SUBJECT: Acceptance of Landscape Improvements Associated With Tract
7142, Dublin Ranch Area A, Neighborhood A-7 (Toll CA II, LP)

RECOMMENDATION: Adopt the Resolution accepting landscape improvements associated

FINANCIAL STATEMENT: Toll CA II, LP, has provided a Maintenance Bond in the amount of
$108,558.00 to replace the Performance Bond and Labor and
Materials Bond that assured the installation of required landscaping
improvements. Said Maintenange Bond will guarantee against
defects for one year. Maintenance of the landscaping on Bent Tree
Drive, Fallon Road and common areas will be performed by the
Dublin Ranch Golf Club Homeowner's Association.
DESCRIPTION: Toll CA II, LP, recently completed landscape improvements within
common areas on the east side of Bent Tree Drive and the north side of Fallon Road fronting Tract 7142,
Dublin Ranch Area A, Neighborhood A-7. This work was governed by a Tract Developer Agreement for
Landscaping dated July 17, 2001, per City Council Resolution No. 125-01. Off-site street improvement
work was accepted by City Council Resolution No. 223-03 on November 18, 2003. Since the landscape
improvements have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of
the Public Works Director, it is appropriate for the improvements to be accepted by the City, with
ongoing maintenance to be performed by the Dublin Ranch Golf Club Homeowner's Association.
At the time that the City and Toll executed the Tract Developer Agreement, the developer provided a
Performance Bond and a Labor and Materials Bond, each for $434,230.00, to guarantee performance of
the landscape work. Now that the work is complete, these bonds may be released in accordance with the
authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in an
amount necessary to guarantee the work for a one-year period following acceptance~ The developer has
provided a Maintenance Bond in the amount of $108,558.00, which is 25% of the original Performance
Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the landscape improvements for
Tract 7142 (Dublin Ranch Area A, Neighborhood A-7).

RESOLUTION NO. - 04
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF LANDSCAPE IMPROVEMENTS FOR
TRACT 7142 (DUBLIN RANCH AREA A, NEIGHBORHOOD A-7)
WHEREAS, the subdivider of Tract 7142, filed on August 21, 2001, in Book 261 of Maps at
Pages 5 - 10, preViously entered into two (2) Tract Developer Agreements with the City of Dublin, one for
Street Improvements and one for Landscaping, to improve said Tract in accordance with plans and
specifications on file with the Public Works Director, said Tract identified as follOws:
a) Subdivider: Toll CA II, L.P., A California Limited Partnership
b) Tract Location: North of Fallon Road, east of Bent Tree Drive, and
west of Old Fallon Road
c) Tract Size: 105 Single-Family Lots
d) Resolution Approving Agreement: No. 125-01, City of Dublin City Council
e) City Streets Affected: Bent Tree Drive and Fallon Road
WHEREAS, the Street Improvements associated with Tract 7142 as governed by one of the two
Tract Developer Agreements, were completed and accepted by the City Council via Resolution No.
223-03 on November 18, 2003; and
WHEREAS, the Landscaping Improvements along the east side of Bent Tree Drive and north side
of Fallon Road along the frontage of Tract 7142, and within the common areas, as governed by the one
remaining Tract Developer Agreement for Tract 7142, are complete in accordance with said plans and
specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director;
and
WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the
Landscape Improvements can be released, in accordance with the authority contained in §66499.7 of the
Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the
completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
The Landscape Improvements completed within said Tract are hereby approved and
accepted subject to a one-year guarantee period; and
2. The original Performance Bond issued by The Continental Insurance Company (Bond No.
929213820) in the amount of $434,230.00 be released; and
3. The original Labor and Material Bond issued by The Continental Insurance Company
(Bond No, 929213820) in the amount of $434,230.00 be released; and

4. The submitted Maintenance Bond issued by National Fire Insurance Company of Hartford
(Bond No. 929309397) in the amount of $108,558.00 be accepted as security for the
aforesaid one-year maintenance period, said period to commence on this date and terminate
on the 6th day of July, 2005.
