PROJECT DESCRIPTION: On January 20, 2004, the City Council adopted Ordinance 2-04, approving a one-year extension to the development moratorium in the Donlon Way area in order to give the City time to prepare and adopt a specific plan with design guidelines intended to protect and preserve the historical resources of the region. During this time, it was anticipated that Staff would accomplish the following tasks: 1. Complete Design Guidelines; 2. Evaluate the historical district designation potential; 3. Assess the appropriate uses in the Specific Plan area; 4. Prepare appropriate development regulations that address setbacks, views, access, open space, and architectural considerations; 5. Evaluate future infrastructure needs and existing economic constraints; and 6. Prepare the Specific Plan. Tasks 1, 2 and 4: Design Guidelines, Historic District Study, and Development Regulations On August 3, 2004, the City Council approved the execution of a contract with RBF Consulting to create Design Guidelines for the future development in the proposed Donlon Way Historic Specific Plan Area (Attachment 1). The consultants begun their work on this process, and met with the Heritage and Cultural Arts Commission on September 9, 2004 to discuss the Commission's vision for the future of the greater Donlon Way area and receive their input on a variety of design and architectural issues. Property Owners in the area were invited to the meeting and three attended. The consultants are currently in the process of preparing the Administrative Draft of the guidelines for Staffs review, which will also include appropriate development regulations that address setbacks, views, access, open space, and architectural considerations and recommendations on methods to preserve the City's historical and cultural resources. Staffs efforts to evaluate the historical district designation potential are also underway. COPIES TO: lObG ITEM NO. A formal discussion with the City Council of the tasks described above will come at a later date. Task 3: Assess the appropriate uses in the Specific Plan area The City Council has also directed Staff to examine and assess the existing land uses in the Specific Plan area to determine of any changes are appropriate. Although the site is oflocal significance, the zoning for the property Vacant is Agriculture, which has very limited options in terms of permitted land uses: single family home, animal keeping operation, community facility, and uses such as a cemetery are permitted conditionally. The commercial development of this site would require Site Development Review, which would permit the City to examine plans for the site to ensure they are compatible with surrounding historic resources. No land use changes recommended to be studied. 7100 San Ramon Road Privately owned. Although the site contains a very valuable historic resource, Alamilla The Springs Apartmems Springs, the existing apartment complex does not interfere with the existence of the resource. No land use changes recommended to be studied. However, Staff will study the best method to require the preservation of Alamilla Springs on the property and preserving public access to the resource. Property Owner Meeting In addition to presenting the City Council with this summary and analysis, City Staff also met with area property owners to solicit their input on the zoning and land uses in the area to hear their opinions on possible land use changes and development in the historic area and discuss the possibility of creating a historic district. Sixteen property owners were invited to the meeting and six attended (See Attachment 3). In general, the property owners present expressed satisfaction with the existing zoning for their individual properties and did not have any proposals to change land use designations or permitted uses, with the exception of the representative of the Dublin Square Shopping Center site, who stated he would support a change to a commercial and residential mixed-use land use designation. There was general consensus among property owners present that the boundary of the proposed Historic Area Specific Plan should be revised to include only those properties west of San Ramon Road. There was also general consensus among the group that any regulations that restricted property owners' abilities to utilize their properties would not be supported. Page 4 of5 Other efforts underway in the proposed Specific Plan area that impact the land use discussion In October 2003, the City Council identified six potential locations for future parks in Dublin in order to correct the City's anticipated 5.3-acre parkland deficit as detailed in the Parks and Recreation Master Plan. The Dublin Square Shopping Center and the See's Candy sites ranked numbers one and three in the priority list. On May 18, 2004, the City Council authorized Staff to proceed with appraisals and environmental work on the Dublin Square Shopping Center and Alameda CountylUnion Pacific Right of Way sites and approved a budget change to fund the studies. Although work on the appraisals has begun, the results of the appraisals and environmental analyses for the two sites will not be available for several months. The results of the appraisals and environmental analyses will allow the City Council to assess the feasibility of using the sites for park purposes. If the City Council determines that it is desirable to designate either site for a park, a programming study and General Plan Amendment Study to designate the site as a park would be the next step. This could happen as early as December 2004. Because of these efforts, Staff recommends the City Council defer discussion of what land use changes (if any) it would like to see studied for the site if the site is not designated for a park until a determination has been made whether or not to designate the property for park purposes. Staff will proceed with the land use analysis portion ofthe Specific Plan in the interim. Next Steps: After tonight's meeting, Staff will work on further analysis of those land use changes (if any) directed by the City Council. The Draft Design Guidelines for the area will be completed and Staff intends to return to the City Council in late November with a status report and further discussion. Conclusion: There are a number of efforts underway in the Donlon Way area aimed at retaining and enhancing the City's historic resources, and Staff and consultants are in the process of completing this work. At this point, Staff is seeking direction from the City Council only on what potential land use changes should be considered for the Donlon Way Specific Plan area. Discussion of the developing Design Guidelines, evaluating the area's Historical District designation potential and how best to protect the valuable historic resources present in the community, and formalizing the boundaries of the proposed Specific Plan area will come at a later date. RECOMMENDATION: Receive staff report and provide direction to Staff on land use changes that should be considered as part ofathe Specific Plan study. Are there any suggestions for land use changes? Is there desire for the creation of a cohesive historic district? Property owners had the following comments about the proposed Historic Specific Plan: Mr. Pillars stated that there was no reason to include any properties east of San Ramon Road in the historic area. He requested that those properties be removed from the historic area immediately. He submitted a formal request to the City to remove their property from the proposed Historic Specific Plan area and to not include it in the Design Guidelines being prepared for the area. He also stated that traffic at the San Ramon/Dublin intersection is very high. ATTACHMENT ~ tt~4 Mr. Roberts stated that they are having trouble redeveloping the Dublin Square Shopping Center site because they have been "jerked around" by the City ever since they proposed an office complex for their property, which was denied. He is concerned that historic district designations can devalue the worth of buildings, and that they want to know what the permitted uses are and the associated restrictions before any public hearings. They are interested in seeing a mixed use zoning designation on their site. Ms. Johnson stated that she is interested in possibly expanding her building and is not sure how new restrictions or land use changes might impact her. She does not think that the existing zoning on the site is problematic. Mr. Stem stated that the existing zoning allows them to do what they want to do with the site, but he cannot understand why the See's site is considered historic just because of the oak trees. He hopes that any zoning changes will not prevent them from building what they want to on the property. He does not think that the existing zoning on the site is problematic. Mr. Gregory doesn't know if a historic district designation would help or hurt them - they are already restricted by what they can and cannot do to the Green Store building by the Planned Development Zoning approved for the property. Would probably not support the creation of a historic district that added more restrictions. Mr. and Mrs. Hagen added that they do not want any land use changes that would prohibit them from continuing to live and operate their business on their property. They stated that the Ailanthus (Tree of Heaven) growing in Dublin Creek and near the cemetery are choking out native trees on their property and on the City's. Mr. and Mrs. Hagan also suggested that a sound wall (perhaps with a painted mural?) be installed along 1-580 to buffer the historic area from freeway noise. The property owner meeting concluded with Staff summarizing the schedule of the Historic Specific Plan project and the timing for the next steps in the process. Staff thanked everyone for attending.
