PROJECT DESCRIPTION
The original City of Dublin Zorung Map was adopted in July 1983, soon after the City's incorporation.
The Map indicated specific zoning for all properties within the City boundary. Since the original Zoning
Map was approvcd in 1983, thcre havc been scvcral amendments, including the introduction of Planned
Development Zoning Districts, Specific Plan Area Rezonings, and the inclusion of properties annexed to
the City.
In September 1997, Dublin's Zoning Ordinance waS changed from the original Alameda County Zoning
Ordinancc, which had been in placc sincc thc City incorporated in 1982. The Ordinance revision included
renumbering chapters, defining terms, eliminating some zorung districts, and adding others. Additionally,
the revision induded updating the Ordinance to reflect current planning and zoning laws. The
accompanying Zoning Map was also updated, but not all of thc changes made to the Ordinance were
accurately and comprehensively reflected on the Map (Attachment 2).
At this time, Staff proposes a comprehensive Zoning Map Amendment to ensure the Zoning Map is
consistent with the General Plan and Zoning Ordinance and to furthcr ensure that the Zoning Map reflects
appropriate zoning designations for the entire City of Dublin. The proposed map utilizes current mapping

technology, which provides for a better graphic rcprescntation of property parcels and zoning districts
(Attachment 3).
ANAL YSIS
As part ofthe Zoning Map Update, there are four categories ofmodil1cations being proposed:
1. Modifications to provide consistency with General PJan Land Usc Map;
2. Modifications to correct mapping errors;
3. Modifications to provide consistency with the 1997 Zoning Ordinance Amendments; and
4. Modifications to reflect recently approvcd rczonings.
All ofthcsc catcgorics arc cXplaincd in more detail below.
1. Zoninl! Map Modifications to provide consistencv with General Plan Land Use Map
In accordance with State Law Seetion 65860, thc Zoning Ordinance must be consistent with the City's
General Plan. In the event that the Zoning Ordinance is inconsistent with thc Gcncral Plan, the ordinance
must be amended within a reasonable time. The City of Dublin adopted a General Plan in February 1985
and thc latcst updatc was complctcd in February 2005. Staff has reviewed the General Plan Land Usc Map
and has deternIÌned that one minor Zoning Map modification for a property adjacent to Interstate 580
should bc included in this updatc. Thc piccc of property, which is part of the Hexcel office complex, is
approximately one half-acre in size and is identified by Assessor Parcel Numbcr 941-1560-003-04. The
property is proposed to be rezoned from Agriculture (A) to M-I (Light Industrial) to correspond with the
existing Gcneral Plan land usc dcsignation, which is Business Park/Industrial, and the existing use, which
is a small part of the Hexcellaboratory/light industrial facility.
There remains one location in Dublin whcre thc General Plan land use designation and the Zoning
Ordinancc are inconsistcnt. There are three parcels of land, two owned by the City of Dublin and one
owned by the Dublin Historical Preservation Association, that are adjacent to the Dublin Heritage Center
on Donlon Way. One of the City parcels is part of the Pioneer Cemctcry, and the other two are vacant
properties_ These properties are all zoned Agriculture (A), but have a General Plan land use designation
of RctaillOfticc. In this casc, the zoning for the properties is accurate, but the General Plan should be
updated to reflect a land use designation ofParkslPublic Recreation. This change will be made the next
time the General Plan Land Use Map is updatcd.
As for the proposed Zoning Map Amendments, a Public Meeting Notice was sent to the property owner of
thc Hcxcel parcel, informing them of the proposed action to change the zoning from Agriculture (A) to M-
I (Light Industrial), inviting them to a public meeting, and notifying thcm of whom they could contact if
they had questions about the changes. No comments or qucstions were received.
2. Zoninl! Map Modifications to correct mappinl! errors
There are a 34 residentially~zoncd propcrtics in the hills of western Dublin along Silvergate Drive whcrc
thc linc separating two rcsidential zoning districts cuts through property lines. The two zoning districts
are both residential, one with a 7,000 square foot minimum lot size and one with a 10,000 square foot lot
sIze.
In order to clean up the Map and create two clear and distinct districts, Staff made a determination which
zoning district each lot in question belonged to. Several of the lots shifted from thc R-I (7,000) Zorung
District to the R-I (10,000) Zoning District. However, all of the lots proposed to change districts are at
Icast 10,000 squarc fcct in size already, so the proposed change will not impact the lots in any way. All of
the development standards will remain the same and the status of the lots will not be impacted.

A Public Mccting Notice was sent to tbe 34 propcrty owncrs of the affected residential parcels, informing
them of the proposed action, inviting them to a public meeting, and notifying thcm of whom they could
contact if they had questions about the changes. No commcnts or questions were received.
3. Zoninl! Man Modifications to provide consistencv with the 1997 Zoninl! Ordinance Amendments
The 1997 revision to the Zoning Ordinancc modified all conventional residential zoning districts by
eliminating thc suffixes tbe County used which were associated with each zoning district. The suffixes
arc no longcr uscd by the City to calculatc building site area or median lot width because the Ordinance
revision established a fixed number for calculating these requirements.
Although the Zoning Ordinance text was modificd, thc accompanying Zoning Map still contained the
suffixes. Also, several districts referenced on the Zoning Map werc eliminated from the Zoning
Ordinance as a result of the 1997 revision. For instance, R-S and H-I are no longer zoning districts within
thc City. Thc 1997 Zoning Ordinance update established new zoning districts, R-M to replacc thc R"S
zoning district, and C-2 to replace the H-I zoning district. The Developmcnt Standards remained the
same, but tbe label for the Zoning District changed. Today, thc Map still contains the extraneous districts,
which will bc corrcctcd with this update.
StafThas rcviewed the current Zoning Ordinancc and has determined that the following map modifications
would provide consistency between the Zoning Ordinance updated in 1997 and the Zoning Map:
I. Eliminate the Zoning Label ofH-1 and replace with C-I as stipulated in the 1997 Comprehensive
Zoning Ordinance Update;
2. Eliminate the Zoning Label R-S and replace with R-M as stipulated in the 1997 Comprehensive
Zoning Ordinance Update;
3. Eliminate Zoning Label suffixes BE (zoning overlay), MLW (minimum lot width) and MBSA
(minimum base site area) as stipulated in tbe 1997 Zoning Ordinance Update. These suffixes were
used by Alameda County to provide for additional requirements. In 1997 the Zoning Ordinance
Updatc modified the basic standards to incorporate these requirements as needed;
4. Include mirumum lot area as part of zoning label for single-family zones. For example, "R-I-B-E
10,000 MBSA" becomes R-I (10,000), which is consistent with Zoning Ordinance Update of
1997; and
5. Renamc multiplc family zoning designations to be consistent with Zoning Ordinancc Update of
1997. For example, "R-S-D-3 1,500 MBSA" bccomcs R-M (1,500).
4. Zoninl! Map Modifications to reflect reeentlv-approved rezoninl!s
Sincc the last Map updatc in 1997, numerous properties have been approved for rezoning. Many new
developments have been approved, and with it, their accompanying Planned Development has been
updated. Tbis Zoning Map update has ensured that all of the rczonings approved by the City Council over
the past several years are accurately rcflcctcd on the Map.
Utilizing current mapping technology
Current map-making mcthods are much more sophisticated than the methods used to create the City's
previous Zoning Maps. The original map, dated 1983, and current map, dated 1997, were either hand
drawn or used a graphics program called Auto CAD, both of which are prone to error. The proposed
Zoning Map Update (sec Attachment 3) was created with Geographic Information Systcms (GIS), an
electronic mapping system. GIS allows the City to utilize color to demonstrate the various zoning districts,
which assures that the zoning for each property is easily discemabJe, and it is geo-coded, which means the
Zoning Districts are accurately mapped to individual property boundaries. The updated Map is easier to
read, morc accurate, and is linked to the City's internal mapping system to ensure that zoning updates can
be immediately and precisely reflected on the Zoning Map,

PLANNING COMMISSION ACTION
The Planning Commission heard the proposed project at thcir mccting on August 23, 2005, At this meeting
thc public hcaring was held and the Conunissioners discussed the item. Onc mcmber of the publjç spoke
and asked a question about how the updated ;¡;oning would impact her residential property, It was explained
hy Staff that the only substantivc change on hcr particular parcel was the minimum lot sizc (from 7,000
square feet to 10,000 square feet), which could only impact her if the property was large enough to
subdivide, which none of the affected parceJs are,
The Plarming Commission closed the public hearing, delibcrated, and passed a motion to adopt Resolution
05-049 by a vote of 5-0 (Attachmcnt 4), rccommcnding that the City Council adopt an Ordinancc amcnding
the Zoning Map to reflect Zoning Ordinance Updates and Minor Map Modifications.
PUBLIC NOTICING
Although the changcs bcing made to the Zoning Map are not substantive, thc City notified all property
owners of affected properties to inform them of the modifications and notice was published in the
newspaper. Staff held an informational meeting on Tucsday August 9, 2005 at 6:00 p.m. to present the
updated Zoning Map and answcr any qucstions from the public. One member of thc public attended the
meeting to get clarification on the changes proposed, but no citizcns phoned with questions, Additionally,
a public hearing noticc was mailcd to thc same property owners and a notice was publishcd in the Valley
Times newspaper advertising the Plarming Commission hearing on August 23, 2005 as well as the City
Council hearing this evening.
ENVIRONMENTAL REVIEW
The update and proposed amendments to the Zoning Map relate to the display of information only and
will not cause physical changes to the environmcnt. The Map modifications are therefore a "non-project"
according to the California Environmental Quality Act (CEQA) Guidelines and are exempt ITom
environmental review.
RECOMMENDATION
Staff recommends that the City Council (I) Hcar Staff presentation, (2) Open the Public Hcaring, (3)
Close the public hearing and delibcrate, and (4) Waive Reading and introduce Ordinance (Attachment 1)
amending the Zoning Map to reflect Zoning Ordinance Updates and Minor Map Modifications.

MINOR MAP MODIFICATIONS

WHEREAS, thc original City of Dublin Zoning Map was adopted in July 1983, and has been
updated a number of times since that date; and
WHEREAS, since the original Zoning Map was approved in 1983, therc have been several
amendmcnts, including the introduction of Planned Dcvclopment Zoning Districts, Spccific Plan Area
Rezonings, and thc inclusion of properties annexed to tbe City; and
WHEREAS, in September 1997, DubJin's Zoning Ordinance was changed from the original
Alam.eda County Zoning Ordinance and the Ordinance revision included renumbering chapters, dcfining
terms, eliminating some zoning districts, and adding others; and
WHEREAS, although the accompanying Zoning Map was also updated, but not all of the changes
made to the Ordinance were accurately and comprehensively reflected on the Map; and
WHEREAS, Staff is proposing a comprehensive Zoning Map Amendment to insure thc Zoning
Map is consistent with the Gcneral Plan and Zoning Ordinance and to further insure that the Zoning Map
reflects appropriate zoning designations for the cntire City of Dublin; and
WHEREAS, as part ofthc Zoning Map Update, there are four categories of modifications bcing

WHEREAS, thc update and proposed amendments to the Zoning Map relate to the display of
illfonnation only and wiJl not causc physical changes to the environment. The Map modifications are
therefore a "non-project" according to the California Environmental QuaJity Act (CEQA) Guidelines and
are exempt from environmental review; and
WHEREAS, tile Plarming Commission did hold a public hearing on said application on August
23,2005; and
WHEREAS, proper notice of said public hearing was given in all respects as required by law; and
WHEREAS, a Staff Report was submitted recommending that the Planning Commission adopt a
Resolution recommending that the City Council adopt an Ordinancc amending the Zoning Map to reflect
Zoning Ordinance Updates and Minor Map Modifications; and

WHEREAS, the Planning Commission did hear and use independent judgment and considcrcd all
said reports, recommendations, and testimony hereinabovc sct forth and recommended approval of the
Zoning Map Amcndments to the City Council; and
WHEREAS, a Staff Report was submitted recommending that the City Council approve the
Ordinance Amcndment; and
WHEREAS, pursuant to section 8.120.050.B ofthe Duhlin Municipal Codc, thc City Council
finds that thc Ordinancc Amcndment is consistent with the Dublin General P1an; and
WHEREAS, the City Council did hear and usc its independent judgment and consider an said
reports, recommendations and testimony hereinabove set fortb.
NOW, THEREFORE, the City Council of the City of Duhlin does ordain as follows:
Section t. Zunin!! Map Amendments
Thc "City of Dublin Zoning Map" is hereby amended to replace the existing "City of Dublin
Zoning Map" with thc "City of Dublin Zoning Map" that was attached to the September 20,2005
City Council staff report as Attachmcnt 5. All previous versions of the "City of Dublin Zoning
Map" are hereby superceded.
Section 2. Severability
The provisions of this Ordinance are severable and if any provision, clausc, sentence, word or part
thercof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstances,
such i1legality, invalidity, unconstitutionality, or inapplicability shall not affect or impair any of
the remaining provisions, clauses, sentences, sections, words or parts thereof of the ordinance or
. their applicability to other persons or circumstances.
Section 3. Effective Date and Postinl! of Ordinance
This ordinance shall take effect and be in forcc thirty (30) days from and after the date of its final
adoption. The City Clerk of the City of Dublin shall cause this Ordinance to be postcd in at least
three (3) public places in thc City of Dublin in accordance with Section 39633 oftbe Govemmcnt
Code of California.

RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE AMENDING THE
ZONING MAP TO REFLECT ZONING ORDINANCE UPDATES AND
INOR MAP MODIFICATIONS

WHEREAS, the original City of Dublin Zoning Map was adopted in July 1983, and has
been updated a number oftimcs since that date; and
WHEREAS, sincc thc original Zoning Map was approved in 1983, there have been several
amendments, including the introduction of Planned Development Zoning Districts, Specific Plan Area
Rezonings, and the inclusion of properties annexcd to the City; and
WHEREAS, in September 1997, Dublin's Zoning Ordinance was changed from thc original
Alameda County Zoning Ordinance and the Ordinance revision included renumbering cbapters, dcfining
terms, eliminating some zoning districts, and adding others; and
WHEREAS, although thc accompanying Zoning Map was also updated, but not all of the changes
made to the Ordinance were accnrately and comprchcnsively reflected on tbe Map; and
WHEREAS, Staff is proposing a comprehensive Zoning Map Amcndment to insure the Zoning
Map is consistent with the General Plan and Zoning Ordinance and to fllrther insure that the Zoning Map
reflects appropriate zoning designations for tbe entire City of Dublin; and
WHEREAS, as part of the Zoning Map Update, tbere arc four categories of modifications being
proposcd:
I. Modifications to provide consistency with General Plan Land Usc Map
2. Modifications to correct mapping errors
3. Modifications to provide consistency with thc 1997 Zorung Ordinance Amendmcnts; and
4. Modifications to reflect recently-approved rezonings
WHEREAS, thc update and proposed amendments to thc Zoning Map relate to the display of
information only and will not cause physical changes to the environment. The Map modifications are
thereforc a "non-projcct" according to the California Environmental Quality Act (CEQA) Guidelines and
are exempt from environmcntal review; and
WHEREAS, the Planning Commission did hold a public hearing on said application on August 23,
2005; and
WHEREAS, proper noticc of said public hearing was given in an respccts as required by law; and
WHEREAS, a Staff Report was submitted recommcnding that the Planning 'Commission adopt a
Rcsolution recommending that the City Council adopt an Ordinance amending the Zoning Map to reflect
Zoning Ordinance Updates and Minor Map Modifications; and

WHEREAS, the Planning Commission did hear and use independent judgment and consi(fered all
said reports, recommendations, and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the City of
Dublin does hereby reconnnend that the City Council adopt an Ordinance amending the Zoning Map to
reflect Zoning Ordinance Updates and Minor Map Modifications.
