Waffle, Senior Planner ATT ACHMENTS: 1) Letter dated August 4, 2008 from Corrie Development Corporation requesting an initiation of a West Dublin BART Specific Plan Amendment Study for the property at 7950 Dublin Boulevard. 2) Email dated August 12, 2008, from Eric Heffner (Windstar Development) opposing the initiation of the proposed Specific Plan Amendment Study. 3) Letter dated August 12, 2008, from Corrie Development Corporation withdrawing the Initiation request. RECOMMENDATION: ~Pt the withdrawal request. FINANCIAL STATEMENT: None. PROJECT DESCRIPTION: As part of the City's Goals and Objectives, Staff is currently working with RBF on the preparation of a new consolidated Downtown Specific Plan. That Specific Plan would consolidate the West BART Specific Plan with the other downtown plans. On August 5, 2008, Corrie Development Corporation submitted a request for the property located at 7950 Dublin Boulevard to be studied to allow zoning that was previously allowed prior to the W est BART Specific Plan approval (Attachment 1). The letter was unclear as to whether the request was to perform a COPY TO: Page 1 of2 ITEM NO. g.5 G:\PA#\2008\Pegasus_Corrie Hotel\08-19-08 CCSR SPA Initiation Withdrawal.doc Study to occur ahead of the consolidated Specific Plan process. Therefore, during conversations with the developer's (Pegasus Group) representative, Guy Houston, it was first explained to Staff that the developer wanted the Study to proceed ahead of the new Downtown Specific Plan. Therefore, Staff prepared a Notice to Property Owners noticing a public meeting on August 19,2008 for the City Council to consider initiating the Study. Following distribution of the Notice, just prior to preparing the Staff Report, Staff received a letter withdrawing the application (see Attachment 3). Staff received one comment on the proposed Initiation as a result of the Notice (Attachment 2). Staff recommends that City Council accept the Developer's withdrawal request, the end result of which would be that the Developer's request and the comment will be considered as part of the Downtown specific plan review process. As previously discussed this property already had entitlements for office, retail and potential motel, hotel lIse. The above entitlements for retail, hotel, motel were removed from our property without our knowledge or approval. We entered into the Agreement with BART based upon the fact the only other Hotel site in West Dublin BART Specific Plan would be the site of the current Raddison Hotel on Regional Street To allow an additional parcel ofland to be re zoned in the West Dublin BART Specific Plan area to a hospitality use will have a negative outcome for our parcel. Therefore we respectfully request that this request for re zone be denied. Thank you. Eric L.
