The cost to modify the artwork is $5,000. An additional appropriation from the Public Art Fund (Acct. # 311.80110.740.000) is necessary. DESCRIPTION: At the October 21, 2008 meeting, the City Council received a report on the artwork at Bray Commons Park: Specifically, the report outlined complaints that had been received regarding the noise generated by the artwork and safety issues related to leaves falling from the artwork. As a result, the City Council directed Staff to proceed with removal of the leaves from the tree, coating the leaves with a plastic material and re-hanging the leaves with twist ties or some other method. Staff has met with artist Bill Gould to facilitate modifications to the artwork. The artist has suggested a slightly different process from that which was directed by the Council. This process includes: • Remove all the leaves from the artwork; • Coat the leaves with. aplastic/rubber high solid polymer coating to deaden the metallic sound; • Reinforce the hanging-hole on each leaf with a metal grommet; • Re-hang the leaves using a sturdy S-hook and cable to reduce friction and sound placing a metal crimp underneath each leaf to eliminate the leaf from sliding off. One or two leaves will be hung on each cable. The cables will be spread out to allow for more space between the leaves which should reduce the noise factor, especially in the wind. Less total leaves will be hung to further reduce the noise factor. The artist will do a few test runs with a group of leaves to access the impact of the changes and how they improve safety and sound issues. Sound tests will be done during the process, and representatives of the Dublin Terraces will be kept informed of the progress and results as well. The work will begin in late December and will be completed by March 2009. Since funds are not available in the Fiscal Year 2008-2009 Budget for modifications to the artwork, Staff is requesting an additional appropriation from the Public Art Fund in the amount of $5,000. Public Art funds can be used for maintenance of artwork owned by the City. This appropriation does not impact Public Art Fund balances collected specifically for the Transit Center Public Art project, which is currently underway. A Budget Change Form is Attachment 2. RECOMMENDATION: Staff recommends that the City Council procure the services of Bill Gould, Artist in an amount not to exceed $5,000 and approve the Budget Change.
