HomeMy WebLinkAboutReso 138-01 PM7537 ApprovedRESOLUTION NO. 138 - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING PARCEL MAP 7537 (ARCHSTONE COMMUNITIES TRUST, A MARYLAND REAL ESTATE INVESTMENT TRUST) WHEREAS, the Final Map for Parcel Map 7537, in the incorporated territory of the City of Dublin, State of California, has been presented to this City Council for approval, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the subdivider, Archstone Communities Trust, A Maryland Real Estate Investment Trust, has dedicated to the public on Parcel Map 7537 the fight-of-way required for the widening of Dougherty Road and Houston Place and the extension of Houston Place, along with a Public Services Easement (P.S.E.) and an Emergency Vehicle Access Easement (B.V.A.E.), all in accordance with the Vesting Tentative Parcel Map approved by the Community Development Director via Resolution 01-03; and WHEREAS, Archstone Communities Trust has executed and filed with the City of Dublin an Improvement Agreement to improve Dougherty Road, Houston Place, and required site improvements in accordance with the Conditions of Approval for the Vesting Tentative Parcel Map, and in accordance with the improvement plans and the specifications attached thereto; and WHEREAS, said Improvement Agreement is secured by a bond furnished by Travelers Casualty and Surety Company of America in the total amount of $2,297,625.00 (Bond No. 103601298), conditioned upon faithful performance of said Agreement; and WHEREAS, said Improvement Agreement is secured by a bond furnished by Travelers Casualty and Surety Company of America in the total amount of $2,297,625.00 (Bond No. 103601298), conditioned upon payment for labor performed or material fumished under the terms of said Agreement; NOW, THEREFORE, BE IT RESOLVED that said Improvement Agreement and bonds are hereby approved, and the Mayor is hereby authorized by the City Council to execute the Improvement Agreement. BE IT FURTHER RESOLVED that the Final Map of Parcel Map 7537 is hereby approved, and the rights to areas marked as Dougherty Road, Houston Place, and those strips of lands marked Public Service Easement (P.S.E.), and Emergency Vehicle Access Easement (E.V.A.E.) as offered for dedication to the public in conformity with the terms of dedication are hereby accepted, subject to improvement, and the Clerk of this City Council is hereby directed to transmit said Map to the County Recorder for filing. PASSED, APPROVED AND ADOPTED this 7th day of August, 2001.
