Report Prepared by: Melissa Morton, Public Works Dir~ ATTACHMENTS: 1) 2) Resolution Location Map RECOMMENDATION-l FINANCIAL STATEMENT: V'. f'JiAdOPt the Resolution accepting the improvements associated with Tract 7597 Braddock and Logan Group III, L. P., has provided a Maintenance Bond in the amount of $93,000.00 (Bond No. 2171474M) to replace the Performance and Labor and Materials Bonds that guaranteed the improvements. The Maintenance Bond will guarantee against defects for one year. The Starward homeowners will maintain the interior private streets and landscaping. Once these improvements have been accepted, the City will incur street light maintenance costs on Starward Drive. DESCRIPTION: Braddock and Logan Group III, L. P., recently completed site improvements associated with Tract 7597, Starward Row. Tract 7597 is a residential development of 10 single-family detached homes located on Starward Drive just north Amador Valley Boulevard. The improvements consist of sidewalk, street lights and landscaping along Starward Drive. The work is governed by an improvement agreement executed on May 16, 2006 via City Council Resolution No. 59-06. The developer and the contractor have now completed the work governed by the agreement. Since the improvements have been constructed pursuant to the improvement agreement and to the satisfaction of the Public Works Director, it is appropriate for the public improvements to now be accepted by the City for permanent maintenance. P., executed the improvement agreement for site improvements, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of $372,000.00, for improvements to guarantee performance of the work. Now that the work is complete, the bonds may be released in accordance with the authority contained in ~66499.7 of the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $93,000.00, which is 25% of the original Performance Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements for Parcel Map 7597. WHEREAS, the developer of Tract 7597, filed June 27, 2006, in Book 291 for Parcel Maps at Pages 45-46, previously entered into an Improvement Agreement with the City of Dublin to improve said Parcel in accordance with plans and specifications on file with the Public Works Director, said Parcel identified as follows: a) Subdivider: b) Parcel Location: c) Parcel Size: d) Resolution Approving Agreement: e) City Streets Affected: Braddock and Logan Group III, L. Starward Drive 10 Single Family Lots No. 59-06, City of Dublin City Council None WHEREAS, the Street Improvements associated with Tract 7597 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that guaranteed the Improvements can be released, in accordance with the authority contained in ~66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by Insurance Company of the West (Bond No. 2171474) for improvements in the amount of by $372,000.00 be released; and 3. The original Labor and Materials Bond issued by Insurance Company of the West (Bond No. 2171474) for improvements in the amount of by $372,000.00 be released; and 4.
