CITY COUNCIL MEETING DATE: March 4, 2003
SUBJECT: Acceptance of Improvements for Parcel Maps 7116 and 7223,
"Hacienda Crossing" at Opus Retail Phases I, II and III
(Opus West Construction Corporation)

RECOMMENDATION: Adopt the Resolution accepting the improvements installed for
. Parcel Maps 7116 and 7223, "Hacienda Crossing"
FINANCIAL SW_~AT~EMENT: Once these improvements have been accepted, the City will incur
maintenance costs for the City street improvements On Dublin
Boulevard and Hacienda Drive. The City will maintain the public
landscaping improvements between the curb and sidewalk as part of
Santa Rita Area Landscape Maintenance Assessment District 97-1.
Per an agreement with Department of Transportation (Caltrans),
landscaping along the 1-580 frontage will be maintained for 20 years
by Opus, after which time, maintenance will be taken over by the
State.
DESCRIPTION: The "Hacienda Crossing Shopping Center" is located in Eastern
Dublin and is bordered by Dublin Boulevard, Hacienda Drive and 1-580. This project consists of retail
stores, restaurants, a movie theatre, and other commercial businesses as part of the Hacienda Crossing
Commercial Center Project in Eastern Dublin Specific Plan area. The Conditions of Approval for Parcel
Maps 7116 and 7223 (Hacienda Crossing Shopping Center) required that the developer, Opus West
Construction Corporation, design and construct public improvements on Dublin Boulevard and Hacienda
Drive. These improvements included modifications to the existing pavement striping, traffic signals,
streetlights, landscaping and irrigation system. The developer also installed landscaping along the project
frontage and 1-580 frontage within the State right-of-way. These improvements have been constructed
pursuant to the Tract Developer Agreement and completed to the satisfaction of the City Engineer, and
should now be accepted by the City for maintenance.
As part of the project, the developer widened and installed a northbound right-turn lane on Hacienda
Drive between the southerly driveway of Hacienda Crossing and Dublin Boulevard, an eastbound

right-turn lane on Dublin Boulevard between Hacienda Drive and Hibernia Drive, and landscaping
frontage improvements adjacent to Hacienda Crossing and the Amerisuites Hotel. These improvements
were constructed under a separate Tract Developer Agreement and were accepted by City Council
Resolution No. 222-02 on December 3, 2002. The developer provided a Maintenance Bond in the amount
of $75,000 to guarantee against defects in the improvements to Dublin Boulevard and Hacienda Drive.
Staff recommends that the City Council adopt the Resolution accepting the improvements installed for
Parcel Maps 7116 and 7223, "Hacienda Crossing".

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS FOR PARCEL MAPS 7116 AND 7223 "HACIENDA
CROSSING"AT OPUS WEST RETAIL PHASES I, II AND III
(OPUS WEST CONSTRUCTION CORPORATION)
WHEREAS, the subdivider of Parcel Map 7116 filed on October 1, 1997, in Book 232 of Parcel
Maps at Pages 53 - 56, and Parcel Map 7223 filed on February 10, 1998, in Book 234 of Parcel Maps at
Pages 45 - 48, previously entered into a Tract Developer Agreement with the City of Dublin to construct
improvements in accordance with plans and specifications on file with the City Engineer, said project
identified as follows:
a) Developer: Opus West Construction Corporation, a
Minnesota Corporation
b) Location: Southeast Comer of Dublin Boulevard and
Hacienda Drive
c) Resolution Approving Agreement: 150-97, City Council of Dublin
d) City Streets Affected: Dublin Boulevard and Hacienda Drive
WHEREAS, the improvements associated with Parcel Maps 7116 and 7223 are complete in
accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction
of the City Engineer; and
WHEREAS, the original $4,656,921.36 Performance Bond and $2,328,460.68 Labor and
Materials Bond posted to guarantee the improvements associated with Parcel Map 7223 was reduced by
$300,000.00 each via City Council Resolution No. 222-02 adopted on December 3, 2002; and
WHEREAS, the remaining original $4,356,921.36 Performance Bond and $2,028,460.68 Labor
and Materials Bond posted to guarantee the improvements associated with Parcel Maps 7116 and 7223
can be released in accordance with the authority contained in §66499.7 of the Government Code of the
State of California; and
WHEREAS, the improvements are guaranteed by a Maintenance Bond issued by American
Insurance Company (Bond No. 929256012) in the amount of $75,000.00 and previously accepted via
City Council Resolution No. 222-02;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within Parcel Maps 7116 and 7223 are hereby approved and
accepted subject to a one-year guarantee period.
2. The original Performance Bond issued by American Insurance Company (Bond No.
11119418827) in the amount of $4,656,921.36, and reduced by $300,000.00 via City
Council Resolution No. 222-02, be fully released.
3. The original Labor and Materials Bond issued by American Insurance Comp~tny (Bond No.
1111941882) in the amount of $2,328,460.68, and reduced by $300,000.00 via City
Council Resolution No. 222-02, be fully released.
