AGENDA STATEMENT CITY COUNCIL MEETING DATE: MARCH 4f 2003 SUBJECT: Approval of Easement Conveyances for Recycled Water Pump Station R20A at Ted Fairfield Neighborhood Park to Dublin San Ramon Services District (DSRSD) Report Prepared by: Lee S. DESCRIPTION: On September 5, 2000, the City entered into an agreement with DSRSD that allowed DSRSD to construct and maintain a recycled water pump facility (Pump Station R20A) within the Ted Fairfield Neighborhood Park (Park Site) located in Dublin Ranch. The pump facility was needed to provide recycled water to Eastern Dublin. The agreement contemplated easement conveyances from the original property owner, MSSH Dublin Development LLC, to DSRSD for access and maintenance of the pump facility and pipelines. However, the City recently acquired title to the Park Site via a Grant Deed from MSSH Dublin Development LLC. As a result, the City must now convey the easements to DSRSD. The three separate Grant of Easement documents include a Site Easement that allows DSRSD exclusive use of the pump building, although City access to the restrooms and drinking fountains would be allowed, a Pipeline Easement that allows DSRSD exclusive access to DSRSD's buried pipes, and a Driveway Easement that allows DSRSD non-exclusive ingress and egress rights to the pump building. Staff recommends that the City Council adopt the Resolution approving Easement Conveyances for Recycled Water Pump Station R20A to Dublin San Ramon Services District (DSRSD) on Parcel B of Tract 6960 (Ted Fairfield Neighborhood Park). COPIES TO: Bert Michalczyk, DSRSD 4._4 G:\DEVELOP\Dublin Ranch\Neighborhood Park~agst easement DSRSD_6960.doc //e~g~ / A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVAL OF EASEMENT CONVEYANCES FOR RECYCLED WATER PUMP STATION R20A TO DUBLIN SAN RAMON SERVICES DISTRICT (DSRSD) ON PARCEL B OF TRACT 6960 (TED FAIRFIELD NEIGHBORHOOD PARK) WHEREAS, on September 5, 2000, the City of Dublin (City) and Dublin San Ramon Services District (DSRSD) entered into an Agreement Regarding Recycled Water Pump Station R20A for construction and operation of a pump facility within the Ted Fairfield Neighborhood Park (Park Site) located in Dublin Ranch; and, WHEREAS, the agreement contemplated three easement conveyances from the original property owner, MSSH Dublin Development LLC, to DSRSD for access to and maintenance of the pump facility and pipelines; and, WHEREAS, the City of Dublin acquired title to the Park Site via a Grant Deed recorded on November 4, 2002. as series No. 2002503363 from MSSH Dublin Development LLC, thus necessitating easement conveyances by the City to DSRSD; and WHEREAS, DSRSD has presented three Grants of Easement to the City for execution as follows: Grant of Easement (The "Puml~ Station R20A Site Easement") Grant of Easement (The "Puml~ Station R20A Pipeline Easement") Grant of Easement (The "Pumt~ Station R20A Driveway Easement") WHEREAS, the Grants of Easement are in conformance with the easement conveyances contemplated by the original agreement; NOW, THEREFORE, BE IT RESOLVED that the easements on Parcel B of Tract 6960, as more particularly described on each of the three Grants of Easement referenced herein, are hereby granted to DSRSD and will remain in full force and effect. BE IT FURTHER RESOLVED that the City Council hereby directs and authorizes the Mayor to execute each of the three Grants of Easement. BE IT FURTHER RESOLVED that the City Clerk shall assure that all three executed Easement Conveyance Deeds, along with a certified copy of this Resolution attached to each, are returned to DSRSD for subsequent acceptance and recording. Tax exempt effective November 10, 1969 GRANT OF EASEMENT (THE "PUMP STATION R20A PIPELINE EASEMENT") THIS GRANT OF EASEMENT ("Agreement") is made as of the __ day of ., 2003, by City of Dublin, a Municipal Corporation ("Grantor/City") to the DUBLIN SAN RAMON SERVICES DISTRICT ("Grantee/DSRSD"). RECITALS A. Grantor CITY acquired title to certain real property, located in the City of Dublin, County of Alameda, State of California via a Grant Deed recorded as-Series No. 2002503363 on November 4 , 2002, which will be developed as Ted Fairfield Neighborhood Park ("Parcel B" of Tract 6960 recorded in Book 242 of Maps at pages 85-95 on 4/07/99). B Grantee desires to acquire certain rights in that part of Parcel B as follows: access to the underground property 'located in Dublin Ranch Park to install, maintain and operate pipelines which are necessary for the operation of the Recycled Water Pump Station R20A; and Grantee has requested a non- exclusive easement in, upon, under, over, across, and through that certain and limited portion of Parcel B, as more particularly described in Exhibit "A", and shown on Exhibit "B", attached hereto and incorporated by this reference (the "Pump Station R20A Pipeline Easement" and/or "Servient Tenement"). NOW, THEREFORE, for valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereby agree as follows: 1. Grant of Easement. Grantor he;eby grants to Grantee a non-exclusive easement in, upon, under, over, across, and through the Servient Tenement described in Exhibit "A", and shown on Exhibit "B", including the right of ingress and egress for the purpose of installing, operating, repairing, replacing, and making improvements to the pipelines of the Recycled Water Pump Station R20A. 2. Character of Easement. The easement granted in this Agreement is appurtenant to the "Pump Station R20A Site Easement", granted to DSRSD by City of Dublin on 3. Description of Easement. The easement granted in this Agreement is an easement for pipelines. For the purposes of this Agreement, "pipeline purposes" means use for and by the Grantee connected with the use of the Servient Tenement and/or the operation of the Recycled Water Pump Station R20A. Page 1 of 3 ~. 4. Term. The easement granted in this Agreement shall be for an indefinite term. 5. Exclusive Easement. The Easement granted in this Agreement is non-exclusive. Grantor retains the right to make use of the Servient Tenement, including the right to grant concurrent easements in the Servient Tenement to third parties that do not interfere unreasonably with the Grantee's free use and enjoyment of the access easement. 6. Maintenance of Easement. Grantor shall maintain the surface of the Servient Tenement in good repair, at Grantor's sole cost and expense. Grantee shall be responsible for costs incurred in the maintenance, repair or replacement of the pipelines and restoration of the surface following any such-work. 7. Binding Effect and Governing Law. The covenants, agreements, and restrictions set forth in this Agreement constitute covenants running with the land and shall be binding upon the parties hereto and their respective heirs, successors, and assigns. This Agreement shall be governed and construed in accordance with. the laws of the State of California. 8. Paragraph Headings. ParagraPh headings as used herein are for convenience only. and shall not be deemed to be a part of any such paragraph and shall not be construed to change the meaning thereof. 9. Notices.
