EXECUTIVE SUMMARY:
On February 1, 2011, the City Council approved the Tract 7943 final map for the Arroyo Vista
residential project at 6700 Dougherty Road. The Arroyo Vista residential project is a community
of 378 residential units (including 198 market rate and 180 affordable housing units) with a
Community Center and Childcare Center on approximately 24 acres. Minor land transfers are
proposed between the City of Dublin, the Zone 7 Water Agency, Eden Housing, and KB Homes
so that property lines follow the existing Alamo Creek Trail.
FINANCIAL IMPACT:
The proposed land transfers include the transfer of smal
cleaning up ownership along the trail frontage and
easements. The transactions are minor and do not ha
developer.
RECOMMENDATION:

DESCRIPTION:
In accordance with the approval of Vesting Tentative Map 7943 (Planning Commission
Resolution 09-15), the street right-of-way dedications and improvement agreements for the
Arroyo Vista project have been completed. On February 1, 2011, the City Council approved the
Tract 7943 final map, and it was later recorded with the County of Alameda. A copy of the Final
Map is included as Attachment 1 to this Staff Report.
Historically, portions of the Arroyo Vista property adjacent to Alamo Creek have been
encumbered by easements in favor of Zone 7. These easement areas are utilized by Zone 7.
for creek maintenance access, and also used by the City of Dublin for the Alamo Creek Trail.
The Tract 7943 final map included dedication of those easement areas to the City in fee.
Refinements to the site plan showed the need for modifications to the property lines created on
the final map to better reflect tlie ownership and use of several small areas around the properfy.
More specifically, portions of the Alamo Canal Trail encroach into the Arroyo Vista property, and
in other locations there is excess City or Zone 7 land that is not needed for the trail and can be
transferred to the adjoining private property. Eden Housing and KB Home have developed a
plan with the City and Zone 7 to correct discrepancies between the Arroyo Vista property line
and the existing Alamo Creek Trail location. The proposed property line adjustments are shown
on the Zone 7 Land Swap, Arroyo Vista-Eden Housing, which is included as Attachment 2 to
this staff report. The plan proposes a total of twelve land transfer actions between Zone 7 and
Eden Housing and KB Home, but the City is only involved in five transfer actions as sliown on
Tables 1. & 2. In addition, it is proposed that the City of Dublin transfer two small portions of
parcels owned in fee by the City to the adjoining properties to coincide with the abandonment of
Zone 7 easements over the parcels, and that one small portion of a parcel owned by KB Homes
be transferred to the City of Dublin. The transfer of ownership for these three parcels of land
are described in the plat and legal descriptions included as Exhibits A, B, and C to the
Resolution (Attachment 3 to-this report) approving the_ Vacation of Land, Acceptance of Grant
Deed, and Acceptance of Easements for Tract 7943 (Arroyo Vista).

It was also determined that there are two locations on the project site where trail access
easements are needed so that the City could access the Alamo Creek Trail in the event of an
emergency and also for the purposes of trail maintenance. This request was also granted in an
effort to offset the property exchange. The access easements for fhese two parcels of land are
described in the plat and legal descriptions included as Exhibits D and E to Attachment 3, and a
summary of the new easements being created is provided in Table 2 below:

The City of Dublin will utilize these two easements for the purposes of accessing the Alamo
Creek Trail for routine maintenance and in the event of an emergency.
Approval by the City Council is required for the two land transfers to Eden Housing and KB
Homes. A resolution (Attachment 3) has been prepared approving the land transfers and
authorizing. the City Manager to execute the grant deeds to the adjoining properties. The
resolution also includes acceptance of the grant deed from KB Homes and the two easements.

VACATION OF LAND, ACCEPTANCE OF GRANT DEED, AND ACCEPTANCE OF
EASEMENTS FOR TRACT 7943 (ARROYO VISTA)
WHEREAS, the Final Map for Tract 7943, in the incorporated territory of the City of
Dublin, State of California, has been presented to this City Council for approval, all in
accordance with provisions of the Subdivision Map Act of the State of California and the City of
Dublin Municipal Code; and
WHEREAS, this extended territory included the entirety of the area within the boundaries
of the Arroyo Vista property which is adjacent to Alameda County Flood Control District, Zone 7
Alamo Creek Line F; and
WHEREAS, portions of the Arr.oyo Vista property were encumbered by easements in
favor of the Zone 7 Water Agency (Zone 7), and
WHEREAS, the easement areas utilized by the City of Dublin for the Alamo Creek Trail
and by Zone 7 for maintenance of the adjoining Alamo Creek Flood Control Channel; and
WHEREAS, the fee title of the easement areas was dedicated to the City on the Tract
7943 final map for use; and
WHEREAS, it has been determined that at three locations the existing property
ownership does not coincide with the physical location of the trail, requiring a land transfer from
the City of Dublin at two locations to the adjoining property owner and at one location from the
adjoining property owner to the City of Dublin, and grant deeds for these three land transfers
have been prepared; and
WHEREAS, in addition, at two locations the City of Dublin requires access easements
from the adjoining property owners for future maintenance of the trail, and grants of easement
for these two easements have been prepared; and
NOW, THEREFORE, BE IT RESOLVED that the proposed two grant deeds of City
property, the acceptance of the grant deed of property, and the acceptance of two grant deeds
of easements are hereby approved.
BE IT FURTHER RESOLVED that the City Manager of the City of Dublin is hereby
authorized to execute the two grant deeds of City property, to accept the grant deed of property, ~
and to accept the two grant deeds of easements, attached hereto as Exhibits "A-E", and that
the Clerk of this City Council is hereby directed to transmit said documents to the County
Recorder for filing. ________ _______
