FINANCIAL STATEMENT: Sorrento at Dublin Ranch I, LP, has provided a warranty bond issued by Arch Insurance Company in the amount of $643,000 (Bond No. SU5025438-A) to guarantee against any defects in the Aviano Way, Palermo Way, Capoterra Way and Perugia Street improvements. DESCRIPTION: Sorrento at Dublin Ranch I, LP, a California Limited Partnership owned by wholly-owned subsidiaries of Toll Brothers, Inc., entered into a Tract Improvement Agreement with the City of Dublin to construct improvements required by Tract 7641, Sorrento at Dublin Ranch (West). Tract 7641 is the master subdivision for the western portion of Toll Brothers' Sorrento at Dublin Ranch, bounded by Brannigan Street, Gleason Drive, Grafton Street and Central Parkway. Tract 7641 improvements included roadway improvements for Brannigan Street and Central Parkway, which were previous approved and accepted on October 2, 2007 by Resolution 1.77-07. The remaining Tract 7641 improvements for Aviano Way, Palermo Way, Capoterra Way and Perugia Street between Palermo Way and Capoterra Way, are now complete, with the exception of portions of landscaping and sidewalk along the Perugia Street eastern frontage. Toll Brothers will obtain an Encroachment Permit, COPY TO: Steve Herndon, Toll Bros. Page 1 of 2 ITEM NO. G:\DEVELOPMENT, PRIVATE\Dublin Ranch\Sorrento\Tract 7641-Sorrento West\agst accept Tract 7641 imps.doc ~~ with surety, to complete the Perugia Street frontage improvements with the adjacent building construction, and will provide a safe pedestrian detour around the incomplete sidewalk until the sidewalk is completed. The improvements for Grafton Street between Gleason Drive and Central Parkway are included in a separate Improvement Agreement and will be accepted when the Toll Brothers complete the pedestrian bridge over Grafton Street. Sorrento at Dublin Ranch I, LP, provided a Performance Bond, and a Labor and Materials Bond issued by Arch Insurance Company in the amount of $2,874,000. (Bond No. SU5018923) for Tract 7641 improvements. These bonds include $303,000 for the Brannigan Street improvements and $2,571,000 for the remainder of the Tract 7641 improvements for Aviano Way, Palermo Way, Capoterra Way and Perugia Street. These bonds were previously reduced to $643,000 by Resolution 177-07. Sorrento at Dublin Ranch I, LP, has provided a Warranty Bond issued by Arch Insurance Company in the amount of $643,000 (Bond No. SU5025438-A) for the Aviano Way, Palermo Way, Capoterra Way and Perugia Street improvements. In accordance with authority contained in §66499.7 of the Government Code, the Performance Bond, and the Labor and Materials Bond may now be released. RECOMMENDATION: Staff recommends that the City Council adopt the resolution Accepting Improvements and Approving Regulatory Traffic Control Devices for Tract 7641, Sorrento at Dublin Ranch (West). Page 2 of 2 1 3 RESOLUTION NO. - 08 ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES FOR TRACT 7641, SORRENTO AT DUBLIN RANCH (WEST) WHEREAS, the subdivider of Tract 7641, Sorrento at Dublin Ranch I, LP, a California Limited Partnership, filed on May 30, 2006, in Book 291 of Maps at Pages 26-26, previously entered into a Tract. Improvement Agreement with the City of Dublin dated April 4, 2006, Resolution 35-06, to improve said Tract in accordance with plans on file with the City Engineer; and WHEREAS, the improvements for Aviano Way, Palermo Way, Capoterra Way and Perugia Street between Palermo Way and Capoterra Way, are complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the roadway improvements, associated with Central Parkway northern frontage between Brannigan Street and Lockhart Street, and Brannigan Street between Central Parkway and Gleason Drive, including the traffic signal modifications at the Central Parkway/Brannigan Street intersection, were previous approved and accepted on October 2, 2007 by Resolution 177-07; and WHEREAS, certain regulatory traffic control devices have been installed as part of the for Aviano Way, Palermo Way, Capoterra Way and Perugia Street improvements; and WHEREAS, the Performance Bond, and the Labor and Materials Bond can be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Warranty Bond to guarantee the completed work for aone-year period following acceptance; and WHEREAS, Sorrento at Dublin Ranch I, LP, has provided Warranty Bonds to guarantee the Aviano Way, Palermo Way, Capoterra Way and Perugia Street improvements for aone-year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The Aviano Way, Palermo Way, Capoterra Way and Perugia Street improvements completed with said project are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Labor and Materials Bond issued by Arch Insurance Company in the amount of $2,874,000 for the tract improvements (Bond No. SU5018923) and reduced to an amount of $643,000 by Resolution 177-07 be released; and 3. The original Performance Bond issued by Arch Insurance Company in the amount of $2,874,000 for the tract improvements (Bond No. SU5018923) and reduced to an amount of $643,000 by Resolution 177-07 be released; and ~ T~~ #- ~ -~ «~~r~~ 1 ATTACHMENT 1. a ~3 4. The submitted Warranty Bond issued by Arch Insurance Company in the amount of $643,000 for the tract improvements (Bond No. SU5025438-A) be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 7th day of October, 2009. 5. The regulatory traffic control devices installed as part of the Aviano Way, Palermo Way, Capoterra Way and Perugia Street improvements are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) No parking on both sides of Aviano Way between Brannigan Street and Rimini Lane/Rimini Court. b) No parking on both sides of Palermo Way through the turn. c) No parking on both sides of Capoterra Way through the turn. d) No Parking along the landscape popouts on Aviano Way, Palermo Way, Capoterra Way and Perugia Street. e) Three-way stop signs at the Aviano Way, Palermo Way and Capoterra Way intersection. f) Four-way stop signs at the Palermo Way and Perugia Street intersection. g) Three-way stop signs at the of Capoterra Way and Perugia Street intersection. h) Stop Sign eastbound on Palermo Way at Grafton Street. i) Stop Sign eastbound on Capoterra Way at Grafton Street. j) Stop Signs on Rimini Lane and Rimini Court at Aviano Way. k) Stop Sign on Montalcino Street at Capoterra Way. 1) Stop Sign on Mirano Court at Capoterra Way.
