Rule 20A funds. Some of the associated work, such as replacement of street lights that are currently on existing wood utility poles, is not covered under Rule 20A funds and will be paid for from the Dougherty Road Improvements, Houston Place to 1-580, Capital Improvement Project. The City has an estimated balance of $112,000 in its P.U.C. Rule 20A account as of FY 2003-2004 and will accrue additional funds at a rate of approximately $131,000 per year. PG&E allows cities to "borrow out" funds three years in advance of the project; based on this assumption, the funding available at the beginning of Fiscal Year 2005-2006, including the "borrowed" funds, would approximately be $636,000. The other utility companies are required to underground their own facilities at their own cost. Rule 20A allocation use. The existing utilities are expected to be undergrounded in conjunction with the adjacent development project and/or paid for by the utility companIes. DESCRIPTION: This is the second reading of a proposed Ordinance that was introduced at the City Council meeting on September 7, 2004. At the City Council meeting of December 16, 2003, the City Council adopted a Resolution of Intention to form Underground Utility District 2003-01 (Dougherty Road from Sierra Lane to Dublin Boulevard, and Dublin Boulevard from Dublin Court to Dougherty Road), setting public hearing dates of January 6 and February 3, 2004, for consideration of an Ordinance establishing the District. On February 3rd, the City Council adopted the Ordinance establishing this District. This project is intended to coincide with the Dougherty Road Improvements, 1-580 to Houston Place project. The improvement project is scheduled for construction in Fiscal Year 2005-2006, and it is proposed that the undergrounding of utilities take place in conjunction with or prior to the construction of the project. Based on the information provided by Pacific Gas and Electric (PG&E) for the available funding balance in the Rule 20A allocation, and on the projected annual accumulation and allowable "borrow out" provisions, it is estimated that a total amount of $636,184 in Rule 20A funding will be available in Fiscal Year 2005-2006. The estimated cost of undergrounding the facilities is $561,000. As a result of a preliminary walk-through of the original project site with representatives of the utility companies, it was determined that none of the existing businesses within the project limits have overhead services from the utility poles to be undergrounded. With the addition of a portion of Scarlett Court, the uses in that area would be required to be undergrounded; however, it is anticipated that these uses will no longer need service at the time the undergrounding takes place, with the exception of 6363 and 6393 Scarlett Court where service comes from utility poles outside the District's limits. The following properties would be included in the expanded District. The original district encompassed those properties with a Dublin Boulevard or Dougherty Road address. The extended district boundaries include those properties with a Scarlett Court address. Page 2 L5b~. ,~ ORDINANCE NO. ·04 AN ORDINANCE OF THE CITY OF DUBLIN ********* AMENDING UNDERGROUND UTILITY DISTRICT 2003·01 ON DOUGHERTY ROAD FROM DUBLIN BOULEVARD TO SIERRA LANE AND ON DUBLIN BOULEVARD FROM DUBLIN COURT TO DOUGHERTY ROAD, ADDING SCARLETT COURT FROM DUBLIN BOULEVARD TO A POINT 700 FEET SOUTH OF DUBLIN BOULEVARD WHEREAS, on December 2,2003, the City Council received a report from the Director of Public Works regarding undergrounding of utilities on segments of various City streets and subsequently determined that the highest priority for undergrounding is the segment of Dougherty Road from Dublin Boulevard to Sierra Lane and on Dublin Boulevard from Dublin Court to Dougherty Road; and WHEREAS, on December 16, 2003, the City Council adopted Resolution No. 238-03, a Resolution of Intention to form Underground Utility District 2003-01 on Dougherty Road from Dublin Boulevard to Sierra Lane and on Dublin Boulevard from Dublin Court to Dougherty Road; and WHEREAS, notices of adoption of the Resolution of Intention were published, posted, and mailed to property owners and utilities as provided in Municipal Code Section 7.12.080; and WHEREAS, public hearings were held on January 6 and February 3, 2004, for the purpose of hearing protests or objections to the proposed District; and WHEREAS, no protests or objections were received, and Ordinance No. 04-04 was adopted forming Underground Utility District 2003-01; and WHEREAS, on August 3,2004, the City Council adopted Resolution No. 155-04, a Resolution of Intention to Amend the boundaries of Underground District 2003-01, and setting public hearings for September 7 and September 21, 2004; and WHEREAS, notices of adoption of the Resolution of Intention were published, posted, and mailed to property owners and utilities as provided in Municipal Code Section 7.12.080; and WHEREAS, Public Hearings were held on September 7 and September 21,2004, for the purpose of hearing protests or objections to the proposed District; and WHEREAS, no protests or objections were received; NOW, THEREFORE, the City Council of the City of Dublin does ordain as follows: Section 1: City of Dublin Underground Utility District 2003-01 on Dougherty Road from Sierra Lane to Dublin Boulevard, and on Dublin Boulevard from Dublin Court to Dougherty Road, is amended to add Scarlett Court from Dublin Boulevard to a point 700 feet south of Dublin Boulevard, as delineated on the map, Exhibit "A", attached hereto. 1 ~ -2.1 -D4 {¿,. .2..
