RECOMMENDATION: FINANCIAL STATEMENT: As of 20lU the City will be responsible for maintenance of the improvements withm the City of Dublin consisting of two traffic monitoring cameras, transit priority devices and signal interconnect cable. rhe City will benefit from the planned installations of ad~anced traffic monitoring and control systems in Dublin, as part of the "Phase I" 1-580 HOV Lane Project. Staff time may be required to inspect construction of these systems withm Dubhn. The CMA will cover the filII cost of this project through multiple sources, including Federal, State and regional funds. This agreement represents a multi-jurisdictional approach to intelligent traffic solutions in the Tri-Valley area in a manner consIstent wIth the overall ohJective of the MQU for 1-580 lTS/TOS to work cooperatively toward improving the managemcnt and operations of the 1-5S0 comdor Imnlementation of "Phase I" HOV Lane Project The "Phase I" HOV Lane Project will lIlstall an 1I1terim High Occupancy Vehicle (BOV) lane on easthound 1-580 from Haelenda Drive to east of Grecnville Road. This project will provIde addillonal freeway capacity to handle traffic congestion on eastbound 1-5S0 dunng the evening commute pcriod and could potentially reduce cut-through traffic on Duhllll Boulevard. The interim HOV lane will be installed in the median area of 1-580 with thc undcrstauding that the right-of.way for a future BART extension in the 1-5S0 median will he preserved WIth the next phase of the lull HOV lanc improvements along 1.580 The CMA will cover the full cost of the "Phase 1" HOV Lane Project ($68 million) through multiple sources mcludlllg Federal, State and regional funds. Thc CMA and Caltrans are jomtly adllllmstenng the design and environmental asscssment of this project. DeSign completIOn and environmental ecrtification of the "Phase I" 1I0V Lane Project are expected to occur 111 summer 2006. The project will be Implemented III two separate phases: Phase 104: ThIS phase will consist of installing advanced traffic management and 1110Dltonng devices on 1-580 and adjaccnt local streets for the purpose of improvlllg management of traffic opcrations and incidents in this corridor dunng the construcllOn period of thc intcrim eastbound 1-580 HOV lane. These devices will includc traffic monitoring cameras on 1-5S0 and adjacent local streets, transit priority systems at signalized intersections, advanced vehIcle detection systems, changeable message signs, and highway adVISOry radIO stallons on 1-580 In Dublin, the Phasc IA project will, at no cost to the City, install tranic monitoring cameras at thc intersections of Dublin Boulevard/San Ramon Road and Duhlin BoulevardlTassajara Road, as well as signal interconnect cahle along Duhlin Boulevard. These cameras will he owned and (lperated exclusively hy the City The Phase IA project will be implemented at an estnnated C(lst of $8 million using the above funding sources. The CMA antiCipates startlllg constructIOn of this projcct in fall 2006 and completmg construclHln hy spnng 2007 Phase IB: This phase will consist ofthc actual installation of the intenm eastbound 1-580 HOV lane from Hacicnda Drivc to cast of Grcenville Road. Ihe Phase I B prOject IS expected to cost approxImately $611 million using the ahove fundlllg sources. The Cities of Livcnnore and Pleasanton have approved similar agreements with the CMA to cover project work within respective jurisdictJollS. Ibe proposed cooperative agreement specIfies that the CMA will be responsible for the full funding, design, construction and administration of the Phasc IA projcct. Staff Review of ProPosed Al!reement The City Attorney's Office Stafr has revIewed the proposed cuupcrative agreement and approved it for fornl. The CMA Board has delegated authority to the CMA Executive Dlrector to exeente the agreement. CM A staff has requested that the City sign the agreement I1rst prior tu its full execution by the CMA. Recommendation Staffrecommcnds that thc City Council adopt the Resolution approving the proposed 1-580 HOV TMP & ITS/TOS Cooperative Agreement for Design, Construction and Admmistration, and authorize the City Manager to execute the agreement. Pagc30f3 RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* APPROVING 1-580 HOV TRANSPORTATION MANAGEMENT nAN AND INTELLIGENT TRANSPORTATION SYSTEMrrRAFFIC OPERATIONS SYSTEM (TMP & ITSrrOS) COOPERATIVE AGREEMENT FOR DESIGN, CONSTRUCTION AND ADMINISTRATION WIIEREAS, the 1-580 Smart Comdor system enables thc Cities of Dublin, Livermore and Pleasanton to monitor local traffic flows and manage traffic incidents in a coordmated manner in the Tri- Vallcy area; and WHEREAS, on February 21, 2006, the City Council adopted Resolution 20-06 approving a Memorandum of Understanding (MOU) for 1-580 Intelligent Transportation System Management/Traffic Operabons System (ITS/TOS) with Alameda County, Caltrans, Livermore-Amador Valley Transit Authority (LAVTA), Alamcda County Congestion Management Agency (CMA), the Bay Area Metropolitan Transportation Commission (MTC), and the Cil1es of Livennore and Plcasanton, in order to improve traffic flow along highly congested corridors in Alameda County including 1-80, I~580 and 1-880; and WHEREAS, adoption of Resolution 20-06 also included approvmg the Project Charter for "Phase I" 1-580 High Occupancy Vehicle (HOV) Lane Project conceming the design components of the interim HOV lane on eastbound 1-580 from HacIenda Dnve to east of Greenville Road, rcpresenting a multi- Junsdlcl10nal approach to intelligent traffic solutions in the Tri-Valley area in a manner consistent with the overall objective of the MOU for 1-580 lTSITOS to work cooperatively toward improvlllg the management and operations ofthe 1-580 corridor; and WHEREAS, the interim HOV lane will be installed in the median area of 1-580 with the understanding that the right-of-way for a future BART extension in the 1-580 median will be preserved with the next phase of the full HOV lane improvements along 1-580; and WHEREAS, the "Phase I" HOV Lane Project will be implemented in two scparatc phascs, Phase 1 A and Phase I B; and WHEREAS, the CMA will cover the full cost of the "Phase 1" HOV Lane Project through multiple sources includmg Federal, State and regional funds; and WHEREAS, Phasc lA will consist of installing advanced traffic management and momtoring devices on 1-580 and adjacent local streets for the purpose of improving management of traffic operations and incidents in this corridor during the construction period of the mterim eastbound 1-580 HOV lane; and WHEREAS, construction of the Phase I A project is expected to start in fall 2006 and end by spring 2007, and I ATTACIDIENT J. WHEREAS, Phase I B will consist of the actual installation of the interim eastbound 1-580 HOV lane from Hacienda Drive to east of Greenville Road; and WHEREAS, construction of the Phasc IB project is expected to start in summer 2007 and end hy 2009; and WHEREAS, the CMA desires to enter mto a Cooperativc Agreement with other participating agencies to define implementatiOn responsihilities for the Phase IA project wifhlll each jurisdiction, including project desIgn, construction and administration; and WHEREAS, the proposed 1-580 ROV Transportahon Management Plan and Intelligent Transportation SystemlTraffic Operations System (TMP & ITS/TOS) Cooperative Agreement for Design, Construction and Administration specifies that the CMA will be responsible for fhe full funding, design, construchon and administration ofthc Phase lA project; and WHEREAS, under fhe said Cooperative Agreement, the City of Dublin will facilitate design review and construction ofthe Phase IA project, including timely issuance of all necessary encroachment permits and timely City lIlspection of improvements within Dublin, as requested by fhe CMA. RECITALS A. CMA and CITY, in cooperation with other agencies, citics and county, and the State of California, Department of Iransportation ("Caltrans") contemplate the lIlstallation and implementation of SMART Corridor components including a Traffic Operations Systems (TOS) and Intelligent Transportation Systems (lIS) Projcct ("PROJECT") within the 1-580 Conidor; and C CMA and CITY dcsirc to spceify thc tcrms and conditions under which the PROJECT is to bc advcrtised, bid, administercd, constructed, and implemented. Plans and speclficahons mvolvmg such work have bcen reviewed and approved by signature of CITY's Rngllleer, or designated rcprcscntative; b. All required permits are issued by CITY authonzmg such work within CITY's jurisdiction or rights-of-way 3 CITY shall issue all aforcsaid permits to CMA, or its designated contractors, agents, and representahves, at no cost, through CITY's Department of Public Works, or other appropnate departments. The CMA's pcnnit applieation(s) will be accompamed hy five (5) sets of constnlctwn plans, five (5) sets of specifications, proof of insurance, and proof that payment and performance surety honds covering constmction of PROJECT have been issued to CMA's contractor(s). Followlllg CITY's Issuancc of such pemlits CMA reserves the right to make changes to the constructIOn plans and specifications, in consultation with CITY, provided that such revIsIons do not materially increase the scope of work or substantially change the nature of the work to be perfonned under thc pcrmits. 4 Receipt by CMA of the necessary approvals and pennits shall constitute CMA's authorization from CITY to proceed wIth work to he pcrfonned by CMA or its designatcd contractors, agents, and representalives under thIS Agreement within the CITY's JurisdiChon or rights-of-way, or which affects thc CITY's facilities. Except as providcd by law, CMA may advertise for bids to procure PROJECT components or construct the PROJECT prior to the Issuance of any applicable permits, but shall not commcncc eonstmction until after the issuance of applicable pennits by CITY CMA may administer thc procurement of the PROJECT components in onc, or multJple phases, and jointly, or scparatcly from the construction ofthe PROJECT Ii Tn the construction of said work, CMA will furnish a designated representativc to pcrform the functIOns of a Resldent Engineer, and CITY may, at no cost to CMA, furll1sh a representative, ifit so desires, to ensure confornlance of work to CITY's standards. 7 Prior to award of the construction contract for PROJECT, CITY may tcrminate this Agrecmcnt by prior written notice, provided that CITY pays CMA lor all PROJECT related costs incurred by CMA resulting from CITY's participation in this Agreement pnor to tennmation. 8. If any facility installed, used or mamtamed by a pnvate or public utility conflicts with the PROJECT eonstmetion, or violates a CITY's encroachment policy, CITY shall require, or work in coopcration with, the owner( s) of such faci h t Y to protcet, rcloeate or remove such facilities in accordance with the CITY's policies and proeedurcs for such facilities located within the limits ofthc CITY's jurisdiction. CMA will mitiate and coordinate all contacts wIth utilities rcgarding such relocations but will not be responsible for any cost assocIated wIth the required protcetion, relocation or removal. Any relocated or new facilities shall be Idenh fled on the Record Drawings to be prepared under thIS Agreement. 9 Nothing in thc provisions of this Agreement IS IIltended to crcatc duties or obligations to or rights in third parties, or affect the legal habihly of either party to the Agreement by imposing any standard of care with respect to the Improvcmcnt or maintenance of State highways greater than the standard of care Imposed by law. 10. Ncithcr CITY, nor its officers and employees, shall be responsible for any damage or liahility occurring by any act or omission by CMA under or III connection with any work, authority or JUrisdictIOn delegated to CMA under this Agreement. It IS understood and agreed that, pursuant to Government Code SectIOn 895 4, CMA shall fully defend, indemnify and save harmless the CITY, and its officers and employees from all claims, suits or actions of every name, kind and descnptHln brought lor or on account of injury (as dcfincd in Government Code Section 810.8) occumng hy reason of any act or omission by CMA under or in cOlUlection with any work, authority or jurisdiction delegated to CMA under this Agreement. All contractors selected by CMA to perfonn construchon of the PROJECT shall include CITY as an additional insurcd on all insurance policies related to the perfonnanee of work on the PROJECT within the CITY's jurisdiction or rights~of-"'ay 14. CITY herehy grants CMA and its authorizcd contractors, agents and representahves the non-exclusive right to enter upon CITY's jurisdiction and rights-of-way, subject to the terms and conditions of thIs Agreement and applicahle pcnnits, for the purpose of performing CMA's obligations under thiS Agreement. OF THE CITY OF DUBLIN * * . * * . - * * APPROVING MEMORANDUM OF UNDERSTANDING FOR 1-580 INTELLIGENT TRANSPORTATION SYSTEM MANAGEMENTffRAFFIC OPERATIONS SYSTEM (lTSrroS) AND PROJECT CHARTER FOR "PHASE I" 1-580 HOV LANE PROJECT WHEREAS, the 1-580 Smart Corridor system enables the Cities of Dublin, Livermore and Pleasanton to monitor local traffic flows and manage traffic incidents in a coordinated manner in the Tri- Valley area, and WHEREAS, it is proposed to participate in a Memorandum of Understanding with Alameda County, Caltrans, Livennore-Amador Valley Transit Authority (LA VT A), Alameda County Congestion Management Agency (CMA), the Metropolitan Transportation Commission (MfC), and the Cities of Livennore and Pleasanton., in order to improve traffic operations along highly traveled corridors, including 1-580; and WHEREAS, the City also desires to enter into a multi-jurisdictional agreement in the fonn of a Project Charter for the "Phase 1" 1-580 High Occupancy Vehicle (HOY) Lane Project in order to establish an agreement regarding the design components of the "Phase I" 1-580 ROV Lane Project among the CMA, Caltrans, Alameda County, LA VT A, and the Cities of Dublin, Livermore and Pleasanton; and WHEREAS, the "Phase I" ROV Lane Project is consistent with the above referenced MOU to work cooperatively toward improving the management and operations of the 1~580 corridor; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the Memorandum of Understanding for 1-580 Intelligent Transportation System ManagementlTraffic Operations System (ITS/TOS), and the Project Charter for "Phase }" 1-580 ROV Lane Project.
