Waive reading and INTRODUCE the Ordinance to Create
the Dublin Ranch East Side Storm Drain Benefit District.
There will be no cost to the City for operation of the District. The
Dublin Ranch developer has financed and constructed the storm
drain facilities and will be partially reimbursed for the costs of
construction by other property owners in the District who benefit
from the facilities through the reimbursement charges collected by
the City pursuant to the proposed ordinance. The City will retain
1 % of the charges to cover its costs of administering the District.

DESCRIPTION: The proposed Dublin Ranch East Side Storm Drain Benefit District
consists of approximately 1,120 acres, of which 420 acres are located within the eastern portion of Dublin
Ranch (Attachment 2). The remaining 700 acres within the City limits to the immediate east are in the
area commonly referred to as the East Dublin Property Owners area, which contains 11 parcels
(Attachment 3). The land in the District drains to a major storm drain line along the north side ofI-580
that is referred to as the G3 Line in the Master Drainage Plan of the Alameda County Flood Control and
Water Conservation District Zone 7.
The Dublin Ranch developer, the Lin Family, has constructed the drainage facilities for the G3 line as part
of the improvements for Dublin Ranch. The G3 line drainage facilities have been designed and sized to
accommodate, in addition to the Dublin Ranch East Side properties, the increased drainage from the
proposed development of the 700 acres of the East Dublin Properties. The total cost for the G3 line
drainage facilities is $4,565,927. This amount is based on the actual construction cost, with markups for
design, surveying, construction administration and City-related processing costs. This cost does not
include value of the right-of-way for the line, nor does it include the amount reimbursed to the Lin Family
by Alameda County Zone 7.
The Dublin Ranch East Side Storm Drain Benefit District is to be established as a means to reimburse the
Lin Family for constructing the G3 line improvements with additional capacity that benefits East Dublin
Properties owners. Based on developable land area, 37.5% ($1,712,223) of the cost has been allocated to
Dublin Ranch and 62.5% ($2,853,704) has been allocated to the East Dublin Properties. The East Dublin
Properties' share has been allocated to the eleven properties based on an estimate of the impervious
surface associated with the land uses approved for each property with the East Dublin Stage 1 Zoning.
The Engineer's Report presents:
1) A description of the G3 line storm drainage facilities that were constructed to accommodate
development within the District.
2) A summary of the construction costs.
3) A description ofthe methodology used for allocating the cost to the benefit received.
4) The dollar-value of the benefits assigned to each parcel within the Benefit District.
Upon issuance of a building permit for a development project or before a final map or parcel map is
approved for recordation that contains the final lots/parcels that will be used for residential development
on a Benefited Property, the City will collect all charges due, including a 1 % administrative fee. The
monies will be remitted to the Lin Family in accordance with a reimbursement agreement with the Lin
Family.
The public hearing notice for this hearing was mailed to all of the properties within the district, and a
notice of the establishment of the District will be recorded against each property in the District.
Staff recommends that the City Council 1) open the public hearing, 2) receive Staff presentation, 3)
receive public testimony, 4) close public hearing, 5) deliberate, and 6) waive the reading and

CREATING THE DUBLIN RANCH EAST SIDE STORM DRAIN BENEFIT DISTRICT,
A LOCAL BENEFIT DISTRICT TO LEVY AND COLLECT CHARGES, AS A
CONDITION OF DEVELOPMENT, TO REIMBURSE DEVELOPERS WHO
CONSTRUCT AND INSTALL DRAINAGE FACILITIES THAT
BENEFIT PROPERTIES OTHER THAN THEIR OWN
FINDINGS
A. Large portions of eastern Dublin are presently being developed, have approved
development plans, or are likely to be developed in the near future. Pursuant to Municipal Code
Section 9.16.110 and Government Code Section 66485, the City has required the Dublin Ranch
developer to construct and dedicate to the City stormwater drainage facilities that will benefit
property outside their Dublin Ranch development, primarily by containing sufficient capacity
to convey stormwater drained from adjacent properties. This Ordinance is adopted as partial
implementation of the Eastern Dublin Specific Plan, including particularly Sections 11.3.2. and
Policies 10.2, 10.3, 10.5, 10.6, and 10.8.
B. On April 3, 2007, the City Council held a properly noticed public hearing at
which it considered the adoption of a local drainage plan that would define the necessary storm
drain facilities for a portion of eastern Dublin (the "Dublin Ranch East Side Storm Drain Benefit
District" or "Benefit District") and the obligation of each benefiting property within that area for
drainage. That obligation would be payment of a charge equal to the dollar-value of the benefit
to each property of the facilities constructed by the Financing Party. Such charges would be
calculated based on a formula described in the plan and used to reimburse the Financing Party.
C. At that public hearing, the Council received an Engineer's Report, prepared by
MacKay & Somps, dated March 16, 2007, and attached as Exhibit A (hereafter the "Engineer's
Report"), that describes the public drainage facilities that have been constructed in eastern
Dublin to serve the Benefit District (hereafter the "Improvements").
D. The Dublin Ranch East Storm Drain Benefit District benefiting properties consists
of the territory and property depicted on the Map in Figure I ofthe Engineer's Report.
F. The Engineer's Report further sets forth the costs of constructing the
Improvements and the portion of the costs attributable to each property in the Benefit District,
based on the methodology set forth therein.
G. The City Council hereby finds that the development of property in the Benefit
District identified in the Engineer's Report would require construction of the Improvements, and

the charges imposed on properties by this ordinance are fairly apportioned within the area on the
basis of the benefits conferred and costs incurred.
H. Therefore, the City Council further finds, pursuant to Dublin Municipal Code
section 9.16.110, that the charges imposed by this ordinance and the benefit district created by
this ordinance are reasonably related to the costs of the Improvements and the properties
benefited by the Improvements.
THE DUBLIN CITY COUNCIL DOES ORDAIN AS FOLLOWS:
SECTION 1: PURPOSE. The purpose of this ordinance is to create a local benefit district,
pursuant to California Government Code Section 66487, to provide for the levy and collection of
charges as a condition of approving the development of properties within the Benefit District that
will necessitate, and benefit from, the construction of storm drain improvements. The owner,
developer, or other person holding an interest in property in the Benefit District shall be required
to pay the City charges equal to their share (according to the benefit analysis) of the actual cost of
constructed improvements. Charges for already-constructed improvements shall be an amount
equal to the proportional benefit to the benefited property of improvements constructed with
supplemental capacity that will benefit or be used by the benefited property.
SECTION 2: DEFINITIONS. For the purpose ofthis ordinance, the following words and
phrases shall have the following meanings:
"Benefit District" means the Dublin Ranch East Side Storm Drain Benefit District, which
includes the area described in Recital D of this ordinance.
"Benefited Property" means a property within the Benefit District which receives benefit from
the construction of an Improvement.
"Financing Party" means a property owner, developer, or governmental entity that is required to
install Improvements which benefit properties within the Benefit District.
"Improvement" is defined in Recital C of this ordinance.
"Land Use Entitlement" may include any of the following: a permit or approval granted by the
City for the development of property, a conditional use permit, final subdivision map, a tentative
subdivision map, a development agreement, a grading permit, and a site design review approval.
SECTION 3: ADOPTION OF LOCAL DRAINAGE PLAN. Pursuant to Government Code
Section 66483, the City Council hereby adopts the Engineer's Report as the local drainage plan
for the Benefit District.

SECTION 4: CREATION OF LOCAL BENEFIT DISTRICT. Pursuant to its authority under
Government Code Section 66487, the City Council hereby creates the Dublin Ranch East Side
Storm Drain Benefit District, a local benefit district consisting of the benefited properties labeled
Parcels 1 through 11 as shown in Figure 4 of the Engineer's Report.. identified by their Assessor
Parcel Numbers listed in Figure 6 ofthe Engineer's Report, and those remaining portions of the
Benefit District referred to in the Engineer's Report as the Dublin Ranch Drainage Shed.
SECTION 5 : OBLIGATIONS IMPOSED. Upon the approval of a Land Use Entitlement for
any Benefited Property in the District, the owner, developer, or other person with an interest in
such property shall be required, as a condition of approving the Land Use Entitlement, to pay
the applicable benefit charges for the property, as set forth in Figure 6 of the Engineer's Report.
Payment for a Benefited Property within the Benefit Area shall be required at the time the City
approves any final or parcel map on that property or at the time the City issues a building permit
on that property, whichever is earlier. The charges listed in Figure 6 of the Engineer's Report
shall be increased automatically at the beginning of each fiscal year by the rate of return that the
City earns from its Local Agency Investment Fund (LAIF).
SECTION 6: USE OF CREDITS. With respect to facilities necessary to provide drainage to a
Benefits Property that have already been constructed, are under construction, or are a condition of
developing another property, no charge shall be levied on a Benefited Property if the Financing
Party for those facilities has indicated in writing to the City that a credit should be granted to the
owner of the Benefited Property. In that event, the total reimbursable owed to the Financing
Party for facilities construction shall be reduced by an amount equal to such credit.
SECTION 7: USE OF CHARGE REVENUE. Charges collected from owners of Benefited
Properties shall be used to reimburse Financing Parties pursuant to a reimbursement agreement
approved by the City Manager in accordance with Section 9.
SECTION 8: RECORDATION. The City Manager is authorized and directed to record in
Official Records of Alameda County a Notice of Establishment of Benefit District in
substantially the form of Exhibit B identifying properties included in the Benefit District with
an appropriate map in order that owners of Benefited Properties shall be on notice regarding the
benefits and obligations of the Benefit District.
SECTION 9: REIMBURSEMENT AGREEMENTS. The City Manager is herby authorized to
enter into reimbursement agreement with Financing Parties consistent with the terms of this
Ordinance, Government Code Section 66485 et seq., and the adopted Engineer's Report.
SECTION 10: EFFECTIVE DATE AND POSTING. This Ordinance shall take effect and be in
force thirty (30) days from and after the date of its passage. The City Clerk ofthe City of Dublin
shall cause this Ordinance to be posted in at least three (3) public places in the City of Dublin in
accordance with Section 36933 of the Government Code of the State of California

I Summaryl
A portion of the constructed master storm drain system for Dublin Ranch "The Improvements" provides
supplemental capacity necessary for the development of other properties that lie to the east of Dublin
Ranch. An "Area of Benefit" (AOB) is therefore established to identify properties benefiting from the
construction of The Improvements. Upon the formation of this District, properties outside of Dublin Ranch
which benefit from The Improvements are required to reimburse the Dublin Ranch Developer (The Lin
Family), who has constructed The Improvements, for a share of the "Total Improvement Costs".
The general location of the Area of Benefit is shown on Figure 1. The AOB boundary encompasses the
drainage shed currently within the City of Dublin City Limits that contributes runoff conveyed by The
Improvements. The drainage shed boundaries were identified as part of the City approved Dublin Ranch
Drainage Master Plan.
The construction cost of The Improvements together with the following items, shall be considered the Total
Improvement Cost:

The Improvements are considered a single element of infrastructure. That portion of the Total
Improvement Cost that is assigned to each of the major drainage sheds within the AOB (the Dublin Ranch
and East Dublin Properties drainage sheds) is based on each shed's Developable Acreage in relation to the
total Developable Acreage (residential, mixed use, commercial, business and industrial land uses) within
the AOB.
The AOB boundary (and the major drainage sheds within it) as well as the location of The Improvements
are shown on Figure 2.
The developer of Dublin Ranch has paid for the construction of The Improvements and does not require an
allocation of the Dublin Ranch portion of the Total Improvement Costs to individual properties within
Dublin Ranch. Cost allocation within the East Properties Drainage Shed is based on an assigned value of
percent of impervious surface coverage associated with each anticipated land use.

Description of Work
The Improvements include approximately 1500 lineal feet of a double 12'x9' concrete
box culvert, 730 lineal feet of a double 10'x9' concrete box culvert, 1800 feet of a 14'x9'
concrete box culvert, and 110 lineal feet of a 8'x9' concrete box culvert. The
Improvements also include access manholes, access ramps, transition structures and other
appurtenances.
The cost of Rights of Way are not included in The Improvements.

Methodology
The methodology for defining benefit and assigning that portion of the Total
Improvement Cost to each benefiting parcel is done in the following steps:
1) Identify the developable land area ("Developable Acreage") within the AOB.
2) Distribute a portion of the Total Improvement Cost to each major drainage shed
based on Developable Acreage.
3) Identify individual properties within the East Properties Drainage Shed which is
to reimburse a portion of the Total Improvement Costs and the Developable
Acreage for each land use within each parcel.
4) Distribute the portion of the Total Improvement Cost to each individual property
within the East Properties Drainage Shed based on the amount of impervious
surface related to the land use plan for the property.
(1) Developable Acreage Within A.O.B.
The boundary for the "Area of Benefit" (AOB) represents the entire drainage shed that
lies within the City of Dublin and contributes to the runoff conveyed by The
Improvements. The single exception to this is the 1.3:1:: acre Maynard property which lies
on the east side of Fallon Road between Croak Road and the westbound Highway 580 off
ramp. Development potential of this property is currently uncertain.
The boundary is divided into two major drainage sheds (The Dublin Ranch Shed and the
East Properties Shed), The AOB boundary and the major drainage sheds within it are
shown on the attached Figure 2.
"Developable Acreage" is defined as identified residential, mixed use, commercial,
business or industrial land uses. Schools, parks, agricultural, rural residential,
public/semi-public and open space land use designations are not included in Developable
Acreage.

Developable Acreage within Dublin Ranch is identified in the Dublin Ranch Master
Drainage Plan. This Master Plan is used to define the Developable Acreage within the
Dublin Ranch Shed, Tables showing Developable Acreage within Dublin Ranch are
included as Figure 7 of this report. The Dublin Ranch Master Drainage Plan also
estimated land uses within the East Properties Shed. However, more recent land use
entitlements provide a better definition of the anticipated land uses for these properties.
The Phase One Planned Development Zoning designations for the land within the East
Properties Shed is used to define the Developable Acreage within this shed, These Land
Uses are shown on Figure 3.
The Developable Acreage within the AOB and a breakdown ofthe Developable Acreage
in each drainage shed is as follows:

(2) Distribute Cost to Major Drainage Sheds
Based on the data presented in (1) above and the Summary of Costs (Exhibit C), the Total
Improvement Cost is allocated to each drainage Shed based on its Developable Acreage
as compared to the Total Developable Acreage within the AOB as follows:
East Properties Shed:
$4,565,927 x 62.5% = $2,853,704
Dublin Ranch Shed:
$4565,927 x 37.5% = $1.712,223
(3) Identify Individual Properties
Figure 3 (map) shows the Land Use Designations within the East Properties Shed. Figure
4 shows the individual properties within this Shed and Figure 5 presents the information
mapped in Figures 3 and 4 in tabular form. Because the Lin family paid for the
construction of the Improvements and does not require an allocation of the Dublin Ranch
portion of the Total Improvement Costs to individual properties within Dublin Ranch the
individual properties in the Dublin Ranch Shed are not identified in Figures 4 and 5.

(4) Cost Distribution
Figure 5 also presents the percent impervious area assigned to each land uses (based on
generally accepted engineering values and observations ofland development that has
already occurred in East Dublin) and that portion ofthe total impervious area contained
within each individual property. The percent impervious factors are chosen to reflect the
fact that more intense development of the land will result in more impervious surfaces,
roofs, roads and hardscape) which generates more storm drainage runoff to be conveyed
through The Improvements resulting in more benefit from The Improvements. The
percent impervious factors chosen are as follows:

Figure 6 assigns a portion of the Total Improvement Cost attributable to the East
Properties Shed to each parcel with this shed based on its impervious surface as
compared to the total impervious surface for the East Properties Drainage Shed, Because
the Lin family paid for the construction of The Improvements and does not require
reimbursement from current or future owners within the Dublin Ranch Shed for the costs
attributable to those properties, (due to its previous ownership of those parcels), Figure 6
does not assign costs to each parcel in the Dublin Ranch Shed.

Dublin Ranch East Side Storm Drain Benefit District
Notice is hereby given as follows:
1. Existence of Benefit District.
On , the City Council ofthe City of Dublin adopted Ordinance No.
establishing the Dublin Ranch East Side Storm Drain Benefit District ("Benefit District")
pursuant to Government Code Section 66487. Copies ofthe Ordinance can be obtained
from the Public Works Department, City of Dublin, 100 Civic Plaza, Dublin CA
(925/833-6630).
2. Area of Benefit.
Parcels within the Area of Benefit ("Benefited Properties") listed as Parcels 1 through 11
of Exhibit A attached, will be required by City to pay their pro rata share of the cost of
certain public storm drain improvements benefiting those parcels all as set forth more
particularly in the Engineer's Report.
3. Time of Collection.
Reimbursement to the financing party is required upon issuance of a building permit for a
development project or before a final map or parcel map is approved for recordation that
contains the final lots/parcels that will be used for residential development on a Benefited
Property.
4. Inquiry.
Any inquiry regarding the Benefit District shall be directed to City Engineer, City of
Dublin, 100 Civic Plaza, Dublin CA 94568; Phone 925/ 833-6630.
