FINANCIAL STATEMENT: Proposed site improvements in the Amendment are estimated at $105,000 at the sole cost of the Developer. This will reduce the City's overall cost of the park. DESCRIPTION: At its meeting of May 16, 2006 the City Council approved an Agreement with Sorrento at Dublin Ranch I L.P., a California limited partnership (Developer) regarding the proposed Neighborhood Square in Sorrento at Dublin Ranch. The Agreement included rough grading and erosion control among other elements for the site as further detailed in Attachment 2. The Developer desires to complete some additional improvements in advance of City construction of the park site in order to enhance the marketability of the model homes surrounding the site. In addition to rough grading and erosion control, the Developer will amend the soil with fertilizers and compost, install underground utility sleeves, install sidewalks along north and south side of site, complete the oval-shaped concrete pathway and complete the entry plaza adjacent to the recreation facility. These improvements will be per the preferred conceptual design for the Neighborhood Square as approved by the City Council on July 18, 2006. By completing this work, the Developer will benefit from an improved park-like appearance of the site while the model homes begin to open around the site in November 2006. Attachment 1 is a Resolution approving the Amendment to the Agreement between the City of Dublin and Dublin Ranch I L. P. The Amendment, which outlines the scope and schedule of the work, is shown as an attachment to the Resolution. The proposed Amendment to the Agreement allows the Developer until April 1, 2007 to complete the work in case of weather or unforeseen delays. Concurrently, Staff is working with its Landscape Architect Keller Mitchell and Company to complete the construction documents for the Square. Staff anticipates that the project will be out to bid by February 2007 and the City's construction will begin in April 2007. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution approving the Amendment to Agreement and authorize Mayor to execute Amendment. ~ C/' d.. b \ r:c,rz.. RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* APPROVING FIRST AMENDMENT TO AGREEMENT REGARDING PROPOSED NEIGHBORHOOD SQUARE IN SORRENTO AT DUBLIN RANCH WHEREAS, the City of Dublin (hereinafter referred to as "CITY") and Sorrento at Dublin Ranch I, LP, a California Limited Partnership owned by wholly-owned subsidiaries of Toll Brothers, Inc., (hereinafter referred to as "Developer") entered into an Agreement on May 16, 2006; and WHEREAS, the Developer and the City wish to amend the Agreement to include additional improvements for the Neighborhood Square in Sorrento at Dublin Ranch; and WHEREAS, as a condition of said Amendment, the Developer is required to warranty the improvements for a period of one year following acceptance of the work by the City; and NOW, THEREFORE BE IT RESOLVED that said Amendment regarding the proposed Neighborhood Square in Sorrento at Dublin Ranch, attached hereto as Exhibit "A", is hereby approved. BE IT FURTHER RESOLVED that the Mayor is hereby authorized by the City Council to execute the Amendment regarding the proposed Neighborhood Square in Sorrento at Dublin Ranch. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk ATTACHMENT 1 .g 14- , , -, - 0<.0 ~ \"2- FIRST AMENDMENT TO AGREEMENT REGARDING PROPOSED NEIGHBORHOOD SQUARE IN SORRENTO AT DUBLIN RANCH The City of Dublin, a municipal corporation ("City") and Sorrento at Dublin Ranch I L.P., a California limited partnership ("Developer") are parties to an agreement entitled Agreement Regardin~ Proposed Neighborhood Square in Sorrento at Dublin Ranch, dated May 16t ,2006 ("Agreement"). City and Developer hereby agree by this First Amendment to Agreement Regarding . Proposed Neighborhood Square in Sorrento at Dublin Ranch, dated Ootober I\Gve1il~e.v :1,2006, to amend said Agreement as set forth below. Section 1. Amendment to Section 3. Grading and Preparation of the Park Site Section 3.b, entitled Erosion Control Measures is amended by adding the following: "No later than October 20, 2006, the City shall provide the seed mix design for hydroseeding to Developer. Developer will hydroseed no later than November 15, 2006." Section 2. Amendment to Section 4. Schedule Section 4 is deleted and new Section 4 is added to read as follows: "The Developer agrees to complete all improvements in the Agreement, including the First Amendment, for the park site and provide the City with the Notice of Completion of Grading no later than April 1 ,2007. The City agrees to provide plans and specifications and a layout plan to the Developer not later than October 20th, 2006 for the walkway and plaza. The City shall accept the work at the time the park site is accepted, provided the work is done in accordance with this agreement." The City of Dublin will complete additional improvements to the park site during the spring and summer of 2007. The City of Dublin agrees to remove the temporary construction fencing by August 31, 2007 or after the site has been mowed three times whichever comes later. The first mowing will occur when the grass has reached 2.5 inches and will be mowed to 2.0 inches. Subsequent mowing intervals will occur once a week. Section 3. Amendment to Section 5. Section 5 is amended by adding the following at the end: "Notwithstanding the preceding sentence, the Developer will complete the sidewalk fronting the Neighborhood Square along Palmero Way and Capoterra Way as shown on Exhibit B. The sidewalk will be installed per City standard detail." Section 4. New Section 5.1 Neighborhood Square Site Improvements A new Section 5.1 is added to read as follows: A. The Developer agrees to provide soil fertilizers and amendments per October 10, 2006 Soil and Plant Laboratory Report shown on Exhibit D, no later than April 1, 2007. The City shall provide the organic compost amendment. B. The Developer agrees to incorporate the fertilizers, amendments and organic compost into the soil per City specifications, no later than April 1, 2007. C. The Developer agrees to install the concrete pathway as shown in Exhibit E and install utility sleeves underneath the pathway as directed by the City. Pathway and utility sleeves shall be installed per City specifications, no later than April 1, 2007. D. The Developer agrees to install the concrete entry plaza as shown in Exhibit E per City specifications, no later than April 1 ,2007. Section 5. Amendment to Section 8. Miscellaneous Section 8 is amended by adding the following: p. The City shall inspect the work for conformance with the plans and specifications. If the workmanship or material is found not to conform to the requirements of the plans and specifications the Developer must replace or correct the deficiency. q. The Developer shall guarantee all the Work for one year from the date the City accepts the Work. The Developer shall be responsible for completing repairs directly attributable to defective materials or workmanship. Following acceptance of the park site and improvements, the City will be responsible for any damage that occurs to the improvements by City employees, agents or contractors. r. The Developer will not receive any credits or reimbursements from the City of Dublin's Public Facility Fees for the work done under this Agreement. Developer shall defend City, its officers, employees and officials, against any claims or actions (including declaratory or injunctive relief) concerning Developer's construction of the work under this agreement on Developer's property_and shall indemnify and hold City harmless from any damages, charges, fees or penalties that may be awarded or imposed against City and/or Developer in connection with, or on account of, Developer's construction of work hereunder and/or City's failure to enforce or comply with any applicable laws. t. Developer will pay prevailing wages for any work done pursuant to this agreement. The possible use of used coffee grounds as a soil amendment was discussed and this couldbe utilized to partially satisfy the requirement for organic matter and some nutrients. This would not be suitable to use as the sole source of organic matter in any areas but could be blended into the BFI "Super Humus" compost which is intended for use. ANALYTICAL RESULTS Particle size data show a sandy clay loam classification by USDA standards. Combined silt plus clay at 53% is a bit high. Organic matter content very low and the addition of substantial organic matter will improve soil porosity and aeration in the plants root zone. The infiltration rate of this soil type is estimated at 0.29 inch per hour. Reaction is moderately alkaline and with lime content low this will easily adjust closer to neutral, .which will be suitable for most plants. Deep rooting trees should not include species particularly sensitive to alkalinity. Salinity, boron and sodium are safely low and the SAR value shows soluble sodium well balanced by calcium and magnesium. Nutrient availability data show deficiencies of nitrogen, potassium, copper, zinc, iron and sulfate. Only phosphorus, calcium and magnesium are well supplied with manganese fair. RECOMMENDATIONS The "Super Humus" compost will supply ample organic matter and sufficient nutrients to cover all of the deficiencies found but it will not satisfy the nitrogen requirement. Some pH adjustment is also required and this is the purpose of the soil sulfur. EXHIBIT D ~ Soil and Plant Laboratory, Inc. 2 I \',,- CITY OF DUBLIN October 6, 2006 Lab No. 06-275-0501 To improve drainage of the root zone any undisturbed or compacted areas should first be loosened to a 10-inch depth. The following materials should then be evenly spread and thoroughly incorporated with 6 inches ofthe soil: Amount /1000 Square Feet 6 cubic yards 30 pounds 15 pounds BFI "Super Humus" Alfalfa Mealor Pellets Soil Sulfur Surface soil that has been amended in the above manner may be used as the top foot of backfill around the sides of the rootball of trees and shrubs. Deeper backfill required around the sides of the rootball of 24-inch box or larger material should not contain the extra organic matter or sulfur but should be blended with 1-112 pounds iron sulfate per cubic yard. Apply the iron sulfate cautiously avoiding contact with moist concrete since staining can result. Soil immediately below the rootball should be left undisturbed to provide support but the bottom around the sides should be cultivated to improve porosity. The above program is designed to depend only on organic sources and as requested an alternate program for maintaining nitrogen is offered. In place of the alfalfa meal slow release Sulfur Coated Urea (42-0-0) could be broadcast as a topdress as soon as planting is complete.
