The meeting was called to order at 7:00 PM., by Mayor Hernandez. 1)Call to Order Attendee Status Melissa Hernandez, Mayor Present Shawn Kumagai, Vice Mayor Present Jean Josey, Councilmember Present Sherry Hu, Councilmember Present Michael McCorriston, Councilmember Present Mayor Hernandez called for a moment of silence to honor the victims of San Jose VTA Rail Yard shooting on May 26, 2021: Abdolvahab Alaghmandan, Adrian Balleza, Alex Ward Fritch, Jose Dejesus Hernandez III, Lars Lane, Michael Rudometkin, Paul Delacruz Megia, Taptejdeep Singh, and Timothy Romo. Mayor Hernandez also recognized Sergeant Dominic Vaca with the San Bernardino County Sheriff’s Department, and a 44-year-old firefighter with the Los Angeles County Fire Department – Fire Station 81 in Agua Dulce, whose name had been withheld, that were both tragically killed in the line of duty. 2)Pledge of Allegiance 3)Oral Communications 3.1)Employee Introductions The City Council welcomed new City of Dublin Staff members, Jordan Foss, Management Analyst II with the Public Works Department, and Shalini Reddy, Senior Office Assistant with the Parks and Community Services Department. 28 DUBLIN CITY COUNCIL MINUTES REGULAR MEETING JUNE 1, 2021 3.2) Elder Abuse Awareness Month Proclamation The City Council presented the Elder Abuse Awareness Month proclamation to Deputy District Attorney, Cheryl Poncini, of the Alameda County District Attorney’s Office – Elder Protection Unit. 3.3)Public Comment No public comment was provided. 4)Consent Calendar Before reviewing the consent calendar, John Bakker, City Attorney, made a statement regarding Item 4.14 noting that the Brown Act requires the City to provide a verbal summary of a recommendation for an action on a local agency executive’s salary or compensation. Item 4.14 is the committee’s recommendation to approve an amendment to the City’s agreement with the City Manager. The basic terms of the proposed recommendation include increasing the City Manager’s base salary to $25,415 per month, increasing the management leave allowance by two days, increasing the City’s annual contribution to the City Manager’s deferred compensation plan by $1000, and making a $10,000 pay- for-performance payment. 4.1)Approved the May 18, 2021 Special City Council Meeting and Regular City Council Meeting Minutes. 4.3)Adopted Resolution No. 52-21 titled, “Adopting an Appropriation Limit for Fiscal Year 2021-22 of $419,772,690.” 4.4)Adopted Resolution No. 53-21 titled, “Approving an Agreement with Lynx Technology, Inc. for Geographic Information Systems Consulting Services.” 4.5)Approved the following proclamations for the month of June in the City of Dublin: National Flag Day and National Flag Week, African American Music Appreciation Month, National Caribbean American Heritage Month, National Great Outdoors Month, National Homeownership Month, National Ocean Month, Juneteenth, and National Gun Violence Awareness Day and Month. 4.2)Adopted Resolution No. 51-21 titled, “Approving a List of Projects Funded in Fiscal Year 2021-22 by Senate Bill 1, the Road Repair and Accountability Act of 2017.” 29 DUBLIN CITY COUNCIL MINUTES REGULAR MEETING JUNE 1, 2021 4.6)Adopted Resolution No. 54-21 titled, “Approving an Agreement with Cascadia Consulting Group, Inc. for Senate Bill 1383 Implementation Assistance;” Resolution No. 55-21 titled, “Approving an Agreement with HF&H Consultants, LLC for Solid Waste Franchise Agreement Amendment and Senate Bill 1383 Implementation;” and Resolution No. 56-21 titled, “Approving an Agreement with Surf to Snow Environmental Resource Management, Inc. for Stormwater Inspections and Illicit Discharge Response Services.” 4.7)Adopted Resolution No. 57-21 titled, “Approving an Agreement with the County of Alameda for Additional Library Services for Fiscal Year 2021-22.” 4.8)Adopted Resolution No. 58-21 titled, “Approving Consulting Services Agreements for On-Call Contract Planning, Housing, and Building Services.” 4.9)Adopted Resolution No. 59-21 titled, “Approving Kaiser Road as a Private Street.” 4.10)Adopted Resolution No. 60-21 titled, “Approving a Storm Drainage Maintenance Agreement Between the City of Dublin and Dublin Crossing, LLC.” 4.11)Adopted Resolution No. 61-21 titled, “Approving a Contractor Services Agreement with Sierra Display, Inc. for Banner Services.” 4.12)Waived the second reading and adopted Ordinance No. 04-21 titled, “Amending Article IV (Abatement of Vicious Dogs) of Section 5.36 (Animal Control) of the Dublin Municipal Code Regarding Potentially Dangerous and Vicious Dogs.” 4.13)Confirmed the Mayor’s appointment of James Morehead to serve as City of Dublin Poet Laureate for a term beginning July 1, 2021 and ending December 31, 2022. 4.14)Approved and authorized the Mayor to execute the First Amendment to City Manager’s Employment Agreement and authorize the payment of $10,000 as Pay-For-Performance for the City Manager’s performance during 2020. 4.15)Adopted Resolution No. 62-21 titled, “Approving Funding Recommendations for the Fiscal Year 2021-22 Human Services Grant Program.” Councilmember Josey pulled item 4.15 for further discussion. 30 DUBLIN CITY COUNCIL MINUTES REGULAR MEETING JUNE 1, 2021 By motion of Councilmember Josey, seconded by Vice Mayor Kumagai, and by unanimous vote, the Council adopted the full Consent Calendar with a revision to Resolution No. 62-21 titled, “Approving Funding Recommendations for the Fiscal Year 2021-22 Human Services Grant Program,” to remove references of the General Fund and Affordable Housing Fund allocations from the Resolution and table the discussion on those allocations to a future meeting. By motion of Councilmember Josey, seconded by Vice Mayor Kumagai, and by unanimous vote, the City Council Adopted Resolution No. 65-21 titled, “Adopting a Budget for the City of Dublin for Fiscal Year 2021-22;” Resolution No. 66-21 titled, “Establishing a Salary Plan for Full-Time Personnel in Accordance with the Personnel Rules;” and Resolution No. 67-21 titled, “Establishing a Salary Plan for Management Positions Exempt from Competitive Service.” RESULT:ADOPTED [UNANIMOUS] MOVED BY:Jean Josey, Councilmember SECOND:Shawn Kumagai, Vice Mayor AYES:Hernandez, McCorriston, Hu, Kumagai, Josey 7)Unfinished Business 32 DUBLIN CITY COUNCIL MINUTES REGULAR MEETING JUNE 1, 2021 7.1)Participation in the California Statewide Communities Development Authority Middle-Income Rental Housing Program and Policy Direction on Loss of Property Tax Revenue Due to Creation of Middle-Income Housing City Attorney, John Bakker, recused himself from this item and left the Council Chamber due to his continued work with California Statewide Communities Development Authority (CSCDA) on community improvement authority projects. He informed the City Council that his colleague, Jon Goetz, will represent the City on this item. The City Council received the presentation and asked clarifying questions. Edgard Martinez provided public comment. Ronna Bailey-Kroll provided public comment. Maribeth Wilson provided public comment. Dharminder Ghuman provided public comment. By consensus, the City Council directed the City Manager to cap the total lost property tax revenue from Middle-Income Rental Program projects at $1 million. By motion of Councilmember Hu, seconded by Councilmember McCorriston, and by unanimous vote, the City Council Adopted Resolution No. 68-21 titled, “Approving, Authorizing, and Directing Execution of a Joint Exercise of Powers Agreement Relating to the CSCDA Community Improvement Authority, and the Form of a Public Benefit Agreement; and Approving the Issuance of Revenue Bonds by the Authority for the Purpose of Financing the Acquisition of the Waterford Place Apartments.” RESULT:ADOPTED [UNANIMOUS] MOVED BY:Sherry Hu, Councilmember SECOND:Michael McCorriston, Councilmember AYES:Hernandez, McCorriston, Hu, Kumagai, Josey 7.2) Mayor Hernandez called for a five-minute break at 9:45 p.m. Mayor Hernandez called the meeting to order at 9:53 p.m. SCS Property Community Outreach 33 DUBLIN CITY COUNCIL MINUTES REGULAR MEETING JUNE 1, 2021 Councilmember Hu recused herself from this item due to her residence being within 500 feet of the SCS property, and therefore considered to be involved in the decision. The City Council received a presentation on the SCS Property community outreach process and background information including initial understanding of opportunities, constraints, and desired objectives, and provided input. Shirley Lewandowski provided public comment. Councilmember Hu returned to the dais. 8)New Business 8.1)Energy Efficiency and Infrastructure Improvement Projects The City Council received a presentation summarizing the recommended Energy Efficiency and Infrastructure Improvement Projects resulting from the Investment Grade Audit conducted by Willdan Energy Solutions and by consensus directed Staff to return with more information on project implementation and proposed funding. 9)Other Business The City Council and Staff provided brief information only reports, including committee reports and reports by City Council related to meetings attended at City expense (AB1234). By consensus, the City Council directed Staff to return with an update on the Human Rights Campaign Municipal Equality Index at a future meeting, and to bring back a presentation providing an overview of the Draft Bay Area 2050 strategies. 10)Adjournment Mayor Hernandez adjourned the meeting in memory of the lives lost in the VTA Rail Yard shooting, for Sergeant Dominic Vaca with the San Bernardino County Sheriff’s Department, and the 44-year-old unnamed firefighter with the Los Angeles County Fire Department – Fire Station 81 in Agua Dulce at 11:44 p.m. 34 DUBLIN CITY COUNCIL MINUTES REGULAR MEETING JUNE 1, 2021 Mayor ATTEST: City Clerk 35
