Thuman Chairman, Dublin "Relay for Life" 2) Shannon Community Center Facility Use Policy RECOMMENDATION: ~/~ ~ Consider Request FINANCIAL STATEMENT: Estimated Lost Fee Revenue: $110 - $450 DESCRIPTION: The American Cancer Society has reserved the Shannon Community Center on Friday, March 28, 2003 for a fundraiser for the Dublin "Relay for Life". Chairman for the event, Gary L. Thuman, has submitted a written request for reclassification and fee waiver under the Shannon Community Center Facility Use Policy. Under the current Facility Use Policy for the Shannon Community Center the American Cancer Society would be classified as a Group 5 - Individual or Other Group. The American Cancer Society has asked to be reclassified as a Group 4 - Dublin Charitable and Social Welfare Organization. To qualify under the Group 4 classification, the group must be an organized non-profit group with current 501(c)(3) or 501(c)(4) IRS status, whose membership is open to the public and whose primary purpose is to serve the Dublin community. Further, the organization's membership must be at least 51% Dublin residents. Although the American Cancer Society is based in Dublin and serves the Dublin community, because of how it is organized, it does not have an actual membership base of 51% Dublin residents. The American Cancer Society has also asked that fees be waived for use of the Shannon Community Center. A comparison of the applicable rental fees for use by the two different classifications based on the proposed five-hour rental by the American Cancer Society are shown below. Group 4 - Dublin Charitable and Social Welfare Organization ($68/hour) $340.00 Group 5 - Individual or Other Group ($90/hour) $450.00 Difference $110. O0 In addition to the fees shown above, a $250 Security Deposit (refundable) is required and groups must provide evidence of liability insurance covering bodily injury and property damage at a minimum limit of $1,000,000 per occurrence. The American Cancer Society is agreeable to putting forth the Security Deposit and Insurance Certificate. It should be noted that revisions to the current Facility Use Policy for the Shannon Community Center were adopted by the City Council in October 2002. This included revisions to the user group classifications. Specifically, the Council clarified the criteria related to Dublin Charitable and Social Welfare Organizations to give priority to resident organizations that serve the Dublin community and reduce the discount given to non-resident groups. New fee schedules were also adopted by the City Council in October 2002 and while the Council supported waiving certain fees for Dublin Charitable and COPIES TO: ca~y L. Although in the past the City Council has granted waivers to the Facility Use Policies for certain facilities, there have been no waivers granted since the policies were revised in October 2002. If the City Council is inclined to grant the request of the American Cancer Society, this could set a precedent for other charitable and social welfare organizations who are organized similarly to the Cancer Society. Consequently, the City Council may want to revisit the criteria for use under this classification. Staff has identified the following options for consideration by the City Council: 1) Approve request to reclassify the American Cancer Society and waive rental fees (lost fee revenue to City - $450) 2) Approve request to reclassify the American Cancer Society but deny request to waive rental fees (lost fee revenue to City - $110) 3) Deny both requests RECOMMENDATION: It is the recommendation of Staff that the City Council consider the request of the American Cancer Society and provide Staff with appropriate direction. Based on the City' s new policy, the American Cancer Society qualifies as a Group 5, Non-Resident/Other Group, which would require an hourly rate fee. I am requesting consideration for a reclassification to a Group 4 status (Dublin based charitable or social welfare group). The office for the Tri-Valley Unit of the American Cancer Society has been located in the City of Dublin for many years and directly supports Dublin residents who are cancer patients. The "Relay for Life" fundraiser is a community event that has collected nearly $400,000 in the past five years which has helped to provide for educational and support programs, patient transportation for treatment, tobacco and drag education programs in all Dublin schools, and as a resource center for wigs and prostheses for cancer patients.
