FINANCIAL STATEMENT: None.
.PROJECT DESCRIPTION:
The project consists of proposed amendments to Chapter 8.76 of the Dublin Zoning Ordinance as it
pertains to the regulation of off-street, recreational vehicle (R V) parking on residential lots. The proposed
amendments would create greater flexibility with respect to the size of a RV parked in the area between
the driveway and nearest side lot line and establish a Conditional Use Permit process by which residents
can ask for deviations to the size of a RV parked in this area as well as deviations wm the permitted
locations for off-street R V parking.

At the February 15, 2005 City Council meeting Staff presented the proposed amendments to the City
Council. The amendments are summarized as follows:
For lots with a 20-foot or less front yard setback:
1. Extend the line that separates Area 5b and Area 3b (see Figure 1) to accommodate RV's up to 25-
feet in length.
2. When an RV parked in Area 5b extends into Area 3b a 6-foot fence would be required to
physically separate Area 5b from Area 3b.
3. Establish a maximum setback distance of 27-feet from the front property line for the required 6-
foot fence.

4. Allow for residents to apply for a Conditional Use Permit to allow an RV longer than 25-feet to be
parked in Area 5b.
5.· Require that 3 additional Conditional Use Permit findings be made prior to approving a request for
a Conditional Use Permit. These findings are: a) that the rear yard will be screened from view
from the public right-of-way; b) that the parking of the RV in the proposed location will have no ..
adverse impacts to adjacent properties' enjoyment of light and air; and, c) that the parking of the .,
RV in the proposed location will have no adverse impacts to persons in vehicles accessing or
exiting the subject and adjacent properties.
For lots with more than a 20- foot setback:
1. Allow for residents to apply for a Conditional Use Permit to allow an RV longer than Area 5b.
2. Require that 3 additional Conditional Use Permit findings (listed above) be made prior to
approving a request for a Conditional Use Permit.
For all lots, regardless of the setback:
1. Allow for alternate locations to be considered by the Zoning Administrator through the
Conditional Use Permit process if there is insufficient room in Area 5b to park an RV.

Following Staff's presentation and . after receiving public input, the Council waived the fIrst reading and
introduced an Ordinance amending Title 8 of the Dublin Municipal Code, Zoning Ordinance Chapter
8.76, O¡¡:'Street Parking and Loading Regulations as it pertains to the parking of recreational vehicles on
residential lots.
Environmental Review:
This project has been found to be Exempt from the California Environmental Quality Act (CEQA),
pursuant to Section 15061(b)(3). It can be seen with certainty that there is no possibility that the proposed
amendments may have an impact on the environment.
RECOMMENDATION:
Staff recommends that the City Council, open the Public Hearing; receive Staff presentation; receive Public .
testimony; close the Public Hearing; deliberate; and, waive the 2nd reading and adopt an Ordinance
(Attachment 1) amending Title 8 of the Dublin Municipal Code.

AN ORDINANCE OF THE CITY OF DUBLIN
AMENDING TITLE 8 OF THE DUBLIN MUNICIPAL CODE (ZONING ORDINANCE),
CHAPTER 8.76, OFF-STREET PARKING AND LOADING REGULATIONS RELATING TO
RECREATIONAL VEHICLE PARKING
WHEREAS, the City of Dublin has determined that in order to more effectively regulat~ the
parking and/or storage of recreational vehicles on a residentiallot that Chapter 8.76, O¡¡:'Street Parking
and Loading Regulations needs to be amended; and
WHEREAS, the California Environmental Quality Act (CEQA), together with the State
guidelines and City environmental r~gulations, require that certain projects be reviewed for environmental
impacts and that environmental documents be prepared; and
WHEREAS, the project has been found to be Exempt ITom the California Environmental Quality
Act (CEQA), according to Section 15061(b)(3) because it can be seen with certainty that there is no
possibility that the amendments to the DubJin Municipal Code (Zoning Ordinance) may have a significant
effect on the environment; and
WHEREAS, the Planning Commission did hold a prop~r1y noticed pubJic hearing on this project
on November 23, 2004, and did adopt Resolution 04-69 recommending that the City Council approve
amendments to the Dublin Municipal Code (Zoning Ordinance); and
e WHEREAS, a properly noticed public hearing was held by the City Council on February 15,
2005; and ...
WHEREAS, a Staff Report was submitted recommending that the City Council approve thc
amendments to the Dublin Municipal Code (Zoning Ordinance); and
WHEREAS, pursuant to section 8.120.050.B of the Dublin Municipal Code, the City Council
finds that the amendments to the Dublin Municipal Code (Zoning Ordinance) are consistent with the
Dublin General Plan and all applicable Specific Plans; and .
WHEREAS, the City Council did hear and use its independent judgment and consider all said
reports, recommendations, and testimony hereinabove set forth.
NOW, THEREFORE, the City Council of the City of Dublin does ordain as follows:

Subdivision E.4 of Section 8.76.060, Recreational Vehicle Parking in Residential Areas, of thc
Dublin Municipal Code (Zoning Ordinance) shall be modified to read as follows:

Section 2.
Subdivision E.7 of Section 8.76.060, Recreational Vehicle Parking in Residential Areas, of the
Dublin Municipal Code (Zoning Ordinance) is added to read as follows:
Parking in the Area between the Driveway and Nearest Side Lot Line (Area 5b). An RV
Darked within the Dawd area between the driveway and the nearest Side Lot Line (Area 5b) may
encroach into the Side Yard area (Area 3b) without having to be screened provided that the front
vard setback is 20-feet or less. the overall length of the vehicle does not exceed 25 feet, and a 6
foot fence setback a maximum of 27 feet from the front propertv line is provided to separate Area
5b from Area 3b (See Figure 76-0). The Zoning Administrator mav approve a Conditional Use
Permit to allow for an R V greater than 25 feet in length on lots with a front vard setback of 20- fect
or less or to allow for an RV longer than Area 5b for lots with a front vard setback of more than
20-feet (See Figure 76-01. provided that the rear yard wilJ be screened from view from the pub!i£
right ofwav and provided that the findings required bv Scction 8.76.060.E.4 and 8.100.060 can be
made.

Section 3.
Subdivision A.14.a.l of Section 8.76.070, Location of Required Parking Spaces, of the Dublin
Municipal Code (Zoning Ordinance) shall be modified to read as follows:
Principal residence. All parking spaces shall be located on the same parcel as the residence they
serve, unless provided as a Residential Parking Lot by the Zoning Administrator pursuant to a
Conditional Use Permit. The most distant parking space in a Residential Parking Lot shall be not

more than 150 feet from the residences they serve. Parking spaces required by this Chapter shall be
located within an enclosed garage, except that two, full-size, unenclosed parking spaces may be
permitted elsewhere on a lot pursuant to a Conditional Use Permit for the purposes of converting a
residential garage to living space (Rev. Ord. 4-03). Other than the two required garaged parking
spaces, a maximum oftwo vehicles (which shall include, but not be limited to, an automobile, car.
truck, or Recreational Vehicle) may be parked in the following areas if screened by a 6 foot high
fence or wall and if at least one side yard is unobstructed to a width of 36 inches: Areas 1, 2, 3a, 3b
and 4. Additional parking may occur in area Sa. Parking in area 5b shall be as required by Section
8.76.060.E.2 and 8.76.060.E.7. No parking shall occur in area 5c except as pennitted by Section
8.76.060.EA. See Figurc 76-2. Parking in a driveway shall not compensate for required enclosed
garage parking unless two, full-size unenclosed parking spaces are permitted pursuant to a
Conditional Use Permit for the purposes of converting a residential garage to living space (Rev.
Ord. 4-03). No parking shall occur in Area 6.
Section 4. Conformin!! Amendments.
Chaptcr 8.76 of the Dublin Municipal Code (Zoning Ordinance) shall be re-numbered and/or re-lettered as
necessary to accommodate and/or reflect the foregoing amendments.
Section 5. Severabilitv.
The provisions of this Ordinance are severable and if any provision, clause, sentence, word or part thercof
is held illcgal, invalid, unconstitutional, or inapplicable to any person or circumstanccs, such illegality,
invalidity, unconstitutionality. or inapplicability shall not affect or impair any of the remaining provisions,
clauses, sentences, sections, words or parts thereof of the Ordinance or their applicability to other persons
. or circumstances.
Section 6. Effective Date and Post!"!! of Ordinance.
This Ordinance shall take effect and be in force thirty (30) days from and after the date of its final
adoption. The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3)
public places in the City of Dublin in accordance with. Section 39633 of the Government Code of
California. "
