Thompson, Public Works Director ATTACHMENTS: 1) Resolution 2) Location Map RECOMMENDATIONi// /A j~ Adopt Resolution accepting improvements for Parcel Map 7250, \ c/" General Motors AutoMall and John Monego Court FINANCIAL STATEMENT: Argonaut Holdings, Inc., on behalf of General Motors (GM), has provided Maintenance Bonds of $250,000 and $125,000 to guarantee against defects for one year. Once improvements have been accepted, the City will incur maintenance and street sweeping costs for John Monego Court. Street light maintenance costs shall be paid by Citywide Street Light Maintenance Assessment District 83-1. Landscape improvements along the project's frontage on Dublin Boulevard will be maintained by the Landscape Assessment District. The median landscaping within and at the entrance to John Monego Court will be maintained by GM. DESCRIPTION: Parcel Map 7250 is located within the Eastern Dublin Specific Plan area, bounded by Tassajara Creek on the west, Tassajara Road on the east, 1-580 on the south, and Dublin Boulevard on the north. GM (Argonaut Holdings, Inc.) owns Parcels 1, 2, and 3 created with Parcel Map 7250. Parcel 4 was later resubdivided and developed as the Koll Dublin Corporate Center. Improvements installed as part of the GM AutoMall project consist of the-construction of John Monego Court, including streetlights, sidewalk, utilities, signing, striping, curb, gutter, drainage, landscaping improvements, and frontage improvements on Dublin Boulevard. These improvements have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of the Director of Public Works. At the time the City and Argonaut Holdings, Inc., executed the Tract Developer Agreement, the developer provided Performance Bonds of $1,000,000 and $500,000, and Labor and Materials Bonds of $500,000 COPIES TO: Moya Kelly, General Motors Dean Sullivan, Barnes Constr. ~ ~.., ITEM NO. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with Maintenance Bonds in amounts necessary to guarantee against defects for a one-year period following acceptance of the work. The developer has now provided Maintenance Bonds of $250,000 and $125,000, which are 25% of the original Performance Bond amounts for the improvements, and which are sufficient to guarantee the one-year period upon acceptance. Staff recommends that the City Council adopt the resolution accepting improvements for Tract 7250, General Motors AutoMall and John Monego Court. RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF IMPROVEMENTS FOR PARCEL MAP 7250, GENERAL MOTORS AUTOMALL AND JOHN MONEGO COURT (ARGONAUT HOLDINGS, INC.) WHEREAS, the subdivider of Parcel Map 7250, filed on December 23, 1998, Recorder Series No. 98-449709, in Book 243 of Parcel Maps at Pages 74 through 81, previously entered into an agreement with the City of Dublin to construct certain improvements required to be completed with said Parcel Map in accordance with plans and specifications on file with the City Engineer, said identified as follows: a) Subdivider: Argonaut Holdings, Inc. b) Parcel Map Location: Bordered by Tassajara Creek, Tasajara Road, 1-580 and Dublin Boulevard c) Parcel Map Size: Parcel 1: 3.131 acres Parcel 2: 2.803 acres Parcel 3: 7.548 acres Parcel 4: 33.342 acres d) Resolution Approving Agreement: 164-98, City of Dublin City Council e) City Streets Affected: John Monego Court WHEREAS, the improvements associated with Parcel Map 7250 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the original Performance Bond and Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee maintenance of the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Parcel Map are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Faithful Performance Bond issued by National Fire Insurance Company of Hartford (Bond No. 9080974) in the amount of $1,000,000.00 be released; and 3. The original Labor and Materials Bond issued by National Fire Insurance Company of Hartford (Bond No. 9080974) in the amount of $500,000.00 be released; and 4. The original Faithful Performance Bond iSsued by National Fire Insurance Company of Hartford (Bond No. 9090561) in the amount of $500,000.00 be released; and 5. The original Labor and Materials Bond issued by National Fire Insurance Company of Hartford (Bond No. 9090561) in the amount of $250,000.00 be released; and 6. The submitted Maintenance Bond issued by Safeco Insurance Company of America (Bond No. 6198854) in the amount of $250,000.00 be accepted as security for the aforesaid one- year maintenance period, said period to commence on this date and terminate on the 4th day of February, 2004; and 7. The submitted Maintenance Bond issued by Safeco Insurance Company of America (Bond No.6198855) in the amount of $125,000.00 be accepted as security for the aforesaid one- year maintenance period, said period to commence on this date and terminate on the 4th day of February, 2004. PASSED, APPROVED AND ADOPTED this 4th day of February, 2003.
