permit for the establishment and operation of a Large Family Day Care Home at 4451 Sunset View Drive subject to the following conditions: CONDITIONS OF APPROVAL Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits, and shall be subject to Planning Division review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval: [PL] Planning; [B] Building; [PO] Police; [PW] Public Works; [ADM] Administration/City Attorney; [FIN] Finance; [PCS] Parks and Community Services; [F] Dublin Fire Prevention; [DSR] Dublin San Ramon Services District; [LDD] Livermore Dublin Disposal; [CO] Alameda County Department of Environmental Health; [Zone 7] Alameda County Flood Control and Water Conservation District, Zone 7; [LAVTA] Livermore Amador Valley Transit Authority; and [CHS] California Department of Health Services. NO. CONDITIONS OF APPROVAL Agency When Required, Prior to: GENERAL 1. Approval. This Conditional Use Permit approval for Happy Little Munchkins (PLPA-2018-00024) is for a Large Family Day Care Home located at 4451 Sunset View Drive. This approval shall generally conform to the Written Statement and Facility Sketch dated September 12, 2018. PL On-going 2. Effective Date. This Conditional Use Permit approval becomes effective 10 days following action by the Planning Commission unless appealed before that time in accordance with the Dublin Zoning Ordinance. PL On-going 3. Permit Expiration. Construction or use shall commence within one (1) year of Permit approval or the Permit shall lapse and become null and void. PL 1 year from approval 4. Time Extension. The original approving decision- maker may, upon the Applicant’s written request for an extension of approval prior to expiration, and upon the PL 1 year from approval 5.1.a Packet Pg. 16 Attachment: 1. Resolution approving a Conditional Use Permit for the operation of a Large Family Day Care Home at 4451 Sunset View Drive 4 of 7 determination that any Conditions of Approval remain adequate to assure that applicable findings of approval will continue to be met, grant a time extension of approval for a period not to exceed six (6) months. All time extension requests shall be noticed and a public hearing or public meeting shall be held as required by the particular Permit. 5. Modifications. The Community Development Director may consider modifications or changes to this Permit approval if the modifications or changes proposed comply with applicable sections of the Zoning Ordinance. PL On-going 6. Revocation of Permit. The Permit approval shall be revocable for cause in accordance with Section 8.96.020.I of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation. PL On-going 7. Requirements and Standard Conditions. The Applicant/Developer shall comply with applicable City of Dublin Fire Prevention Bureau, Dublin Public Works Department, Dublin Building Department, Dublin Police Services, Alameda County Flood Control District Zone 7, Livermore Amador Valley Transit Authority, Alameda County Public and Environmental Health, Dublin San Ramon Services District and the California Department of Health Services requirements and standard conditions. Prior to issuance of building permits o r the installation of any improvements related to this project, the Applicant/Developer shall supply written statements from each such agency or department to the Planning Department, indicating that all applicable conditions required have been or will be met. Various Issuance of building permits 8. Fees. The Applicant/Developer shall pay all applicable fees in effect, including, but not limited to, Planning fees, Building fees, Traffic Impact Fees, TVTC fees, Dublin San Ramon Services District fees, Public Facilities fees, Dublin Unified School District School Impact fees (per agreement between Developer and School District), Fire Facilities Impact fees, Noise Mitigation fees, Inclusionary Housing In-Lieu fees, Alameda County Flood and Water Conservation District (Zone 7) Drainage and Water Connection fee s; or any other fee that may be adopted and applicable. Various Issuance of building permits 9. Indemnification. The Applicant/Developer shall defend, indemnify, and hold harmless the City of Dublin and its agents, officers, and employees from any claim, action, or proceeding against the City of Dublin or its agents, officers, or employees to attack, set aside, void, or annul an approval of the City of Dublin or its ADM On-going 5.1.a Packet Pg. 17 Attachment: 1. Resolution approving a Conditional Use Permit for the operation of a Large Family Day Care Home at 4451 Sunset View Drive 5 of 7 advisory agency, appeal board, Planning Commission, City Council, Community Development Director, Zoning Administrator, or any other department, committee, or agency of the City to the extent such actions are brought within the time period required by Government Code Section 66499.37 or other applicable law; provided, however, that the Applicant/Developer's duty to so defend, indemnify, and hold harmless shall be subject to the City's promptly notifying th e Applicant/Developer of any said claim, action, or proceeding and the City's full cooperation in the defense of such actions or proceedings. 10. Clarifications to the Conditions of Approval. In the event that there needs to be clarification to the Conditions of Approval, the Community Development Director has the authority to clarify the intent of these Conditions of Approval to the Applicant without going to a public hearing. The Community Development Director also has the authority to make minor modifications to these Conditions of Approval without going to a public hearing in order for the Applicant to fulfill needed improvements or mitigations resulting from impacts to this project. PL On-going 11. Noise/Nuisances. The Applicant shall control all activities so as not to create unusual or unnecessary noise which annoys or disturbs or injures or endangers the health, repose peace or safety of any reasonable person of normal sensitivity present in the area. PL On-going 12. Annual Review. On an annual basis, this Conditional Use Permit approval may be subject to a review by the Community Development Director to determine compliance with the Conditions of Approval. PL On-going PROJECT SPECIFIC 13. Number of Children. The maximum number of children present at the Large Family Day Care Home at any one time shall not exceed 14. PL On-going 14. Hours of Operation. The Large Family Day Care Home shall operate Monday through Friday between the hours of 8:00 am and 6:00 pm. PL On-going 15. Staggered Drop-Off & Pick-up. The drop-off and pick- up of children shall be staggered over a minimum one- hour time period. PL On-going 16. Outdoor Play. No outside activities may take place before 9:00 am or after 6:00 pm. PL On-going 17. Operator Parking. The occupants of the home shall have no more than one vehicle parked at the project site from 8:00 am to 6:00 pm as long as a Large Family Day Care Home is being operated at this address. Employee Parking. The employee that does not reside in the home shall park inside the garage. PL On-going 19. Signage. No signage advertising the Day Care Home is permitted. PL On-going 20. Child Care License. The Day Care Operator shall submit a copy of the approved State Department of Social Services License Permit for the operation of the Large Family Day Care Home. PL Occupancy & On-going 21. Business License. The Applicant shall apply for a City of Dublin Business License. The Business License shall remain current and valid throughout the life of the Large Family Day Care Home. PL Occupancy & On-going FIRE PREVENTION BUREAU 22. Residential Smoke Alarms. The Large Family Day Care Home shall be equipped with residential smoke alarms. The number and placement of detectors shall be determined by the Fire Department. F Occupancy 23. Fire Extinguisher. An approved portable fire extinguisher with a minimum rating of 2A-10BC shall be provided and mounted in a location approved by the Fire Department. F Occupancy 24. Addresses. Addresses shall be posted on the building so they are clearly visible from the street. Addresses on the building not clearly visible from the street shall also be posted at the driveway entrance. F Occupancy 25. Fire Alarm. An approved device suitable for sounding a fire alarm shall be provided. The device shall be attached to the structure and produce a distinctive tone audible throughout the structure. F Occupancy 26. Room for Sleeping. Any room used for sleeping purposes shall have an operable window that can be opened for emergency escape and/or access. F Occupancy 27. Water Heater/Furnace. Every unenclosed gas-fired water heater or furnace which is within the area used for child care shall be protected in such a way to prevent the children from making contact with those appliances. F Occupancy 28. Exiting. Every story or basement of a Large Family Day Care facility shall be provided with two exits that are remotely located from each other. Doors shall have a minimum of 32 inches of clear width and not less than 80 inches in height. A manual operated sliding door may be used for one of the exits. F Occupancy 29. Exit Doors. Exit doors, including sliding doors, shall be openable from the inside without the use of a key or any special knowledge or effort. If both lock and latch are provided, both must be released with a single motion. Applicant's Written Statement (Happy Little Munchkins Large Family Day Care Home Conditional Use Permit (PLPA-2018- Prachi Arun Nadkarni 4451 Sunset View Drive, Dublin CA 94568 September 11, 2018 The City of Dublin 100 Civic Plaza Dublin, CA 94568 RE: Conditional Use Permit for Large Home-Based Daycare Dear Sir/Madam, I, Prachi Arun Nadkarni, have been serving the community of Dublin, CA since August, 2016 through my small home-based daycare, Happy Little Munchkins. I started out as a small business (6-8 children) to serve the families in my community and took care of tens of children these past 2 years. The demand for the daycare, however, kept on going up ever since. I applied for a large daycare permit, but I was told that I would need to apply for a conditional use permit (CUP) since a large home-based daycare already exists within 300 feet of my daycare at 4451 Sunset View Drive, Dublin, CA, 94568. I am a licensed childcare provider and a trained early childhood studies (ECS) practitioner. After spending over 10 years as a finance and HR professional, I found out that my true passion lies in working with children. As a result, I took several courses in ECS from Ohlone College, Fremont, and trained in early childhood education for toddlers and preschoolers. As part of the training, I specialized in early childhood growth and development and worked with some of the finest childcare providers. I am very excited about my daycare, Happy Little Munchkins, wherein I put my education to practice. I am a proponent of “learning through play” methodology and have found it to be the most effective mode of early childhood education. I also believe that every child needs his or her own curriculum based on the current needs, interests and capabilities. I put my experience into growth of the children in my daycare. As mother of a 7-year old, I get to put my academic specialization into good use on him and I can clearly see the benefits. I get very excited to work with the families in my community and am humbled that I get a chance to play a part in helping shape the future of the kids in my care. My childcare program is intended to help the children in my care to work on these broader goals: • Language development – vocabulary building, explaining stories and ideas, circle time, from 2-3 letter to complex sentences, book reading, making up stories • Gross motor skills – activities that encourage running, climbing, balancing, swinging, throwing, catching • Fine motor skills – drawing, cutting, pasting, writing, puzzle solving, stringing beads 5.1.b Packet Pg. 22 Attachment: 2. I have run a small home-based daycare for over 2 years and am eligible to apply for a large home-based daycare if I am granted the conditional use permit for the same. 2. How many employees will you have or propose to have? I currently employ 1 instructor and intend to continue doing the same. Employee Parking: The employee will be working at the daycare between the hours or 8:00 AM and 6:00 PM. She will use my garage as her off-street parking space. My husband leaves for work before 8:00 AM and arrives after 6:00 PM – his car parking space can be used by the employee between the hours of 8:00 AM and 6:00 PM. 3. What are the proposed hours and days of operation? The proposed hours and days of operation are: Monday – Friday: 8:00 AM – 6:00 PM The proposed drop off/pick-up times are: Monday – Friday: Drop Off: 8:30 AM – 9:30 AM Pick Up: 5:00 PM – 6:00 PM 4. Will your business, activity or use target a specific segment of the community? Currently, my small home-based daycare serves the families of all segments of the community. The large home-based daycare will continue doing the same. 5. In what ways will your business, activity or use benefit the community? My small home-based daycare has been serving the families in our community for the past 2 years. I have taken care of tens of children these past years and intend to serve more. If given a permit to expand, I may employ a second person from our community. 6. Are there any ways in which your business, activity or use may disrupt the peace of the surrounding residents or businesses? Expansion of my daycare is intended to be non-disruptive to the peace of the surrounding residents or businesses. I currently have a permit for up to 8 children in my daycare and expansion of the same to 14 will not account for any significant change in my day-to-day operation of the daycare. 7. Will your business, activity or use have any negative effects on the health or safety of people residing or working in the vicinity? No, the large daycare will not have any negative effects on the health or safety of people residing or working in the vicinity. 8. Will your business, activity or use create any negative impacts on property, transportation systems, or existing improvements in the neighborhood? No, the large daycare will not create any negative impacts on property, transportation systems or existing improvements in the neighborhood. 9. Is the proposed project located on hazardous waste and substances site (pursuant to Government Code Section 65962.5)? No, the large daycare is not located on hazardous waste and substance site.
