It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: The internal streets and common areas will be privately owned and maintained by the Tralee Village Center Homeowner's Association. The public right-of-way improvements replaced or modified improvements that were already existing, and will not result in an additional maintenance cost for the City. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Accepting Improvements for Tract 7457, Tralee Village (Pfeiffer Ranch Investors, Inc.) and Approving Regulatory Traffic Control Devices. ~ ~~ r, . ~ Submitted By Public Works Director Review y Assistant City Manager Page 1 of 3 ITEM NO. '`'~ ~ DESCRIPTION: Pinn Brothers Fine Homes, Inc., dba Pfeiffer Ranch Investors, Inc., has completed commercial and a portion of the residential improvements for Tract 7457, Tralee Village. Tract 7457 is a phased commercial and residential development approved by the City Council in July, 2004. The project site is located at the northwest corner of the Dougherty Road/Dublin Boulevard intersection and will, when completed, consist of 34,950 square feet of commercial space and 233 unit flats and townhouse-style condominiums. This work was governed by an Improvement Agreement executed on May 16, 2006, via City Council Resolution No. 61-06. The developer has completed street improvements along the Dougherty Road and Dublin Boulevard frontages associated with the project, including modification of the existing traffic signal at Dublin Boulevard and the project entry. The internal private street improvements serving the project have also been completed, with the exception of several alleyways serving eight townhome buildings that have not yet been constructed. Control of the project passed to Signature Homes in March, 2011. Signature Homes has obtained building permits for the remaining units and will complete the alleyways as a condition of occupancy. Signature Homes has also posted bonds to cover the remainder of the sitework construction. It is appropriate that the improvements now be accepted by the City, with maintenance of improvements in the public right-of-way to be by the City and for the onsite improvements to be maintained by the Tralee Village Center Homeowner's Association. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Adare Street, Bantry Bay Street, Dublin Court, Tralee Village Drive and Village Center Way are designated as "Private Streets". At the time that the City and Pfeiffer Ranch Investors, Inc. executed the Improvement Agreement, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount $2,375,574.00 for site improvements, to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code. Both the frontage and onsite improvements were completed over finro years ago. The developer addressed the punchlist items at that time, and recent inspection shows that, after two years of use, no further defects have appeared and the improvements have held up to normal use. Based on the above, staff is recommending that the developer not .be required to post a 12- month warranty bond as a condition of release for the performance and labor and materials bonds. The City Attorney concurs with this recommendation. ~ NOTICING REQUIREMENTS/PUBLIC OUTREACH: A copy of the staff report has been sent to Greg Pinn of Pinn Brothers Fine Homes and to Patrick Van Ness of Signature Homes. AND APPROVAL OF REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 7457, filed on June 13, 2006, in Book 291 of Maps at Pages 29 - 37, previously entered into an Improvement Agreement with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: a) Subdivider: b) Tract Location: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: Pfeiffer Ranch Investors, Inc., a California Corporation West of Dougherty Road, south of Sierra Lane and north of Dublin Boulevard 4 Lots, 34,950 SF Retail, 233 Multi-Family Units No. 61-06, City of Dublin City Council Dougherty Road and Dublin Boulevard WHEREAS, the improvements associated with Tract 7457 governed by the agreement are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the original improvement Performance Bonds and Labor and Materials Bonds that guaranteed the Improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) Adare Street, Bantry Bay Street, Dublin Court, Tralee Village Drive and Village Center Way are designated as "Private Streets". 3. The original Performance Bond issued by Developers Surety and Indemnity Company in the amount of $2,375,574.00 (Bond No. 720570S) be released; and 4. The original Labor and Materials Bond issued by Developers Surety and ~ Indemnity Company in the amount of $2,375,574.00 (Bond No. 720570S) be released.
