HomeMy WebLinkAboutItem 4.06 StormDrainDubRanch CITY CLERK File # D~[(21[{j-~ØJ AGENDA STATEMENT CITY COUNCIL MEETING DATE: September 7,2004 SUBJECT: Acceptance of Improvements for a Portion of Storm Drain Lines "c" and "D" in Dublin Ranch, Areas C and H Report Prepared by: Melissa Morton, Public Works Director ATTACHMENTS: 1) 2) Resolution accepting Improvements Location Map ¥ Adopt resolution accepting the improvements constructed by the Un Family and the Sierra Land Development Corporation for Storm Drain Lines "c" and "D" between Dublin Boulevard and the G3 Storm Drain Line box culvert RECOMMENDA TION: FINANCIAL STATEMENT: The developer has provided a Maintenance Bond in the amount of $313,750 to guarantee against any defects in the improvements for a one-year period. Upon acceptance, the City will incur maintenance costs for these storm drain improvements. DESCRIPTION: As part of the infrastructure for Dublin Ranch, the Sierra Land Development Corporation (The Lin Family) has constructed a 96" storm drain line (Line "C") from Dublin Boulevard at Keegan Street through Area H, connecting to the recently-completed G3 box culvert; and an 8'xlO' box culvert (Line "D") from Dublin Boulevard at Lockhart Street through Area C, also connecting to the G3 box culvert. These improvements were constructed in conformance with an Improvement Agreement entered into with the Lin Family on May 4, 2004. The improvements also include a section of 48" storm drain line in future Dublin Boulevard and a short section of a 60" storm drain line in future Central Parkway. The Lin Family provided a Performance Bond and a Labor and Materials Bond, each in the amount of $1,255,000, to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $313,750, which is sufficient to guarantee the improvements for a one-year period after acceptance. The developer has also provided the deeds for the right of way as required by the agreement. RESOLUTION NO. - 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS FOR STORM DRAIN LINE "C" AND "D" IN DUBLIN RANCH, AREAS C AND H WHEREAS, the Lin Family entered into an Improvement Agreement on May 4, 2004 with the City of Dublin to construct storm drain improvements in Dublin Ranch, Area "H", in accordance with the plans entitled, Dublin Ranch Area C & H-Phase 2 Grading and Storm Drain Lines C & D Improvements, prepared by MacKay & Somps, approved by the Director of Public Works on May 12, 2004, and consisting of 13 sheets; and WHEREAS, improvements associated with Storm Drain Lines "C" and "D" in Dublin Ranch . Areas C and H are complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the Director of Public Works; and WHEREAS, the Lin Family has executed Easement Grant Deeds to the City of Dublin for Storm Drain Lines "C" and "D"; and WHEREAS, the Performance Bond, and the Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; and WHEREAS, the Lin Family has provided a Maintenance Bond to guarantee the completed work for a one-year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed with said project are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by Insco Insurance Services, Inc., (Bond No. 867550S) in the amount of $1,255,000.00 be released; and 3. The original Labor and Materials Bond issued by Insco Insurance Services, Inc., (Bond No. 867550S) in the amount of $1,255,000.00 be released; and 4.
