FINANCIAL STATEMENT:
Toll CA II, L.P. (Toll Brothers, Inc.), has provided a Maintenance
Bond in the amount of $329,266.00 (Bond No.104564079) to
replace the Performance and Labor and Materials Bonds that
guaranteed the improvements. The Maintenance Bond will
guarantee against defects for one year. Once these improvements
have been accepted, the City will incur maintenance and street
sweeping costs for the City-maintained street improvements. Street
light maintenance costs will be paid by the Street Lighting
Maintenance Assessment District 99-1.
DESCRIPTION: Toll CA II, LP recently completed street improvements associated
with Tract 7139, Dublin Ranch Area A, Neighborhood A-4, a subdivision located in the Eastern Dublin
Specific Plan area east of Signal Hill Drive, north of Tract 7140, and west of the Dublin Ranch Golf
Course. Improvements also included construction of Signal Hill Drive from the existing Golf Course
Recreation building to East Sugar Hill Terrace. The work was governed by two separate Tract
Improvement Agreements: 1) for street improvements executed on May 6, 2003, via City Council
Resolution No. 72-03, and 2) landscaping for Tracts 7137, 7138, 7139 and 7140, Neighborhoods A-2,
A-3, A-4 and A5, executed on May 6, 2003, via City Council Resolution No. 75-03.

The developer has completed the work governed by both of these agreements. Since the street
improvements have been constructed pursuant to the Tract Improvement Agreement and to the
satisfaction of the Public Works Director, it is appropriate for these improvements to now be accepted by
the City for permanent maintenance. The remaining work covered by the landscape agreement is being
accepted under a separate item on this agenda.
The following regulatory traffic control devices will be accepted and approved as part of this project and
added to the City of Dublin Traffic Code:
A. Stop control devices have been installed on the westerly approach of Lochgreen Way at Signal
Hill Drive, on the westerly approach of East Cog Hill Terrace at Signal Hill Drive, on the
easterly approach of Highland Meadows Court at Saddle Creek Terrace, on all three
approaches of the intersection of Signal Hill Drive and East Sugar Hill Terrace, and on all
three approaches of the intersection of Bent Tree Drive and East Sugar Hill Terrace (Traffic
Code Section 6.16.020).
At the time the City and Toll CA II, L.P., executed the Tract Improvement Agreement for the street,
grading and utility improvements, the developer provided a Performance Bond and a Labor and Materials
Bond each in the amount of $770,340.00 for off-site street improvements, and Performance Bond and a
Labor and Materials Bond, each in the amount of $546,722.00, for on-site tract improvements for a total
amount of $1,317,062.00 to guarantee performance of the work. Now that the work is complete, these
bonds may be released in accordance with the authority contained in S66499.7 of the Government Code,
and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year
period following acceptance. The developer has provided a Maintenance Bond in the amount of
$329,266.00, which is 25% of the original Performance Bond, and which is sufficient to guarantee the
improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the street improvements for Tract
7139, Dublin Ranch Area A, Neighborhood A-4, and approving the regulatory traffic control devices.

ACCEPTANCE OF IMPROVEMENTS FOR
TRACT 7139 (DUBLIN RANCH AREA A, NEIGHBORHOOD A-4)
AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the subdivider of Tract 7139, filed on July 11, 2003, in Book 271 of Maps at Pages
35 - 39, previously entered into two Tract Improvement Agreements with the City of Dublin to improve
said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract
identified as follows:

Saddle Creek Terrace, and Signal Hill Drive
WHEREAS, the Street Improvements associated with Tract 7139 are complete in accordance with
said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public
Works Director; and
WHEREAS, the Landscaping Improvements governed by the remaining Tract Improvement
Agreement are also complete and will be accepted separately; and
WHEREAS, the developer has installed certain regulatory traffic control devices as part of the
Tract improvements; and
WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that
guaranteed the Street Improvements can be released, in accordance with the authority contained in
S66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to
guarantee the completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed on Signal Hill Drive, Bent Tree Drive, East Cog Hill Terrace
and within said Tract are hereby approved and accepted subject to a one-year guarantee
period; and
2. The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code, said regulatory devices to include the following:

of America (Bond No. 103964595) in the amount of$770,340.00 be released; and
5. The original Performance Bond issued by Travelers Casualty and Surety Company of
America (Bond No. 103964587) in the amount of$546,722.00 be released; and
6. The original Labor and Material Bond issued by Travelers Casualty and Surety Company
of America (Bond No. 103964587) in the amount of $546,722.00 be released; and
7. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of
America in the amount of$329,265.50 (Bond No. 104564070) be accepted as security for
the aforesaid one-year maintenance period, said period to commence on this date and
terminate on the 19th day of September, 2007.
