Informational Report: Status of Update to Dublin Municipal Code,
Standard Agreements and Standard Conditions of Approval

DESCRIPTION:
At its March 22, 2006 Goals and Objectives meeting, the City Council reviewed and approved with high
priority the proposed comprehensive update to the Dublin Municipal Code (DMC). In addition, the City's
standard agreements, standard forms, and standard conditions of approval are also to be reviewed as part
of the comprehensive update. This informational report provides the Council with the status of the
comprehensive update.
Update to Dublin Municipal Code
In consultation with Staff, the City Attorney's Office has developed a schedule for the review of particular
chapters of the DMC, to be presented to the Council in groups of two or three chapters per Council
meeting.
We began reviewing various provisions of the DMC in 2006. The first group of proposed ordinances is
on the Council agenda tonight: (1) proposed amendments to DMC Chapter 4.16 relating to peddlers and
solicitors, (2) the addition ofDMC Chapter 4.18 relating to charitable solicitation, and (3) the proposed
amendments to DMC Section 1.04.030 relating to penalties for violation of the DMC. In addition, the
City Attorney is finalizing proposed amendments to DMC Chapter 5.12 relating to parades and events to
be presented to Council at the February 20 or March 6 meeting.
Furthermore, the City Attorney's Office has been working with Staff to develop proposed amendments to
DMC Chapter 2.46 relating to contracts and purchasing; DMC Chapter 2.38 relating to the sale of surplus
real property; DMC Chapter 2.40 relating to unclaimed property; and DMC Title 9 relating to
subdivisions.

In addition, the following Chapters of the DMC will be reviewed during the first half of2007: 5.100
relating to parks and recreation facilities, 5.104 relating to newsracks, 3.16 relating to transient occupancy
tax, 4.04 relating to business registration, and 4.20 relating to massage establishments and massage
servIces.
As the update continues, the City Attorney's Office will continue to schedule chapters of the DMC for
Council review, until all relevant chapters have been updated. This is not expected to occur until the end
of calendar year 2008.
Finally, the comprehensive update to the DMC includes an update of the Dublin Zoning Ordinance (Title
8 of the DMC). The City Attorney's Office and Planning Staffhave developed a preliminary schedule for
the review of the Zoning Ordinance, which provides that the Zoning Ordinance will be presented to the
Planning Commission and City Council in three groups of about 10 to 14 chapters at a time, in order to
preserve consistency between internal references amongst the chapters. The City Attorney's Office and
City Staff are concurrently working on the update to the DMC and Zoning Ordinance.
Update to Standard Agreements
As part of the comprehensive update, the City Attorney's Office is currently reviewing the City's standard
agreements, including: 1) the City's standard consulting services agreement; 2) the City's standard
agreement and related documents for construction projects; and 3) the City's standard application for
development projects. The City Attorney's Office anticipates its review of the consulting services
agreement will be completed by March. The City Attorney's Office is currently working with Public
Works to review the agreement and related documents used for construction projects, such as the Dublin
Boulevard/Dougherty Road project. The City Attorney's Office anticipates that its review of the
application for development projects will be completed by late February or early March.
Update to Standard Conditions of A?proval
Finally, the City Attorney's Office has collected the standard conditions imposed on development projects
within the City by the following City departments: Planning, Building, Parks and Recreation, Fire, and
Police. The City Attorney's Office anticipates its review of the standard conditions to be completed by
March, at which time the City Attorney and City Manager will work with the various departments to
develop a system to ensure the standard conditions are properly utilized.
RECOMMENDATION
Staff recommends that the City Council receive this report.
