HomeMy WebLinkAboutReso 11-05 I-580FallonImprov RESOLUTION NO. t t - 05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * . . * * * . * * APPROVING FREEWAY MAINTENANCE AGREEMENT WITH THE STATE DEPARTMENT OF TRANSPORTATION (CALTRANS) FOR IMPROVEMENT OF THE I·580/FALLON ROAD INTERCHANGE WHEREAS, the City of Dublin plans to improve the Interstate 580IFallon Road freeway interchange to mitigate the Dublin Ranch area development; and WHEREAS, City Staff has been working cooperatively with Caltrans on the design and environmental documentation of the I~580/Fallon Road Interchange Improvement Project; and WHEREAS, one of Caltrans' requirements prior to issuance of an encroachment permit to construct the project is to enter into a maintenance agreement to identifY maintenance responsibilities of the proposed improvements; and WHEREAS, the project wi\1 require maintenance of new landscaping, two new traffic signals and safety lighting, and new Fallon Road pavement constructed within Caltrans' right of way; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin approves the freeway maintenance agreement with Caltrans for the improvement of the I~580/Fallon Road Interchange. BE IT FURTHER RESOLVED that the Mayor is authorized to execute the agreement. PASSED, APPROVED AND ADOPTED this Ist day of February, zoos. AYES: Co unci I members Hildenbrand, McCormick, Oravetz, Zika and Mayor Lockhart NOES: None ABSENT: None ABSTAIN: None K2/GI2_1-05/reso-caltrnns-fallonI-580 (Item 4.3) g:miscproj\I-580-Fat1on ROad\RC8O CltltrM" Maim Ag:mt Ala-580-R26.21R27.2 FREEWAY MAINTENANCE AGREEMENT THIS AGREEMENT, made and entered into in duplicate, cffcctivc this ,~ ,day of Rj.\'Y.Q...r""(~, 200), is by and between the State of California, acting by and through the Department of Transportation, hereinafter referred to as "STATE," and the City of Dublin, hereinafterreferred to as "CITY", WITNESSETH: WHEREAS, under STATE Cooperative Agreement No. 4-l820-Al bctween STATE and CITY, CITY will construct improvements to State Highway Route 580, a freeway within the limits of CITY, at the 1-580/Fallon Road Interchange, and WHEREAS, the parties hereto mutually desire to clarify the division of maintenance responsibility, upon completion of improvements and acceptance by STATE, under said Cooperativc Agrccmcnt, as to scparation structures, and local CITY streets and roads, or portions thereof, and landscaped areas lying within or outside the freeway limits. WHEREAS, a new plan map has been prepared showing the area to be maintained by the City; and NOW THEREFORE, IT IS AGREED: 1. When a planned future improvement has been constructed and/or a minor revision has been effected within the limits of the freeway herein dcscribed, which affects the parties division of maintenance responsibility as described hercin, STATE will providc a ncw dated and revised Exhibit "A" which will be made a part hercofby an amendment to this Agreement whcn executed by both parties, which wi]] thereafter supersede the attached original Exhibit "A" and which will then become part of this Agreement. 2. VEHICULAR OVERCROSSINGS STATE will maintain, at STATE expense, the entire structure of any vehicular and pedestrian overcrossings below the dcck surface except as hereinafter provided. CITY wi\1 maintain, at CITY expense, the deck and/or surfacing (and shall perfOillJ such work as may be necessary to ensure an impervious and/or othcrwise suitable surface) and all portions of the structure above the bridge deck, including, but without limitation, lighting installations, as well as all traffic service facilities (signals, signs, pavement markings, rails, etc.) that may bc required for the benefit or control of traffic using that overcrossing. Screening shall be placed at such locations (as shall be determined by STATE), on STATE freeway overpasses on which pedestrians are allowcd (as directed by Sect. 92.6 ofthc Strcets and Highways Code). All screens instal1ed under this program will be maintained by STATE (at STATE expense). 1 AIa-580-R26.21R27.2 3. LANDSCAPED AREAS ADJACENT TO CROSSING STRUCTURES Any plantings or oth.er types of roadside devclopmcnt lying outside of the area reserved for exclusive freeway use shaH be maintained by CITY at CITY expense. CITY shall also maintain, at CITY expense, landscaping within the area reserved for freeway use as shown on Exhibit "A". CITY shall not enter said landscaped areas within freeway limits via thc frceway side unless an encroachment permit is obtained from STATE. 4. INTERCHANGE OPERATION It is the responsibility of the STATE to provide efficicnt operation of freeway interchanges including ramp connections to local streets and roads. The maintcnance and energy costs of safety lighting, traffic signals or other necessary electricaIJy operated traffic control dcviccs at ramp connections to CITY streets shaH be shared, between the STATE and the CITY. CITY will operate the traffic control signal(s) as jnstalled and pay one hundred percent (100%) of the operation cost. In the event STATE's Traffic Operations Center determines that the operation of the traffic control signal(s) is unacceptable, and CITY fails to satisfactorily improve the opcration, STATE will instaH a State standard controller at CITY's expense. STATE will thcn operate the traffic control signal(s) as instaIJed and pay one hundred percent (100%) of the operation cost. STATE wiH maintain the traffic control signal system as instal1ed and pay an amount equal to fifty percent (50%) of the total maintenance costs including electrical energy costs. CITY shaH reimburse STATE for CITY's proportionate share of said maint~nance costs, such share to be an amount equal to fifty percent (50%) of the total maintenance costs, including electrical energy costs. Whcn thc National Electrical Manufacturers Association (NEMA) sponsored National Traffic Control/IYHS Communication ProtocoJ (NTCIP) is completed, and STATE has imp1emented this protocol in a State standard control1er to communicate with the 1-580 Smart Corridor System, STATE will replace CITY's controller with STATE's control1er at STATE's cxpcnse. STATE will then operate the traffic control signal(s) as instaIJed and pay one hundred percent (100%) of the operation cost. STATE will maintain the traffic control signal system as installed and pay an anJount equal to fifty perccnt (50%) of the total maintenance costs, including electrical energy costs. CITY shall rcimburse STATE for CITY's proportionate share of said maintenance costs, such share to be an amount equal to fifty percent(50%) of the total maintenance costs, including electrical energy costs. 2 Ala-580,R26.21R27.2 5. LEGAL RELATIONS AND RESPONSæILJTIES: A. Nothing in the provisions of this Agreement is iotended to crcate duties or obligations to or rights in third parties not parties to th.is contract or affect the lcgalliability of either party to the contract by imposing any standard of care with respect to the maintenance of STATE highways different from the standard of care imposed by law, B. It is understood and agreed that neither STATE nor any officer or employee thereof is responsible for any damage or liability occurring by reason of anything done or omitted to be done by CITY under or in connection with any work authority or jurisdiction delegated to CITY under this AgreenJent. It is understood and agreed that, pursuant to Government Code section 895.4, CITY shaH defend, indemnifY and save harmless STATE and aU of its officcrs and employees from aU claims, suits or actions of every name, kind and description brought for or on account of injuries to or death of any person or damage to property resulting from anything done or ornitted to be done by CITY under or in connection with any work, authority or jurisdiction delegated to CITY under this Agreement. C. It is understood and agreed that neither CITY nor any officer or employee thereof is rcsponsible for any damage or liability occurring by reason of anything done or omitted to be done by STATE under or in connection with any work, authority or jurisdiction delegated to STATE lInder this Agreement. It is understood and agreed that, pursuant to Government Code section 895.4, STATE shaH defend, indemnify and save harmless CITY and aU of its officers and employees from all claims, suits or actions of every name, kind and description brought for or on account of injuries to or death of any person or damage to property resulting from anything done or omittcd to be done by STATE under or in connection with any work, authority or jurisdiction delegated to STATE under this Agreement. 6. EFFECTIVE DATE This Agrcement shall be effective upon the date appearing on its face, it being understood and agreed, however, that the execution of this Freeway Maintenance Agreement shall not affect any pre,existing obligations of CITY to maintain designated areas pursuant to prior written notice from STATE that work in such areas, which CITY has agreed to maintain pursuant to the terms of the Freeway Agreement, has been completed. 3 Ala-580-R26.2iR27.2 IN WITNESS WHEREOF, the partics hereto have set their hands and seals the day and year first above written.
