STAFF RECOMMENDATION: Approve the July 9, 2020, City Council Special Meeting Minutes and the July 21, 2020, Regular City Council Meeting Minutes. FINANCIAL IMPACT: None. STUDY SESSION Chief Garrett Holmes, Dublin Police Services, gave a presentation which included facts about the department, its policies, and services to the community. The City Council discussed policing and services in the City of Dublin and provided their feedback. Shirley Lewandowski provided public comment. Hannah Keihl provided public comment. David Burrows provided public comment. Mayor Haubert appointed Councilmember Kumagai and Councilmember Josey to an ad hoc committee to work with the City Manager and Police Chief to establish parameters for a task force and bring a recommendation back to the City Council in September 2020. 5. City of Dublin, et al., Alameda Superior Court Case No. RG19009622 Regular Meeting A Regular Meeting of the Dublin City Council was held on Tuesday, July 21, 2020, remotely via Zoom Video Communications. The meeting was called to order at 7:00 PM, by Mayor Haubert. 1. Recognition of Retirements The City Council recognized the retirements of Alameda County Fire Department Fire Chief David Rocha and the City of Dublin City Clerk/Records Manager Caroline Soto and thanked them for their years of service in the City of Dublin. Sheila Mason provided public comment Phil Tucker provided public comment. By consensus, the City Council directed Staff to bring back an item to discuss adding the words ‘diverse and inclusive’ to the City of Dublin Mission Statement, and to bring an informational report regarding how surrounding agencies are handling rent increases and late fees during the COVID-19 pandemic to determine what options the Council may have to address this issue in the City of Dublin. By motion of Mayor Haubert, seconded by Councilmember Kumagai , and by unanimous vote, Item 7.2 Review of Community Workforce Agreements: Themes, Data, and Proposed Negotiation Terms, was moved to the August 18, 2020 City Council meeting to provide more time to evaluate the staff report. First Reading of Ordinance Amending Dublin Municipal Code Section 2.08.020 and Providing for an Increase in the Salary for Members of the City Council, and item 4.10 City Proclamations for the Months of July and August, were pulled from the Consent Calendar for a separate vote and further discussion. Linda Smith, City Manager, stated a correction was made to the title of Item 4.9 on the Consent Calendar to change the phrase ‘Business Regulation’ to ‘Business Registration’ in the title of the Ordinance. 4.1. Approved the minutes of the June 9, 2020 Adjourned Regular City Council Meeting, the June 16, 2020 Regular City Council meeting with a correction to the name of a speaker on Item 3.2 Public Comment, and the June 22, 2020 Adjourned Regular City Council Meeting Minutes. 4.2. Adopted RESOLUTION NO. 74 - 20 APPROVING A CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF DUBLIN AND KIMLEY-HORN FOR PREPARATION OF THE 2023-2031 UPDATE TO THE HOUSING ELEMENT OF THE GENERAL PLAN 4.3. Confirmed the Mayor’s recommendations of appointments to the City Council 2020 Ad-Hoc Audit Review Committee. 4.4. Received the Payment Issuance Report and Electronic Fund Transfers for payments issued from June 1, 2020 – June 30, 2020 totaling $4,763,574.71. Waived the reading and adopted ORDINANCE NO. 09 - 20 ADDING SECTION 2.30 TO THE DUBLIN MUNICIPAL CODE, RELATING TO ELECTRONIC AND PAPERLESS FILING OF FAIR POLITICAL PRACTICES COMMISSION CAMPAIGN DISCLOSURE STATEMENTS 4.7. Adopted RESOLUTION NO. 75 - 20 AWARDING A DESIGN/BUILDER AGREEMENT TO ADC CONSTRUCTION MANAGEMENT, INC. FOR THE CIVIC CENTER HVAC AND ROOF REPLACEMENT, CIP NO. GI0119 4.8. First Reading of Ordinance Amending Dublin Municipal Code Section 2.08.020 and Providing for an Increase in the Salary for Members of the City Council DUBLIN CITY COUNCIL MINUTES 5 REGULAR MEETING JULY 21, 2020 The City Council discussed the salary for members of the Council and provided their feedback. Sherry Hu provided public comment. Councilmember Kumagai made a motion to approve the Ordinance as presented. The motion was seconded by Councilmember Hernandez, and by a two to three vote, the motion did not pass. RESULT: DENIED [2-3] MOVED BY: Shawn Kumagai, Councilmember SECOND: Melissa Hernandez, Councilmember AYES: Kumagai, Hernandez NOES: Goel, Haubert, Josey On motion of Councilmember Josey, seconded by Councilmember Kumagai, and by a three to two vote, the motion passed to waive the reading and INTRODUCE the Ordinance Amending Dublin Municipal Code Section 2.08.020 and Increase in the Salary by three percent per year for Members of the City Council. City Proclamations for the Months of July and August The City Council received the proclamations for the month of July and August: National Night Out Proclamation, American Muslim Appreciation and Awareness Month, and Pledge to America's Workers Month. On motion of Mayor Haubert, seconded by Vice Mayor Goel, and by unanimous vote the City Council approved the proclamations. California Community Housing Agency (CalCHA) Middle-Income Rental Housing Program The City Council received the report. On motion of Councilmember Josey, seconded by Mayor Haubert, and by unanimous vote, the City Council directed Staff to continue to work with Catalyst to address indemnification and liability concerns, and return with a Resolution authorizing the City to become a member of CalCHA and authorizing the City Manager to enter into purchase option agreements with CalCHA for essential middle-income rental housing created within City limits. Downtown Dublin Specific Plan Amendments 2020 The City Council received the presentation and provided their feedback. On motion of Councilmember Hernandez, seconded by Vice Mayor Goel, and by unanimous vote the City Council Amended the Downtown Dublin Specific Plan and adopted RESOLUTION NO. 79 - 20 AMENDING THE DOWNTOWN DUBLIN SPECIFIC PLAN TO CREATE A NEW STREET GRID IN THE RETAIL DISTRICT, SITE A TOWN SQUARE, COMBINE THE REMAINING ALLOCATION OF NEW NON-RESIDENTIAL SQUARE FOOTAGE FROM THE TRANSIT-ORIENTED AND RETAIL DISTRICTS INTO ONE POOL, ALLOW LODGING IN THE RETAIL DISTIRCT, AND AMEND THE DESIGN GUIDELINES FOR THE CORE AREA OF THE RETAIL DISTRICT PLPA-2020-00009 RESULT: ADOPTED [UNANIMOUS] MOVED BY: Melissa Hernandez, Councilmember SECOND: Arun Goel, Vice Mayor AYES: Josey, Kumagai, Goel, Haubert, Hernandez 7. The Council provided direction to Staff to continue utilizing alternates for the next round of appointments to Commissions and Committees and revisit the topic in Spring of 2021. Other Business Brief information only reports from City Council and/or Staff, including committee reports and reports by City Council related to meetings attended at City expense (AB1234). By majority, the City Council agreed to have an item brought back for a future meeting to discuss the denial of the At Dublin project with prejudice or without prejudice . 10.
