DESCRIPTION: Assessment District 99-1 funds the electric energy, maintenance, and repair costs associated with the decorative street lighting within all of the Dublin Ranch development (excepting the golf course) and also m Tract 7067, which is thc Clifden Parc development offMountam Rise Place in the western hills. This Assessment District was formed in 1999 at the request of the developers in Dublin Ranch. The Clifden Parc development was annexed in 2000, and Dublin Ranch Areas A and G were aImexed in 2001 The remaming portions of Dublin Ranch, including Areas H, C, F aIld H, were annexed ]n Deeemher of2005 and are therefore a part ofthis District for the 2006-2007 assessment. The City began mallltammg some of the lights in Dublin Ranch Phase I, and also in Clifden Pare, during the 2001-2002 Fiscal Year It is expeetcd that the City will be maintaining approximately 1,194 lights by the end of Fiscal Year 2006-2007 For Fiscal Year 2006-2007, no change is recommended with respect to the method of determining the assessments. The assessment for a single-family residence is proposed to be $36.80, which is an inercase of $15.70 per individual lot over the 2005-2006 assessment. ThIS amount is within the maximum assessment allowed by the initial Engineer's Report for the District, and is necded to fund increases m power aIld maintenance costs, as well as increases in inventory For the first several years 0 f operation, thIS District did not incur a significant maintenaI1Ce cost; however, as these lights age, the number of repairs is increasing. As noted in the Preliminary Engineer's Report, a portion of the reserve is being set aside each year for future pole pamting costs. The poles are expected to need repainting on a ten-year cycle, which means that the I1rst poles may need painting in the next few years. Aside from the reserve specifically eannarked for pole painting, the reserve in this District has become extremely low The reserve is allowed by law to he approximately 50% of the annual maintenance cost, and it is recommended that an e/Tort be madc to keep the reserve at that level in order to have funds available for emergencies. For a street lighting distnct, such an emergency could be a major underground electric line break or a series of pole or fixture failures. Staff is therefore recommending a significant rate increase for Fiscal Year 2006-2007 in ordcr to bring the reserve baek up to a comfortable level. In future years, it may be possiblc to reduce the rate somewhat ifno extraordinary expenditures occur. The ongmal Engmeer's Report for this District prepared in 1999 provided for a maxImum assessment of $34.22 per parcel, which could be increased annually based on the Consumer Price Index (CPI), as well as actual increases in the cost of utihl1es. The Engineer's Report includes a chart which details the CPT and utility inereas"s for each successive year The April 2006 CPI rate of mer ease for San Francisco Bay Area Urban Wage Earners was 2.8%. The maximum assessment has therefore been adjusted by 2.8% to $41.54 Staff recommends that the City Council conduct a public heanng, deliberate, and adopt the resolution approving the Engineer's Report, confirming the diagram and assessment, and ordering levy of assessment. J 7, ..... . 1 """'. - As required by said Act, a diagram is hereto attached showing the exterior boundaries of said landscape maintenance assessment district and also the lines and dimensions of each lot or parcel of land within said street lighting maintenance assessment district as the same existed at the time of the passage of said resolution, each of which lots or parcels having been given a separate number upon said diagram. I do hereby assess the net amount to be assessed upon aU assessable lots or parcels of land within said street lighting maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the acqUIsition and maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment is made upon the several lots or parcels ofland within said street lighting maintenance assessment district in proportion to the estimated benefits to be received by said lots or parcels respectively from the acquisItion and maintenance of said improvements. The diagram and assessment numbers appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property The scope of work includes the maintenance, operation, repair and replacement of aU public street lighting facilities located within the public streets and within public easements within private streets within the District Boundaries, as shown on the approved improvement plans for the following Tracts: 7067, 6925, 6956 through 6964, 7136 through 7142, and 7324 through 7327 and, including, but not limited to, the lighting poles, fixtures, conduits, conductors, service boxes, controllers, and appurtenances, and the furnishing of power, together with aU incidental expenses for the maintenance, operation, and repair of the street lighting system. Dublin Ranch Areas B, C, F, and H were annexed to the Dublin Ranch Street Lighting Maintenance Assessment District 99-1 in December of 2005 Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year 2006-2007 and includes all of such parcels excepting those portions thereof within existing public roads or rights of way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County This District has been established to pay for maintenance, operation and repair of the street light fixtures, which differ from the City Standard. Therefore, the Assessment has been equally apportioned over the proposed 3,801 planned single-family residential lots contained within the District. The per lot assessment will be $36 80 per lot for Fiscal Year 2006~2007, increasing to $41.54 (subject to inflation and utility rate increases) at build-out for all residential lots within the boundaries of the District on a per lot basis. Commercial property shall be assessed at 5.5 times the rate for residential lots times the acreage of the lot. Common areas and public land within the District have been exempted and will have a zero assessment since they receive no special benefit with regard to the special light fixtures. Until they are subdivided, the assessment for these lots shall be equal to the per-lot or per-unit assessment each year, times the number of proposed lots within each Tract. With the recording of the future Tract maps, the new assessments will be reapportioned to each of the individual residential lots. As more street lights are installed each year, until all have been installed, the assessment each year will be based on the estimated cost of maintenance (using the then current numbers in Section 2), divided by the number oflights to be installed that year, provided in no event will the per lot assessment be more than $41.54 (as adjusted for inflation). It should be noted that future annexations to this District may affect the spread of assessments. In addition to the increase in the annual maintenance cost as a result of additional lights, the annual maintenance cost shall be increased annually beginning July 1, 2000, by the percentage increase in the Bay Area Urban Wage Earner Consumer Price Index ("Index") (applies to all costs except electricity), plus any actual increase in the cost of electricity If the Bay Area Urban Wage Earner Consumer Price Index is unavailable or doomed by the City Council to be inappropriate, a comparable consumer price index, as approved by the City Council, shall be used to replace the Bay Area Urban Wage Earner Price Index.
