DESCRIPTION: In 2003-2004 the City Council rated the goal: "to refurbish exhihlt
space wlthm the Murray Schoolhouse" as a high pnonty At the meeting or April 4, 2006 the City Council
approved the hl(l for the Duhlln Heritage Center Exhihlt Restoration projeet and awarded the project to Rosa
Constmction. The work for thc projcct includcs construction of thc exhibit backdrops in the interior of the
Murray Schoolhousc as wcll as related lighting, electrical, and interior pamtmg.
At this timc thc Contractor has completed the project on time and withm the onginal bld pnce With no
change orders. Staff IS requestmg that Council accept all final improvemcnts to allow thc facility to be
opened and operational for the City of Dublin. A maintenance bond in the amount of $11,055 to
guarantee against defects will be provided to the City The City currently has an $110,548 Performance
Bond to be relinquished when the mamtenance bond 15 received.
RECOMMENDATION
Staff recommends the followmg actIOns:
I Authorize Staff to accept a maintenance bond in the amount of$II,055 at a future date; and
2. Adopt resolution to accept thc final improvements for Contract No. 06-03

A RESOLllTlON OF THE CITY COUNCIl,
OF THE CITV OF DUBLIN

ACCEPTING IMPROVEMENTS TO THE DUBLIN HERITAGE CENTER
EXHIBIT RESTORATION PROJF.CT .. CONTRACT 06-03
WHEREAS, Rosa Constructum entered mto a contract with the City of Dublin to complete the
1I1lprovements of Duhlln Hentage C"nl<;r Exhibit Rcstoration in accordance wIth plans and specIficatIOns
on file with the City Engincer; and
WHEREAS, said Improvements have heen completed in accordance with said plans and
speclficahons, and any approved modilieations thereof, to the satisfaction of said City Rngmeer of the
City of Dublin; and
WHEREAS, as a condition of said contract, Rosa Construction is required to guarantee the
improvements for a penod of one year following aee"1)!ance of the work by the said City of Dublin; and
WHEREAS, as improvements are now completed, and the onglllal performance bond security
requirement can be reduced, m accordance wIth the authority contained in Section 66499 7 of the
Government Code of the State of California, to an amount found necessary to guarantee mamtenance of
the completcd work for the aforesaid one-year period.
NOW, THEREFORE BE IT RESOLVED thaI.
1 The 1ll1provements arc completed per plans and specifications; and
2. Upon approval and acceptance, the aforeSaid performance bond security requirement may be
reduced Irom the amonnt of $110,548 to the amount of $11,055 upon acceptance hy Staff of the
replacement maintenance bond as security for the aforesaId one-year maintenance period; and
3 Upon approval and acceptance, the said original performance bond in the anlount of $11 0,548
posted in connection with the work involved in the construcl1on of said Fa"il;ty he herehy
rclcased upon acceptance of said maintenance bond.
PASSED, APPROVED AND ADOPTED this 20th day of June 2006.
