Consideration of a Request for Sewer Capacity Assistance Prepared By: Linda Maurer, Economic Development Director EXECUTIVE SUMMARY: • The City Council will provide direction to Staff regarding a request for participation in the City's Sewer Capacity Assistance Program. FINANCIAL IMPACT: If the City Council provides direction to Staff to proceed, there would be legal fees associated with the review of the agreement for sewer capacity. RECOMMENDATION: Staff recommends that the City Council provide direction regarding the request for participation in the Program. (5 2- O b DESCRIPTION: On May 4, 2010, the City Council adopted Resolution 53-10 approving a Letter Agreement with the Dublin San Ramon Services District (DSRSD) for the Administration of Unused Sewer Capacity for the City of Dublin. ' Commonly referred to as the Sewer Capacity Assistance Program, the Program allows the City to market its excess sewer capacity as an economic .development incentive program to help stimulate economic growth in the community. The Program is designed to support large and small businesses and encourage the recruitment, renovation or re-use of properties in Dublin. The Program allows the City to provide a credit of up to twenty-five percent (25%) of the DSRSD connection fees that would otherwise be paid by the applicant. The City Council is being asked to consider a request from Matthew Scanlan, President of Bratts Entertainment, Inc. to participate in the program. Bratts Entertainment is exploring their options relating to the financing of additional sewer capacity requirements for a proposed new entertainment venue called Star Lanes; which combines bowling with an upscale lounge/sports bar experience. The proposed project, located at 6075 Amador Plaza Road (the former Good Guys location), would meet with the intent of the new Downtown Specific Plan's Guiding Principles, in that it encourages businesses that support evening activities for adults and teenagers. Through the Program, the City would be able to assist Mr. Scanlan with approximately $45,000 in fees of the $180,000 in sewer capacity fees. Of the remaining balance of fees, Mr. Scanlan could finance $100,000 through DSRSD's financing program and pay the remaining balance. Mr. Scanlan has submitted his application for a Minor Use Permit and a Conditional Use Permit to the Community Development Department to process the proposed indoor recreation use and the parking standard respectively. Mr. Scanlan's participation in the Program would: be subject ~ to the approvals necessary to operate his business at the proposed location. Staff is seeking City Council direction at this time before investing a significant amount of Staff time and associated legal fees in drafting the necessary agreements. If the City Council desires, Staff will work with Mr. Scanlan, the property owner and the Dublin San Ramon Services District to draft the agreements and will bring back the agreements for City Council action at a future date. .
