HomeMy WebLinkAboutAttachmt 1 ResoAdoptNegDecl RESOLUTION NO. 05- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ADOPTING A NEGATIVE DECLARATION FOR A CONDITIONAL USE PERMIT (CUP) AND SITE DEVELOPMENT REVIEW (SDR) TO CONSTRUCT A 53,860 SQUARE FOOT AUTO SALES AND SERVICE ESTABLISHMENT ON THREE PARCELS AT 6363, 6391, AND 6451 SCARLETT COURT P A 04-009 WHEREAS, Ken Harvey, on behalf of Dublin Honda, has requested approval of a Conditional Use Permit! Site Development Review application for a 53,860 square foot automotive sales and service establishment with a 245-stall parking lot on three parcels at the southeast comer of Dublin Boulevard and Scarlett Court; and WHEREAS, the California Environmental Quality Act (CEQA), together with the State guidelines and City environmental regulations require that certain projects be reviewed for environmental impact and that environmental documents be prepared;· and WHEREAS, an Initial Study was conducted finding that the project, as proposed, would not have a significant effect on the environment; and WHEREAS, a Negative Declaration has been prepared for this application and is on file in the City of Dublin Planning Department; and WHEREAS, the City accepted comments on the Dublin Honda Auto Dealership Site Development Review and Conditional Use Permit Initial StudylNegative Declaration during the 20-day public comment period, which ran from December 18, 2004 and ended on January 7, 2005 at 5:00 p.m.; and WHEREAS, no comments were received either during or after the comment period; and WHEREAS, the Planning Commission did review and use their independent judgment to consider the Negative Declaration at a public hearing on February 22,2005; and WHEREAS, proper notice of said public hearing was given in all respects as required by law. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed 53,860 square foot auto sales and service establishment on three parcels at 6363, 6391, and 6451 Scarlett Court in Dublin will not have a significant effect on the environment based on review ofthe Initial Study and public testimony. B. The Negative Declaration has been prepared and processed in accordance with State and local environmental laws and guideline regulations. C. The Negative Declaration is complete and adequate. NOW, THEREFORE BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby adopt the Negative Declaration for P A 04-009, the proposed auto sales and service establishment on three parcels at 6363,6391, and 6451 Scarlett Court in Dublin.
