DESCRIPTION: The City Council has participated in discussions with Staff regarding the possible benefits offorming a Geologic Hazard Abatement District (GHAD)in the City. The purpose of such a Dis1rict is to prevent, mitigate, abate and con1rol geologic hazards in areas such as hillsides. Given recent events where slides have occurred as the result of adverse weather conditions in various hill areas of southern California, the City Council may wish to consider the formation of a GHAD at some point in the future. In order to conform with California State Law related to the future formation of a GHAD, it is necessary for the City to declare itself subject to provisions of the Law by adopting a resolution containing said declaration. A copy of the adopted resolution must then be forwarded to the State Controller in order to establish the City's eligibility to form a GHAD. Staff recommends that the City Council adopt the resolution declaring that the City of Dublin is subject to the provisions of California Public Resources Code Division 17 relating to Geologic Hazard Abatement Dis1ricts, and direct Staff to forward the adopted resolution to the State Con1roller. - __w____~~____~.___________~_________________~~________--------- COPIES TO: G:\AGENMISC\agst GHAD State Laws 062105.doc 'UbI ITEMNO.~ Itrbt RESOLUTION NO. -05 . A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * ~ * * * * * * * * * * * * .* * * * * * DECLARING THAT THE CITY OF DUBLIN IS SUBJECT TO THE PROVISIONS OF CALIFORNIA PUBLIC RESOURCES CODE DIVISION 17 RELATING TO GEOLOGIC HAZARD ABATEMENT DISTRICTS WHEREAS, the City Council has discussed with City staff the useful role that Geologic Hazard Abatement Districts can in some cases perform in the prevention, mitigation, abatement and control of geologic hazards; and WHEREAS, the Geologic Hazard Abatement District Law is only applicable where the City has adopted a resolution declaration that the City of Dublin is subject to the Law's provisions and forwarded a copy of the resolution to the State Controller; and WHEREAS, the City Council may wish to consider formation of Geologic Hazard Abatement Districts in the future; NOW, THEREFORE, BE IT RESOLVED THAT: Section L Pursuant to PubJic Resources Code section 26550, the City Council of the City of . DubIin does hereby resolve and declare that it is subject to the provisions of California Public Resources Code Division 17, "Geologic Hazard Abatement Districts" as that Division may from time to time be amended. Section 2. A copy of this resolution shall be forwarded to the State Controller.
